On approval of the rules for certification of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities

In accordance with subparagraph 11-1) of Article 20 of the law of the Republic of Kazakhstan dated July 16, 2001 "on architectural, urban planning and construction activities in the Republic of Kazakhstan" and subparagraph 1) of Article 10 of the law of the Republic of Kazakhstan dated April 15, 2013 "on public services" :

1.approve the attached rules for certification of employees performing expert work and engineering services in the field of architectural, urban planning and construction activities.

2. Committee for construction, housing and communal services and land management of the Ministry of national economy of the Republic of Kazakhstan (B. A. Smagulov):
1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;
2) official publication of this order in the information and legal system "Adilet" and in the official mass media within ten calendar days after state registration in the Ministry of Justice of the Republic of Kazakhstan;
3) posting this order on the internet resource of the Ministry of national economy of the Republic of Kazakhstan.
3.control over the implementation of this order is entrusted to Uskenbayev Kairbek Aitbayevich, Vice-Minister of national economy of the Republic of Kazakhstan.
4.this order shall enter into force on the expiration of ten calendar days after the date of its first official publication.

Rules for certification of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities

Chapter 1. General provisions
1. These rules for certification of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities (hereinafter referred to as - Certification of experts engaged in expert work and engineering services, developed in accordance with the law of the Republic of Kazakhstan dated July 16, 2001" on architectural, urban planning and construction activities in the Republic of Kazakhstan "and subparagraph 1) of Article 10 of the law of the Republic of Kazakhstan dated April 15, 2013" on public services "and, certification of experts performing expert work and engineering services in the field of urban planning and construction activities".
2. The following concepts are used in these rules:
1) Central authorized body - a central state body that manages architectural, urban planning and construction activities in the field of Public Administration;
2) engineering services in the field of Architecture, Urban Planning and construction - a set of services that ensure the preparation and implementation of construction in order to achieve optimal design indicators (technical and author's supervision);
3) expert works-work on the examination of projects of buildings and structures and conducting technical inspections of their reliability and stability;
4) expert - an individual who performs certain types of expert work and engineering services in the field of Architecture, Urban Planning and construction;
5) expert's certificate - a qualification certificate certifying the status of an expert and his right to perform expert work and the provision of engineering services in urban planning and construction activities;
6) applicant - an individual applying for expert status;
7) local executive body - a structural subdivision of the local executive body that considers the compliance of documents with the requirements, approves the list of experts admitted to testing and the schedule of testing, and also makes a decision on the passage of certification by experts.
3.certification is carried out in order to determine the level of professional training and competence of experts, knowledge of state standards in the field of Architecture, Urban Planning and construction and Environmental Protection, sanitary and epidemiological well-being of the population and hygiene standards, improve the quality of work carried out by them, take into account the changes taking place in the field of construction and study new requirements.
4. certification of the following types of expert works and engineering services:
1) examination of urban planning, pre-design and design and estimate documentation;
2) technical supervision;
3) Author's supervision;
4) for experts performing technical inspections of the reliability and stability of buildings and structures.
5. experts on urban planning, pre-design and examination of design and estimate documentation are divided into the following specialties:
1) urban planning;
2) pre-design documentation;
3) architecture;
4) structural part;
5) Engineering networks and systems (by type of engineering networks and systems);
6) technological part (depending on the purpose of the object);
7) estimated Department;
8) fire safety;
9) environmental department;
10) sanitary and epidemiological profile.
6. experts engaged in technical supervision are divided into the following specialties:
1) for objects of the first level of responsibility - in terms of supporting and enclosing structures;
2) for objects of the first level of responsibility - in terms of engineering networks;
3) for objects of the first level of responsibility - in terms of technological equipment;
4) for objects of the second and third levels of responsibility - in terms of supporting and enclosing structures;
5) for objects of the second and third levels of responsibility - in terms of engineering networks;
6) for objects of the second and third levels of responsibility - in terms of technological equipment.
7. experts engaged in author supervision are divided into the following specialties:
1) for objects of the first level of responsibility - in terms of architecture;
2) for objects of the first level of responsibility - in terms of supporting and enclosing structures;
3) for objects of the second and third levels of responsibility - in the architectural part;
4) for objects of the second and third levels of responsibility - in terms of supporting and enclosing structures.
8. experts in the implementation of technical and author's supervision are divided into the following levels of responsibility:
for objects of the first level of responsibility - on objects of all levels of responsibility within the framework of the existing certificate, carries out the activities specified in this paragraph;
for objects of the second and third levels of responsibility - for objects of the second and third levels of responsibility within the framework of the existing certificate, performs the services specified in this paragraph.
9. certification:
1) for certification as an expert on urban planning, pre-design and examination of design and estimate documentation - persons with higher professional education in the relevant sections of urban planning, design and estimate documentation and at least five years of experience in the development and (or) examination of the relevant sections of urban planning, pre-design and design and estimate documentation;
2) for certification as an expert in technical supervision for objects of the first level of responsibility in terms of supporting and enclosing structures - persons with higher professional education in the construction industry and at least five years of experience as an expert;
3) for certification as an expert in technical supervision for objects of the first level of responsibility in terms of engineering networks-persons with higher professional education in the construction industry and at least five years of experience as an expert;
4) for certification as an expert in technical supervision for objects of the first level of responsibility in terms of technological equipment - persons with higher professional education in the construction industry and at least five years of experience as an expert;
5) for certification as an expert in technical supervision for objects of the second and third levels of responsibility in terms of supporting and enclosing structures - persons with higher professional education in the construction industry and at least three years of experience in carrying out construction and installation works;
