Regulations of the Republican State Institution " Department of the Committee for Technical Regulation and Metrology of the Ministry of Trade and Integration of the Republic of Kazakhstan in the Akmola region»
1. General provisions
1. The Republican state institution "Department of Committee of technical regulation and Metrology of the Ministry of trade and integration of the Republic of Kazakhstan in Akmola region" (hereinafter – the Department) is a territorial subdivision of the Republican state institution "Committee of technical regulation and Metrology of the Ministry of trade and integration of the Republic of Kazakhstan" (hereinafter - the Committee).
2. The Department carries out its activities in accordance with the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
3. The Department is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan.
4. The Department enters into civil relations on its own behalf or on behalf of the Committee, if it is authorized to do so.
5. The Department makes decisions on issues of its competence, which are issued by the orders of the head of the Department.
6. The structure and staffing of the territorial body shall be approved by the Executive Secretary of the Ministry of Trade and Integration of the Republic of Kazakhstan in coordination with the Minister of Trade and Integration of the Republic of Kazakhstan.
7. Full name of the Department:
in the state language – "Kazakhstan respublikasy Saud and integration of Technical ministrels rettew and Metrology KOMITET Akmola region boiynsha Department" Memlekettik respublikasy becames;
in Russian – Republican State Institution "Department of the Committee of Technical Regulation and Metrology of the Ministry of Trade and Integration of the Republic of Kazakhstan in the Akmola region".
8. Location of the Department: 020000, Republic of Kazakhstan, Akmola region, Kokshetau city, Auelbekov Street, 117.
9. The founder of the Department is the state represented by the Government of the Republic of Kazakhstan.
10. Financing of the Department's activities is carried out at the expense of the republican budget.
11. If the Department is granted the right to carry out income-generating activities by legislative acts, the income received from such activities is directed to the state budget revenue.
12. The Department is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the Department.
2. Main tasks, functions, rights and responsibilities of the Department
13. Task: control in the field of technical regulation, ensuring the uniformity of measurements, legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment and in the field of sale of jewelry and other products made of precious metals and precious stones.
14. Functions:
1) organization and conduct of state metrological control;
2) implementation of state control in the field of technical regulation, with the exception of the field of food safety;
3) monitoring compliance with the legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment;
4) implementation of state control when importing into the territory of the Republic of Kazakhstan from countries outside the Eurasian Economic Union and exporting from the territory of the Republic of Kazakhstan to these countries precious stones, jewelry and other products made of precious metals and precious stones, coins made of precious metals;
5) implementation of state control in the sphere of sale of jewelry and other products;
6) issuance of a state control act for each batch of goods when importing into the territory of the Republic of Kazakhstan from countries outside the Eurasian Economic Union and exporting from the territory of the Republic of Kazakhstan to these countries precious stones, jewelry and other products made of precious metals and precious stones, coins made of precious metals;
7) issue of a document on the special registration of individual entrepreneurs and legal entities on the beginning or termination of activities for the import into the territory of the Republic of Kazakhstan from countries outside the Eurasian Economic Union, and export from the territory of the Republic of Kazakhstan to these countries of precious stones, jewelry and other products made of precious metals and precious stones;
8) issuance of the certificate of the international Certification Scheme for rough natural diamonds (Kimberley Process Certificate);
9) preparation of protocols, consideration of cases of administrative offenses and imposition of administrative penalties in accordance with the procedure established by the Code of the Republic of Kazakhstan on Administrative Offenses;
10) implementation of permitting control of the applicant's compliance with qualification or licensing requirements before issuance of the permit and (or) of the Annex to resolution in the order of different forms of control with the possibility of visiting the audited entity, the results of which the decision on compliance or non-compliance of the applicant's qualification or licensing requirements;
11) implementation of the licensing compliance of licensees and permit-holders of the second category of legislation of the Republic of Kazakhstan on permits and notifications after the issuance of the permit and (or) annexes to the resolution (in implementing activities) in accordance with the Business code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan" through inspections;
12) interaction with expert councils for the development of technical regulations, individuals and legal entities on technical regulation issues;
13) preparation of proposals for the establishment of advisory bodies in the interests of ensuring the safety of products, processes;
14) making proposals for the formation of a plan for the development of technical regulations.
15. Rights and obligations of the Department:
1) requests and receives from state bodies, organizations, and their officials the necessary information and materials;
2) exercise other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.
3. Organization of the Department's activities
16. The Department is headed by a head appointed and dismissed by the Executive Secretary of the Ministry of Trade and Integration of the Republic of Kazakhstan.
17. Issues of granting vacations, providing material assistance, training (retraining), advanced training, promotion, payment of allowances and bonuses to the Head of the Department are issued by the order of the Executive Secretary of the Ministry of Trade and Integration of the Republic of Kazakhstan.
18. The Head organizes and directs the work of the Department and is personally responsible for the performance of the tasks assigned to the Department and the implementation of its functions.
19. For this purpose, the Head of the:
1) defines the duties and responsibilities of employees of the Department;
2) Appoints and dismisses employees of the Department;
3) imposes disciplinary penalties and applies incentives to employees of the Department;
4) represents the interests of the Department in other state bodies and other organizations;
5) signs the orders of the Department;
6) approves the Department's work plan;
7) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.
4. Property of the Department
20. The Department has the right of operational management of separate property in cases provided for by law.
21. The property assigned to the Department belongs to the republican property.
22. The Department does not independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of the funds allocated to it under the financing plan, unless otherwise established by law.
5. Reorganization and abolition of the Department
23. Reorganization and liquidation of the Department shall be carried out in accordance with the civil legislation of the Republic of Kazakhstan.
