THE PROSECUTOR GENERAL'S OFFICE OF THE REPUBLIC OF KAZAKHSTAN: EVERY FACT WILL BE THOROUGHLY INVESTIGATED BY SUBMITTING AN APPROPRIATE LEGAL ASSESSMENT

For offenses committed during the state of emergency, 6966 protocols on the initiation of administrative proceedings were drawn up, 4918 persons were brought to various types of administrative responsibility, including 1978 people were arrested. Fines were imposed on 791 people and 2,149 were warned. There are 2,048 materials under consideration by the courts.

As of today, investigative and operational groups are investigating 494 criminal cases, including 44 on acts of terrorism, 34 on mass riots, 15 murders, etc.

524 persons suspected of committing crimes were placed in the IVS. 412 persons were taken into custody with the court's sanction.

The necessary investigative actions are currently being carried out.

On suspicion of committing a crime without court approval, detention for no more than 48 hours is possible (Part 2 of Article 14 of the CPC).

But in case of suspicion of committing a particularly serious, terrorist or extremist crime, a crime during mass riots, as well as in a state of emergency, detention for no more than 72 hours is allowed (Part 4 of Article 131 of the CPC).

To prevent an administrative offense, establish the identity of the suspect, and draw up a protocol, detention for up to 3 hours is possible.

If the sanction of the article under which the administrative case is initiated provides for arrest as one of the penalties, then detention for up to 24 hours is possible (Part 3 of Article 789 of the Administrative Code).

Persons who have violated the procedure established in connection with the curfew may be detained until the end of the curfew, and those who do not have documents with them – until their identity is established, for no more than 48 hours (Part 2 of Article 789 of the Administrative Code).
