25th anniversary of the Constitution of Kazakhstan
Kassym-Jomart Tokayev took part in the online plenary session of the international scientific and practical conference "The Constitution of the XXI century – the rule of law, the value of man and the effectiveness of the state" and the IV Congress of the Association of Asian constitutional courts and equivalent institutions.
The President recalled that in 1995, a national referendum adopted the new Constitution of Kazakhstan, which was inspired by the First President – Elbasy Nursultan Nazarbayev, who personally led the work on the preparation of this fundamental document.
– The Constitution has created a solid legal basis for our Independence. Man, his life, rights and freedoms were declared the highest values of the state. In this document, the principles of territorial integrity of the country, social harmony, political stability, the rule of law and democracy are enshrined. The legal, political and socio-economic prerequisites for the formation of a new Kazakh state were determined, the Head of state said.
Kassym-Jomart Tokayev noted that the content of the Constitution is being improved and updated in accordance with the requirements of the time, and this is natural. Kazakhstan is developing dynamically, and the transformation processes have covered the entire world today. Therefore, the text of the Basic law includes additional legal mechanisms and norms that reflect new realities.
– Over a quarter of a century, three constitutional reforms have been implemented with the broad participation of civil society. However, the creative potential of the Constitution has not been exhausted and will be revealed as the necessary socio-economic, political and other prerequisites become available, - the President stressed.
According to the Head of state, today the main tasks facing our country are the consistent strengthening of universally recognized democratic principles, strengthening guarantees of human and civil rights and freedoms.
– The Parliament has adopted a number of important legislative changes on the initiative of the National Council of public trust. Entered into force a fundamentally new law on peaceful Assembly, significantly facilitated the process of establishment and registration of political parties introduced a 30% quota for women and youth in electoral party lists, decriminalized libel, said Kassym-Jomart Tokayev.
The head of state highly assessed the role of the constitutional Council in implementing the provisions of the Basic law. As noted in the speech, this body ensures the supremacy of the Constitution on the territory of the Republic, reveals the content of constitutional requirements. In addition, this year the constitutional Council of Kazakhstan chairs the Association of Asian constitutional courts and the Eurasian Association of constitutional control bodies.
At the end of his speech, the President congratulated the conference participants on the anniversary of the basic law.
– The Constitution of Kazakhstan embodies the rich centuries-old experience and wisdom of the Kazakh people in combination with the advanced achievements of world legal thought. I am sure that the Basic law will continue to serve as a reliable guarantee of the successful political and economic development of our state, Kassym – Jomart Tokayev said.
Gianni Buquicchio, President of the European Commission for democracy through law of the Council of Europe, Zholymbet Baishev, President of the Court of the Eurasian economic Union, Frauke Bahler, Director General of the German Foundation for international legal cooperation, and Gyorgy Szabo, head of the OSCE program Office in Nur-Sultan, made speeches at the conference.
