New forms of MZHD management

On January 7, 2020, the Law of the Republic of Kazakhstan "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Housing and Communal Services" came into force. Within the framework of the adopted Law, only two forms of management are provided for:

1.The Association of Property Owners (AXIS) is a legal entity that is a non-profit organization formed by the owners of apartments, non-residential premises of one MZHD, managing the condominium object, financing its maintenance and ensuring its safety, which will work according to the principle "one house - one AXIS - one account".

2. A simple partnership (PT) - without the formation of a legal entity that will work on the principle of "one house – one PT - one account".

In the Moscow Railways, located on a single foundation or having a single communal engineering systems,the owners of apartments, non-residential premises have the right to create one AXIS or PTP with the consent of more than 2 / 3 owners of apartments, non-residential premises of each apartment building. KSP(K), PKSP(K), PK can carry out their activities until July 1, 2022. After the expiration of the validity period of the KSP(K), the PKSP (K), the PC must, according to the act, transfer to the Council of the Ministry of Railways all available technical, financial and other documents and liquidate in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
