In accordance with subparagraph 23-24) of Article 20 of the Law of the Republic of Kazakhstan dated July 16, 2001 "On Architectural, urban planning and construction activities in the Republic of Kazakhstan" and subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services", I ORDER:

1. To approve the attached Rules on Accreditation of Project Management organizations in the field of architecture, Urban planning and Construction.
2. The Committee for Construction, Housing and Communal Services and Land Management of the Ministry of National Economy of the Republic of Kazakhstan in accordance with the procedure established by law to provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this order, sending a copy of it for official publication in periodicals and in the information and legal system "Adilet";
3) placement of this order on the Internet resource of the Ministry of National Economy of the Republic of Kazakhstan.
3. Control over the execution of this order shall be entrusted to the supervising Vice-Minister of National Economy of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of twenty-one calendar days after the date of its first official publication.

Rules for accreditation of project management organizations in the field of architecture, urban planning and construction

Chapter 1. General provisions
1. These Rules on accreditation of project management organizations in the field of architecture, urban planning and construction (hereinafter – the Rules) have been developed in accordance with subparagraph 23-24) of Article 20 of the Law of the Republic of Kazakhstan dated July 16, 2001 "On Architectural, Urban planning and construction activities in the Republic of Kazakhstan" and subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On public services".
2. The rules regulate the procedure for accreditation of organizations for project management in the field of architecture, urban planning and construction and determine the procedure for the provision of the state service "Accreditation of organizations for project management in the field of architecture, urban planning and construction".
3. The following concepts are used in these Rules:
1) accreditation – the procedure for the official recognition by the authorized body of the authority of the organization for project management in the field of architecture, urban planning and construction;
2) certificate of accreditation – a certificate certifying the status of an organization for project management in the field of architecture, urban planning and construction;
3) the applicant is a legal entity applying for accreditation as a project management organization in the field of architecture, urban planning and construction;
4) authorized body – local executive bodies of regions, cities of republican significance, the capital.
Chapter 2. Rules and qualification requirements
4. The state service "Accreditation of project management organizations in the field of architecture, urban planning and construction" (hereinafter referred to as the state service) is provided by local executive bodies of the regions, cities of Nur–Sultan, Almaty and Shymkent (hereinafter referred to as the service provider) in accordance with these Rules.
5. Legal entities (hereinafter referred to as the service recipient), in order to receive a public service, send an application with documents in the form of an electronic document certified by an electronic digital signature (hereinafter referred to as an EDS) to the service provider via the "electronic government" web portal www.egov.kz (hereinafter referred to as the portal).
The list of basic requirements for the provision of public services, including the characteristics of the process, the form, content and result of the provision, as well as other information, taking into account the specifics of the provision of public services, are set out in accordance with Annex 1 to these Rules in the form of a standard of public services (hereinafter – the Standard of public services).
6. The list of documents required for the provision of public services is determined by paragraph 8 of the Standard of Public Services.
Information of documents on the state registration (re-registration) of a legal entity is provided to the service provider from information systems through the gateway of "electronic government".
The Service Recipient consents to the use of information constituting a legally protected secret contained in information systems.
The status of acceptance of the application for the provision of public services is sent to the service recipient in the "personal account", indicating the date and time of receipt of the result of the public service.
7. Actions that are part of the process of rendering public services, duration of execution:
1) automatic registration of the application with the documents specified in subparagraphs 1) and 2) of paragraph 6 of these Rules;
2) the issuance, reissue of the certificate in electronic form is carried out by an information system (computer) without the participation of the service provider – within 20-40 (twenty - forty) minutes.
8. Accreditation certificates are subject to renewal when the name and (or) location of the legal entity is changed.
9. The service provider ensures that data on the stage of rendering public services are entered into the information system for monitoring the provision of public services in accordance with the procedure established by the authorized body in the field of informatization in accordance with subparagraph 11) of paragraph 2 of Article 5 of the Law.
10. Organizations for project management in the field of architecture, urban planning and construction that have been accredited are included in the Register of accredited organizations for project management in the field of architecture, urban planning and construction, in accordance with Annex 6 to these Rules, which contains a set of information about the details of a legal entity, the date of issue and the number of the certificate of accreditation, the staff of specialists, as well as information about the measures of responsibility taken in relation to this legal entity, established by the laws of the Republic of Kazakhstan.
11. Suspension, renewal, revocation (revocation) of the certificate of accreditation is carried out in accordance with the procedure and (or) on the grounds provided for in Article 45 of the Law of the Republic of Kazakhstan "On Permits and Notifications".
12. It is not allowed to carry out activities by an organization without a valid certificate of accreditation.
13. Amendments and additions are made to the Register of Accredited Organizations provided for in paragraph 10 of these Rules on the basis of an application of an accredited organization in the form in accordance with Annex 7 to these Rules.
At the same time, any changes and additions made do not entail violations of the licensing requirements provided for in Annex 3 of these Rules.
Chapter 3. The procedure for appealing decisions, actions (inaction) of service providers and (or) its officials on the provision of public services
14. A complaint against the decision, actions (omissions) of the service provider on the provision of public services may be filed to the head of the service provider, the authorized body, to the authorized body for evaluation and quality control of the provision of public services in accordance with the legislation of the Republic of Kazakhstan.
15. Complaint of the service recipient in accordance with subparagraph 2) Paragraph 2 of Article 25 of the Law is subject to consideration:
by the service provider, authorized body - within five working days from the date of its registration;
by the authorized body for the assessment and control of the quality of public services - within fifteen working days from the date of its registration.
16. The term of consideration of the complaint by the service provider, the authorized body, the authorized body for the assessment and control of the quality of public services in accordance with paragraph 4 of Article 25 of the Law is extended for no more than ten working days if necessary:
1) conducting an additional study or inspection on a complaint or an on-site inspection;
2) getting more information.
In case of extension of the term of consideration of the complaint, the official authorized to consider complaints, within three working days from the date of extension of the term of consideration of the complaint, informs in writing (when filing a complaint on paper) or electronically (when filing a complaint electronically) to the applicant who filed the complaint about the extension of the term of consideration of the complaint with indicating the reasons for the extension.
In cases of disagreement with the results of the provision of public services, the service recipient applies to the court in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
