On April 30, 2021, a public discussion of the draft amendments to TR CU 007/2011 "On the safety of products intended for children and adolescents" began, which will last until July 30, 2021.
The draft amendments are aimed at establishing forms, schemes and procedures for conformity assessment based on the standard conformity assessment schemes adopted by the decision of the EEC Council No. 44 of April 18, 2018.In addition, the provisions of the regulation have been revised based on the requirements of the Protocol on Technical Regulation in the EAEU (Annex No. 9 to the Treaty on the EAEU of May 29, 2014) and the practice of its application. In this regard, from article 2 "Definitions" of the rules, it is proposed to exclude the terms that are fixed by the provisions of the Treaty. This applies to the following concepts: "release into circulation", "manufacturer", "importer" and "person authorized by the manufacturer". In the new version, according to the principles of the documents mentioned above, it is proposed to set out two articles of the regulations: article 10, which defines the principles of ensuring compliance with safety requirements" and article 12, concerning the procedures for assessing the conformity of products. As for article 10, the draft provides for a more detailed description of the application of standards from the lists of the document on standardization, which were adopted in order to comply with the requirements of TR CU 007/2011 (approved by the decision of the CCC No. 797 of September 23, 2012). With regard to article 12, we note that in fact the certification and declaration schemes remained unchanged, as for state registration, but it is planned to establish numbered schemes here:
1p-for products produced in the territory of the EAEU;
2p – for products manufactured outside the EAEU.
The draft amendments provide for the establishment of mandatory requirements for the set of documents required for the implementation of conformity assessment of products, as well as the procedure for conducting conformity assessment procedures. The draft amendments do not affect the lists of children's products that require the registration of permits for conformity assessment. It is planned that the new version of TR CU 007/2011 will be applied only after 6 months from the date of official publication of the decision on the adoption of changes by the EEC Council. It should be noted that a draft decision of the EEC Board has already been prepared, which sets out the procedure for introducing changes. According to the document, it is not necessary to reissue the permits for conformity assessment adopted before the entry into force of the innovations.
