In this regard, on the basis of the contract, a lawsuit was filed, as a result of which the design and estimate documentation for the construction of the cemetery was recalculated and the court decided to make changes. To date, at the expense of the saved funds of the akim's office of the village, the DED has been processed for 1.7 million tenge, a budget application for 81.8 million tenge has been submitted. |

The project provides for an electric network with a length of VL-10 kV - 5.4 km, VL-0.4 kV - 2.1 km. For the implementation of this project, a competition was organized and on 29.03.2022, by the method of open tender No. 7048563-OK1, the winner was recognized as the Construction Company “Er-Kanat Service” LLP. Contract No. 44 dated 07.04.2022 for 39.5 million tenge was signed between the contracting institution and the Department of Urban Construction . The term of the contract is 3 months (08.07.2022). For reference: at the beginning of July, the contractor supplied 60 pieces of electric poles, more than 2000 meters of cable. At the same time, a specialist of the city construction department and technical supervision visited the facility and confirmed the completion of work for 6.0 million tenge, payment was made to the contractor by account No. 4672506/22-577 dated 07/29/2022. Today, some materials (cable) are missing from the facility. Warning letters were repeatedly sent to the contracting institution of “Er-Kanat Service” Construction Company LLP, due to the fact that construction and installation work under the contract was not carried out. In addition, an instruction has been sent from “Asem Kurylys” LLP, which is the technical supervisory authority of the facility. But, since there was no result, the city construction department appealed to the specialized economic court of the Kyzylorda region with a statement of claim No. 01-1/622 dated 11.07.2022 (statement of claim: recognition of the contractor as an indefinite participant in public procurement and oblige to carry out construction work). According to the statement of claim, by the decision of the Specialized Interdistrict Economic Court of the Kyzylorda Region No. 4360-22-00-2/1296 dated October 14, 2022, the contractor “Er-Kanat Service” Construction Company LLP was recognized as an indefinite participant in public procurement and is obliged to complete construction work.
