The year 2026 has been declared the Year of Digitalization and Artificial Intelligence in the Republic of Kazakhstan. One of the fully automated systems with elements of artificial intelligence that directly affects the country's economy is the public procurement system.
As part of the implementation of the Action Plan for the implementation of the election program of the Head of State "Fair Kazakhstan - for everyone and for everyone. Now and forever" On July 1, 2024, a new Law "On Public Procurement" was adopted.
The main objectives of the Law are to improve the quality of procured goods, works, and services; to streamline and reduce bureaucracy; and to further automate public procurement procedures.
As part of the implementation of the Law, the widespread use of the procurement method in the form of a tender using a rating-point system continues, where the key factor in determining the winner is not a person, but an automatic algorithm.
The main difference is the exclusion of the human factor. The portal automatically analyzes data from information systems of state bodies (work experience, taxes paid, "territoriality," negative values, etc.) and determines the winner. This is not just a simplification of the process, but a powerful barrier against unscrupulous participants.
The commission does not affect the choice, which means that the results of the purchases are not subject to appeal.
Equal chances for everyone. One of the most interesting criteria for determining the winner is "negative values," working on the principle of fair distribution of volumes among contractors:
- the more contracts you have, the higher the chances of other participants to pick up the next competition, that is, for each existing contract in the current year, the contractor deducts 0.2% of the conditional discount;
- for entering the register of unscrupulous participants over the past 5 years, 0.2% of the conditional discount is also deducted.
If at the initial stage the use of a tender using a rating-point system was only the right of the customer during construction, today it is an obligation for construction and installation work, design and engineering services.
Moreover, in the context of the speed of technological progress, the timing of such tenders was reduced to 5 working days.
Considering the positive dynamics, the Ministry of Finance plans to expand the list of works and services, the purchase of which is carried out exclusively through a tender using a rating-point system.
This helps to identify conscientious contractors (mostly local) as procurement winners as soon as possible.
In addition, the tender using a rating-point system contributes to the development and support of small and medium-sized businesses, will increase tax receipts in the corresponding region, and will also allow demonopolizing the construction market.
