On the approval of the Rules for the provision of the state service "Registration and de-registration of dangerous technical devices" and the invalidation of certain orders of the Minister for Investment and Development of the Republic of Kazakhstan and the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan

Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan № 229 dated April 24, 2020. Registered with the Ministry of Justice of the Republic of Kazakhstan on April 27, 2020 № 20497.

In accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On public Services", I ORDER:

Approve the attached Rules for the provision of the state service "Registration and de-registration of dangerous technical devices", according to Annex 1 to this order.
To recognize as invalid some orders of the Minister for Investment and Development of the Republic of Kazakhstan and the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan in accordance with Annex 2 to this order.
The Committee for Industrial Development and Industrial Safety of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan, in accordance with the procedure established by law, shall provide:

state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
placement of this order on the Internet resource of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan.
Control over the implementation of this order should be entrusted to the supervising Vice-Minister of Industry and Infrastructure Development of the Republic of Kazakhstan.
This order shall enter into force upon the expiration of twenty-one calendar days after the date of its first official publication.

Rules for the provision of public services "Registration and de-registration of dangerous technical devices"

Chapter 1. General provisions

These Rules for the provision of public services "Registration and de-registration of dangerous technical devices" (hereinafter - the Rules) are developed in accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services" (hereinafter - the Law) and determine the procedure for registration and de-registration of dangerous technical devices.
"Registration and de-registration of dangerous technical devices" is a state service (hereinafter-the state service) and is provided by the territorial departments of the Industrial Safety Committee of the Ministry of Emergency Situations of the Republic of Kazakhstan and local executive bodies of districts, cities of regional significance, the cities of Nur-Sultan, Almaty and Shymkent (hereinafter – the service provider) according to these Rules.

3.For registration, de-registration of a dangerous technical device, the owner of a dangerous technical device or the head of an organization operating a dangerous technical device:

at industrial facilities, submits an application to the territorial division of the authorized body in the field of industrial safety;

at social infrastructure facilities, submits an application to the local executive body that carries out state supervision in the field of industrial safety.

Chapter 2. The procedure for the provision of public services

In order to receive a public service, legal entities and individuals (hereinafter referred to as the service recipient) send the service provider via the e-government web portal www.egov.kz (hereinafter referred to as the portal):

1) the application, according to appendices 1 and 2 to these Rules;

2) an electronic copy of the passport of a dangerous technical device.

The list of the main requirements for the provision of public services, including the characteristics of the process, form, content and result of the provision, as well as other information, taking into account the specifics of the provision of public services, is set out in the standard of public services (hereinafter referred to as the Standard) in accordance with Annex 3 to these Rules.

When the service recipient submits all the necessary documents through the portal, the status of acceptance of the request for the provision of public services is displayed in the" personal account " of the service recipient, indicating the date of receipt of the result of the public service.

The total period for reviewing documents and issuing a notification of registration, de-registration of a dangerous technical device is 3 (three) working days.

An employee of the office of the service provider registers documents on the day of their receipt and sends them to the head of the service provider, who is appointed the responsible executor.

If the service recipient applies after the end of working hours, on weekends and holidays, according to the labor legislation of the Republic of Kazakhstan, the application is accepted and the result of the provision of public services is issued on the next working day.

The responsible executor checks the completeness of the submitted documents within one working day and, if the fact of incompleteness of the submitted documents is established, prepares a reasoned refusal in accordance with Annex 4 to these Rules and sends it to the service recipient through the portal in the form of an electronic document signed by the EDS of the head of the service provider or the person replacing him, to the personal account of the service recipient.

The сervice provider receives information about the identity document, about the state registration (re-registration) of a legal entity, an individual entrepreneur, from the relevant state information systems through the "electronic government" gateway.

If the service recipient submits a full package of documents, the service provider checks the submitted documents within two working days and draws up the result of the provision of the state service within one day - notification of registration of a dangerous technical device or notification of de-registration of a dangerous technical device or a reasoned refusal, according to the forms according to appendices 4, 5 or 6 to the Rules and sends it to the service recipient through the portal in the form of an electronic document signed by the EDS of the head of the service provider or the person replacing him, to the personal account of the service recipient.

The grounds for refusal to provide public services established by the legislation of the Republic of Kazakhstan are set out in Annex 3 to these Rules.

The result of the provision of public services is sent and stored in the" personal account " of the service recipient in the form of an electronic document signed by the EDS of the head of the service provider or the person replacing him.

The service provider ensures that data on the stage of rendering the state service is entered into the information system for monitoring the provision of state services in accordance with the procedure established by the authorized body in the field of informatization.

Chapter 3. The procedure for appealing decisions, actions (inaction) of the service provider on the provision of public services

A complaint against the decision, actions (omissions) of the service provider on the provision of public services may be filed to the head of the service provider and (or) to the authorized body for evaluation and quality control of the provision of public services in accordance with the legislation of the Republic of Kazakhstan.

The complaint of the service recipient in accordance with paragraph 2 of Article 25 of the Law is subject to consideration:

by the service provider – within 5 (five) working days from the date of its registration;

by the authorized body for the assessment and control of the quality of the provision of public services – within 15 (fifteen) working days from the date of its registration.

The term of consideration of the complaint by the service provider, the authorized body for assessing and monitoring the quality of public services in accordance with paragraph 4 of Article 25 of the Law is extended for no more than 10 (ten) working days if necessary:

conducting an additional study or inspection on the complaint or an on-site inspection;
for more information.

In case of extension of the term for consideration of the complaint, the official

authorized to consider complaints, within three working days from the date of extension of the term for consideration of the complaint, informs the service recipient who filed the complaint in writing (when filing a complaint on paper) or electronically (when filing a complaint in electronic form) about the extension of the term for consideration of the complaint, indicating the reasons for the extension.

In cases of disagreement with the results of the provision of public services, the service recipient applies to the court in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
