The return of regulated products due to the absence in the list of producers exporting plant products to the Russian Federation is illegal.

The regulatory legal acts of the Eurasian Economic Union in the field of Plant quarantine do not provide a register of producers exporting plant products.

Moreover, the return of products for reasons not stipulated by the requirements of the law is a violation of the participants’ rights in a foreign economic activity.

Specific cases when the quarantine products are returned or destroyed are provided in the Regulations on the Quarantine Phytosanitary Control (Supervision) Procedure in the Customs Territory of the Eurasian Economic Union and approved by the Decision of the Customs Union Commission No. 318 of June 18, 2010.

Unified quarantine phytosanitary requirements of the Eurasian Economic Union, approved by the Decision of the Council of the Eurasian Economic Commission No. 157 of November 30, 2016, also do not stipulate requirements for presence of a specified register of exporting quarantine products enterprises.

An official letter will be sent to the Rosselkhoznadzor about the unlawful actions of plant quarantine inspectors at the Kazakhstan-Russian border.

In the case of the product return in regards to the list of producers exporting plant products, Kazakhstan will be forced to take similar measures in relation to products imported from the Russian Federation.
