The citizen appealed to the Constitutional Court for a review of the constitutionality of paragraph 1 of Article 249 of the Civil Code of the Republic of Kazakhstan (General Part). This paragraph outlines the cases in which property rights may be terminated.
The petitioner argues that the contested provision led to the forced termination of his property rights in favor of a third party, who had been residing in the property for more than twenty years, without the necessary procedures being conducted in advance.
The Constitutional Court stated that the arguments presented by the petitioner directly relate to the factual circumstances that have already been examined by the courts and cannot serve as grounds for reviewing the constitutionality of the Civil Code provision raised by the citizen.
