"Management of the State Architectural and Construction Control of the Mangystau region"
1. General provisions
1. The state Institution "Management of the State Architectural and Construction Control of the Mangystau region" (hereinafter referred to as the Management) is a state body of the Republic of Kazakhstan exercising state control and supervision in the field of architectural, urban planning and construction activities.
2. The state institution "Department of State Architectural and Construction Control of Mangystau region" has no departments.
3. The State institution "Department of State Architectural and Construction Control of Mangystau region" carries out its activities in accordance with the Constitution and on architectural, urban planning and construction activities in the Republic of Kazakhstan, other normative acts, acts of the President and Government of the Republic of Kazakhstan, as well as this Regulation.
4. The state institution "Management of the State Architectural and Construction Control of the Mangystau region" is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the treasury bodies.
5. The state institution "Management of the State Architectural and Construction Control of the Mangystau region" enters into civil relations on its own behalf.
6. The state institution "Department of State Architectural and Construction Control of Mangystau region" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation.
7. The state institution "Management of the State Architectural and Construction Control of the Mangystau region" on issues of its competence in accordance with the procedure established by law makes decisions issued by orders of the head of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" and other acts provided for by the legislation of the Republic of Kazakhstan.
8. The structure and the limit of the staffing of the state institution "Department of State Architectural and Construction Control of the Mangystau region" are approved in accordance with the current legislation.
9. Location of the legal entity: Republic of Kazakhstan, Mangystau region, 130000, Aktau city, 23 microdistrict, building No. 41.
10. The full name of the state body is the state institution "Management of the State Architectural and Construction Control of the Mangystau region".
11. This Regulation is the constituent document of the state institution "Department of State Architectural and Construction Control of the Mangystau region". Amendments and additions to the Regulation are made by the decree of the Akimat of the Mangystau region.
12. Financing of the activities of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is carried out from the regional budget.
13. The state institution "Management of the State Architectural and Construction Control of the Mangistau region" is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the state institution "Management of the State Architectural and Construction Control of the Mangistau region".
If the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is directed to the state budget income.
14. The mode of operation of the state institution "Department of State Architectural and Construction Control of Mangystau region" will be determined in accordance with the requirements of the current legislation of the Republic of Kazakhstan.
2. Mission, main tasks, functions, rights and obligations of the state institution "Department of State Architectural and Construction Control of Mangystau region"
15. The mission of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is to implement the implementation of state policy in the field of architecture, urban planning, construction, development of the production base of the construction industry in the territory of the Mangystau region.
16. The purpose of the state institution "Management of the state architectural and construction control of the Mangystau region":
1) ensuring compliance with the norms of legislation and urban planning documentation during the construction and operation of construction facilities.
17. Tasks of the state institution "Management of the State architectural and Construction control of the Mangystau region":
1) implementation of the state architectural, urban planning and construction policy in the subordinate territory;
2) prevention and timely response to violations of architectural and construction norms and legislation of objects under construction on the territory of the Mangystau region;
3) monitoring of facilities and complexes under construction (planned for construction) in accordance with the procedure established by the authorized body for architecture, urban planning and construction on the territory of the Mangystau region;
4) introduction of digital technologies to ensure transparency of activities and improve the quality of public services;
5) implementation in the interests of local public administration of other tasks assigned to local executive bodies by the legislation of the Republic of Kazakhstan.
18. The functions of the state institution "Department of State Architectural and Construction Control of the Mangystau region" include:
1) implementation of state architectural and construction control and supervision over the quality of construction of facilities, application of administrative measures of influence established by the Code of the Republic of Kazakhstan on Administrative Offenses to violators of architectural and urban planning discipline at these facilities;
2) licensing in the field of architectural, urban planning and construction activities;
3) certification of experts for the right to carry out expert work and engineering services in the field of architectural, urban planning and construction activities;
4) organization and supervision of the quality of project documentation;
5) accreditation of project management organizations in the field of architecture, urban planning and construction;
6) monitoring of facilities under construction (reconstructed, expanded, modernized, overhauled) and put into operation;
7) making decisions on the application of the provided legislative measures to violators in connection with violations and deviations from the norms of legislation, state regulatory requirements, conditions and restrictions established in the field of architectural, urban planning and construction activities;
8) carrying out inspections for:
8-1) approved design (design and estimate) documentation, a positive conclusion of the expert examination of projects, as well as notification of the bodies carrying out state architectural and construction control and supervision on the start of construction and installation works;
8-2) reliability of the data specified in the notification;
8-3) the availability of a license for the right to carry out the relevant types of licensed architectural, urban planning and construction activities;
8-4) compliance of completed (performed) construction and installation works, applied building materials (products, structures) and equipment with approved design solutions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and operational qualities of buildings (structures);
8-5) organization and implementation by the contractor (general contractor) of all types and forms of own production control and supervision of the quality of construction (entrance, operational, acceptance, laboratory, geodetic and others);
8-6) timeliness and correctness of execution of executive documentation;
8-7) organization and implementation by the customer (owner) of technical and author supervision during the construction of facilities;
8-8) compliance by persons carrying out technical and author supervision with the requirements established by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities;
9) for compliance of the completed (performed) construction and installation works, applied building materials, products, structures and equipment with approved design decisions and state (interstate) standards, including ensuring the strength, stability, reliability of load-bearing and enclosing structures and operational qualities of buildings (structures) ;
9-1) on the prohibition of the use of building materials, products, structures and equipment that do not comply with national standards and specifications;
9-2) on the elimination by the customer (developer) and (or) the contractor construction and installation organization (enterprise) of the violations committed within the established time limits;
9-3) on suspension of construction and installation works;
10) implementation of licensing control, including taking appropriate measures against violators of licensing standards based on the results of inspections;
11) conducting organizational activities for the certification of experts providing expert work and engineering services (electronic testing);
12) for the design, placement and construction of production facilities;
13) architectural and construction control and supervision is carried out in the form of inspection and preventive control and supervision;
14) organization of work on the implementation of gender policy;
15) generalization and analysis of the results of inspections and control;
16) consideration of appeals of individuals and legal entities;
17) organization of reception of citizens and representatives of legal entities;
18) comply with the norms of anti-corruption legislation, taking measures to combat corruption.
19) preparation of proposals to improve the legislative acts of the Republic of Kazakhstan regulating the issues of architectural and construction activities;
20) exercise in the interests of local public administration of other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.
19. In order to implement the main tasks and perform its functions, the state institution "Department of State Architectural and Construction Control of the Mangystau region" within its competence has the right:
1) to request from the subjects of architectural, urban planning and construction activities and receive from them information about the objects and complexes planned for construction and under construction (reconstructed, expanding, modernized, overhauled) on the territory of the Republic of Kazakhstan;
2) to request from persons carrying out technical and author supervision, and to receive from them for familiarization the necessary design (design estimates) and executive technical documentation on the construction site, as well as expert opinions of the relevant projects;
3) involve independent laboratories to conduct laboratory tests of structures of objects under construction and applied building materials, products and structures for compliance with the project requirements and state (interstate) regulations;
4) upon detection of violations of state standards and (or) deviations from approved projects (design solutions), the state architectural and construction inspectorate issues instructions on the elimination by the customer (developer) and (or) contractor construction and installation organization (enterprise) of the violations committed within the established time;
5) apply to the judicial authorities to protect the interests of the state in terms of compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of architectural, urban planning and construction activities;
6) suspend the construction of residential and industrial facilities in the absence of title and identification documents;
7) submit, in accordance with the established procedure, draft resolutions of the akimat, decisions, orders of the akim and decisions of the maslikhat on issues within the competence of the state institution "Department of State Architectural and Construction Control of the Mangystau region";
8) exercise other rights in accordance with the current legislation.
9) on the organization, planning and ensuring the implementation of mobilization training measures and ensuring the implementation of civil defense measures.;
The state Institution "Department of State Architectural and Construction Control of the Mangystau region" has no right to engage in activities that do not meet the goals of the established state institution "Department of Urban Planning Control and Land Protection of the Mangystau region".
3. Organization of the activities of the state institution "Department of State Architectural and Construction Control of Mangystau region"
20. The management of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is carried out by the head, who is personally responsible for the fulfillment of the tasks assigned to the state institution "Management of the State Architectural and Construction Control of the Mangystau region" and the implementation of its functions;
21. The head of the state institution "Department of State Architectural and Construction Control of Mangistau region" is appointed and dismissed by the Akim of Mangistau region in accordance with the legislation of the Republic of Kazakhstan;
22. The head of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is, respectively, the chief state construction inspector of the Mangystau region;
23. The head of the state institution "Department of State Architectural and Construction Control of Mangystau region" has a deputy who is appointed and dismissed in accordance with the current legislation of the Republic of Kazakhstan;
Full-time employees of the state institution "Department of State Architectural and Construction Control of Mangystau region", whose job responsibilities include operational inspection and monitoring of the progress and quality of construction, are state construction inspectors;
24. Powers of the head of the state institution "Department of State Architectural and Construction Control of Mangystau region":
1) represents the interests of the state institution "Department of State Architectural and Construction Control of Mangystau region" in all organizations, in cases and within the limits established by the legislation of the Republic of Kazakhstan;
2) issues a power of attorney to represent the interests of the state institution "Department of State Architectural and Construction Control of the Mangystau region";
3) approves the procedure and plans of the state institution "Department of State Architectural and Construction Control of Mangystau region" on business trips, internships, training of employees in Kazakh and foreign centers and other types of retraining and advanced training of employees;
4) opens bank accounts of the state institution "Department of State Architectural and Construction Control of Mangystau region";
5) issues orders and gives instructions that are mandatory for all employees of the state institution "Department of State Architectural and Construction Control of the Mangystau region";
6) hires and dismisses employees of the state institution "Department of State Architectural and Construction Control of Mangystau region";
7) defines the powers of employees of the state institution "Department of State Architectural and Construction Control of the Mangystau region";
8) makes decisions on encouragement and imposes disciplinary penalties on employees of the state institution "Department of State Architectural and Construction Control of the Mangystau region";
9) takes measures to combat corruption and is personally responsible for it;
10) Signs licenses and annexes to them, certifications of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities and accreditation of project management organizations in the field of architecture, urban planning and construction, as well as other documents related to this;
11) exercise other powers assigned to him by the legislation of the Republic of Kazakhstan and this Regulation;
The execution of the powers of the head of the state institution "Department of State Architectural and Construction Control of the Mangystau region" during his absence is carried out by the person replacing him in accordance with the current legislation;
25. The head of the state institution "Department of State Architectural and Construction Control of Mangystau region" determines the powers of his deputy in accordance with the current legislation.
26. On behalf of the State Institution"Department of State Architectural and Construction Control of Mangistau region ", documents sent to state bodies and other state institutions on issues within the competence of the state institution"Department of State Architectural and Construction Control of Mangistau region" are signed by the head of the department, and in his absence – by deputies.
27. The first head of the state institution "Department of State Architectural and Construction Control of Mangystau region", within its competence, ensures compliance with the requirements of the legislation of the Republic of Kazakhstan On combating corruption.
28. The first head of the state institution "Department of State Architectural and Construction Control of Mangystau region" exercises other powers assigned by laws and other regulatory legal acts of the Republic of Kazakhstan.
4. Property of the state institution "Department of State Architectural and Construction Control of Mangystau region"
29. The state institution "Management of the State Architectural and Construction Control of the Mangystau region" may have a separate property on the right of operational management in cases provided for by law;
The property of the state institution "Department of State Architectural and Construction Control of Mangystau region" is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan;
30. The property assigned to the state institution "Department of State Architectural and Construction Control" refers to communal property;

The state institution "Management of the State Architectural and Construction Control of the Mangystau region" has no right to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
5. Reorganization and abolition of the state institution "Department of State Architectural and Construction Control of Mangystau region"
32. The reorganization and abolition of the state institution "Management of the State Architectural and Construction Control of the Mangystau region" is carried out in accordance with the legislation of the Republic of Kazakhstan.
