"Management of Entrepreneurship and Trade
Mangystau region"
Chapter 1. General provisions
Chapter 2. Mission, main tasks, functions, rights and obligations of the state institution "Department of Entrepreneurship and Trade of the Mangystau region"
14. The mission of the state institution "Department of Entrepreneurship and Trade of Mangystau region" is the effective implementation of state policy at the local level in the field of entrepreneurship and trade development.
15. The main tasks of the state institution "Management of Entrepreneurship and Trade of the Mangystau region" are:
creating conditions for the development of private entrepreneurship;
ensuring the implementation of the state trade policy;
implementation of other tasks assigned to the state institution "Department of Entrepreneurship and Trade of the Mangystau region" in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
16. The State Institution "Department of Entrepreneurship and Trade of the Mangystau region", in accordance with the tasks assigned to it, performs the following functions in accordance with the procedure established by law:
1) implements the state policy of support and development of private entrepreneurship in the Mangystau region;
2) ensures and is responsible for the implementation and execution of the state and regional program in the Mangystau region in the field of entrepreneurship and trade;
3) ensures the creation and development of infrastructure facilities in the region to support small and medium-sized businesses;
4) determines the strategy for the development of relations between local executive bodies with associations of private business entities, the National Chamber and market infrastructure facilities;
5) organizes the activities of the expert council, performs the functions of a working body under the expert council on private entrepreneurship under the Akimat of the Mangystau region;
6) provides state support for private entrepreneurship at the local level;
7) organizes education, training, retraining and advanced training of specialists and personnel for small and medium-sized businesses;
8) develops a business support map of the region with the participation of the regional chamber of entrepreneurs;
9) submits proposals to the central authorized body for state planning to determine priority sectors of the economy;
10) performs the functions of a working body under the Regional Coordinating Council for the review of projects within the framework of the implementation of state and regional business support and development programs in the Mangystau region;
11) carries out, within its competence, state control over compliance with the maximum permissible retail prices for socially significant food products in the Mangystau region;
12) carries out, within its competence, the regulation of the activities of the subjects of internal trade of the Mangystau region;
13) organizes exhibitions and fairs aimed at the development of private entrepreneurship in the Mangystau region;
14) carries out organizational measures to provide food and non-food essential goods during the preparation and conduct of command and staff exercises and emergencies in the region;
15) takes appropriate measures to digitalize and ensure information security of the state institution "Management of Entrepreneurship and Trade of the Mangystau region";
16) carries out activities for the development of electronic commerce;
16-1) carrying out work on the organization, planning and ensuring the implementation of mobilization training activities within the competence of the Department of Entrepreneurship and Trade of the Mangystau region;
17) exercises other powers assigned to the state institution "Department of Entrepreneurship and Trade of the Mangystau region".
17. Rights and obligations of the state institution "Management of Entrepreneurship and Trade of the Mangystau region":
Rights of the state institution "Management of Entrepreneurship and Trade of the Mangystau region":
1) to request and receive from state bodies, organizations, institutions and enterprises the necessary documents, information and materials for the implementation of the functions assigned to it to the extent provided for by the current legislation of the Republic of Kazakhstan;
2) interact with local executive bodies, territorial divisions of central executive bodies, organizations and institutions, public associations on issues within its competence;
3) submit proposals on the strategy, priorities and development goals of the region to the Akim of the Mangystau region in accordance with the established procedure;
4) to give binding instructions and issue legal acts within its competence;
5) to convene, in accordance with the established procedure, meetings on issues within its competence with the involvement of managers and specialists of other local authorities;
6) participate in the development of decisions carried out in the field of measures of financial and credit, tax policy, as well as in all other cases affecting the development of entrepreneurial activity;
7) interact with the relevant structures of foreign countries in order to establish business contacts, exchange information and work experience;
8) to involve on a contractual basis Kazakhstani and foreign consultants, advisers and experts on issues within the competence of the state institution "Department of Entrepreneurship and Trade of Mangystau region".
9) sign agreements and other documents on issues of their competence;
10) to carry out its activities in accordance with this Regulation, as well as with the work plans of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
11) exercise other rights provided for by the legislation of the Republic of Kazakhstan.
Responsibilities of the state institution "Department of Entrepreneurship and Trade of the Mangystau region":
12) to provide explanations on issues within the competence of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
13) submit the necessary materials and information within its competence and within the framework of legislation in case of an official request for this by legal entities and individuals;
14) ensure that employees of the state institution "Department of Entrepreneurship and Trade of the Mangystau region" comply with the ethics standards of administrative civil servants;
15) perform other duties within the competence of the state institution "Department of Entrepreneurship and Trade of the Mangystau region".
Chapter 3. Organization of the activities of the state institution "Department of Entrepreneurship and Trade of the Mangystau region"
18. The management of the state institution "Management of Entrepreneurship and Trade of the Mangystau region" is carried out by the first head, who is personally responsible for the fulfillment of the tasks assigned to the state institution "Management of Entrepreneurship and Trade of the Mangystau region" and the exercise of his functions.
19. The first head of the state institution "Department of Entrepreneurship and Trade of Mangystau region" is appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
20. The first head of the state institution "Department of Entrepreneurship and Trade of Mangystau region" has a deputy who is appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
21. Powers of the first head of the state institution "Department of Entrepreneurship and Trade of the Mangystau region":
1) organizes and directs the work of the state institution "Department of Entrepreneurship and Trade of the Mangystau region" and is personally responsible for the fulfillment of the tasks assigned to the state institution "Department of Entrepreneurship and Trade of the Mangystau region" and the implementation of its functions;
2) defines the duties and powers of the deputy first head, heads of departments and employees of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
3) conducts anti-corruption work and is personally responsible for work in this direction;
4) in accordance with the current legislation, appoints and dismisses employees of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
5) in accordance with the procedure established by law, resolves issues of encouragement, provision of financial assistance, imposition of disciplinary penalties on employees of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
6) approves regulations on departments and job descriptions of employees of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
7) within its competence issues orders, gives instructions, signs official documentation;
8) represents the interests of the state institution "Department of Entrepreneurship and Trade of the Mangystau region" in state bodies and other organizations;
9) ensures the observance of gender balance in the nomination of men and women to leadership positions;
10) in accordance with the established procedure, resolves issues of financial, economic and economic activities, controls the rational and targeted execution of budget funds;
11) monitors the implementation of regulatory legal acts, draft programs and other documents on issues within the competence of the state institution "Department of Entrepreneurship and Trade of the Mangystau region";
12) exercise other powers in accordance with the legislation of the Republic of Kazakhstan.
22. The first head determines the powers of his deputy in accordance with the current legislation.
Chapter 4. Property of the state institution "Management of entrepreneurship and Trade
Mangystau region"
23. The state institution "Department of Entrepreneurship and Trade of the Mangystau region" may have a separate property on the right of operational management in cases provided for by law.
The property of the state institution "Department of Entrepreneurship and Trade of the Mangystau region" is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
24. The property assigned to the state institution "Management of Entrepreneurship and Trade of the Mangystau region" belongs to communal property.
25. The state institution "Management of Entrepreneurship and Trade of the Mangystau region" does not have the right to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds allocated to it under the financing plan, unless otherwise established by law.
Chapter 5. Reorganization and abolition of the state institution "Department of Entrepreneurship and Trade of the Mangystau region"
26. Reorganization and abolition of the state institution "Department of Entrepreneurship and Trade of Mangystau region" are carried out in accordance with the legislation of the Republic of Kazakhstan.
