Following a preliminary examination, the Constitutional Court accepted for constitutional proceedings a citizen's appeal to verify the constitutionality of subparagraphs 2) and 3) of paragraph 1 of Article 11 and subparagraph 10) of paragraph 1 of Article 14 of the Law “On the Procedure for Organizing and Holding Peaceful Assemblies”.
According to the contested norms, local executive bodies may refuse to hold peaceful assemblies if other official or mass events are already planned at the proposed time and place or if construction and installation work is being carried out. In addition, the authorities have the right to propose to the organizers to change the place or time of the assembly in order to ensure the rights and freedoms of citizens, public safety, as well as the uninterrupted functioning of transport and the safety of infrastructure facilities.
