Representatives from law enforcement agencies, the Judicial Administration, and the Ministry of Justice, along with legal experts, were heard by the Constitutional Court in relation to the appeal filed by the Prosecutor General. The focus of the appeal is the interpretation of operative paragraph 6 of the normative Decision of the Constitutional Council No. 3 dated March 6, 1997.
The crux of the matter lies in questioning the feasibility of allowing the prosecutor to participate in the decision-making process of the investigating judge regarding the authorization of specific investigative actions. The representative from the Prosecutor General's Office emphasized that such participation would enhance the effectiveness of supreme supervision in ensuring legality during the pre-trial investigation stage.
Pursuant to Article 65 of the Constitutional Law, the Constitutional Court's decision on the appeal will be disseminated through periodical printed publications authorized to officially publish legislative acts, the unified system of legal information, and made available on the Constitutional Court's official internet resource.
