The Constitutional Court will check the constitutionality of the norms on prohibitions for convicts in disciplinary isolators and solitary confinement cells

As a result of the preliminary examination, the Constitutional Court accepted for constitutional proceedings a citizen's appeal to check the constitutionality of Article 109, paragraph two, subparagraph 2), paragraph one of Article 134 of the Criminal Executive Code and paragraph 104 of the Internal Regulations of penal institutions (Order of the Ministry of Internal Affairs of 17.11.2014 No. 819).

The contested norms establish prohibitions on visits, telephone conversations, purchase of food and basic necessities, as well as smoking and use of a sleeping place during the daytime for convicts placed in disciplinary isolation cells and solitary confinement cells. Exceptions for telephone conversations are possible in cases of death or serious illness of close relatives, natural disasters causing significant damage to the convicted person's family and other exceptional personal circumstances.
