REPRESENTATIVES OF THE CONSTITUTIONAL COUNCIL SPOKE AT THE CENTRAL COMMUNICATIONS SERVICE UNDER THE PRESIDENT OF THE REPUBLIC OF KAZAKHSTAN

Today in the Service of Central communications under the President  of the Republic of Kazakhstan during the press conference the representatives of the Constitutional Council  have  told about the activities of the  Constitutional Council, held in the frames of the 25-th anniversary of the Constitution of the Republic of Kazakhstan.  The information was provided by the member of the Constitutional Council Unzila Shapak  and Secretary General Bakyt Nurmukhanov. "Constitution is the basic law of the state, which has the highest legal force. August 30 of this year marks the 25th anniversary of the adoption of the Constitution of the Republic of Kazakhstan in a national referendum. The anniversary of the Basic Law is a significant event in the development of Kazakhstan's statehood, " said Unzila Shapak, the member of the Сonstitutional Council.The activity of the Сonstitutional Council is aimed at ensuring the inviolability of the Basic Law of the country. Since 1996, the Сonstitutional Council has received more than 200 appeals.The subject of 29 of them was the verification of compliance with the Constitution of laws adopted by the Parliament and submitted to the Head of state for signature. A total of 17 laws were found to be unconstitutional in 15 cases.The Сonstitutional Council has considered more than 100 applications for the official interpretation of the Constitution's norms, for which more than 80 normative decisions have been adopted. They address the implementation and protection of constitutional rights of citizens, the electoral system, the status and powers of state bodies, the legislative process, and others. 24 messages of the Constitutional Council on the state of constitutional legality in the Republic were read out at a joint session of the Chambers of the Parliament. In these messages  the Constitutional Council analyzes the state of legality in the country and submits particular proposals to strengthen the guarantees of human rights and freedoms.The entry of the first President of the Republic - Elbasy into the Constitutional Council as its life member helped to strengthen the regime of constitutional legality.
According to the speaker, the Constitutional Council takes systematic measures to explain and promote constitutional values and improve the constitutional culture of society. Purposeful work is being carried out to educate the legal culture of citizens.The Constitutional Council has elaborated the uniform logo of the 25th anniversary of the Constitution. In accordance with the National plan  of activities on holding the 25th anniversary of the Constitution of the Republic from the beginning  of the year  structured work has been carried out. The documental films, devoted to the history of the Constitution, development of the constitutional rights over 25 years have been made. All the regions hold the conferences, round tables,  lectures,  open lessons and other events.  They  cover the labour teams,  the  students of the higher educational establishments,  schools and colleges. 
The Constitutional Council together with the Ministry of education and science held a competition among students of law faculties of higher educational establishments for the best work on constitutional development.
The Republican educational and methodological center of complementary  education of MES RK among students of  5-7 grades  held Republican competition of drawings on  "The Constitution is the fundamental law of the country".
The Constitutional Council has published a number of books and collections.The book presented on July 1 reveals the role of the First President of the Republic in the constitutional construction of independent Kazakhstan. The second book is devoted to the achievements of the Republic of Kazakhstan on the way to establishing the principles of the rule of law. Its authors are foreign experts. They highly appreciate our Constitution and have made particalar proposals to improve the effectiveness of legal policy. A separate monograph summarizes the activity of the Constitutional Council of the Republic of Kazakhstan. In the publication "Zhyr arkauy – ATA Zan" works of Kazakh poets about the Constitution and the values laid down in it are collected. The collection of children's drawings "Bala orgen ATA Zan" includes individual manuscripts and drawings of schoolchildren who took part in essay and drawing competitions dedicated to the Constitution of the Republic. For the first time, the Encyclopedia of the Constitution of the Republic of Kazakhstan was published in the state language. The Constitutional Council launches the project "week of the Basic Law" from 24 to 30 August this year. The goal of the project is a deep understanding of the role of the Constitution in modernizing society and the state, increasing the constitutional culture of the population.
Within the framework of this project, online conferences, free legal consultations, webinars, media appearances, charity events, commissioning of new facilities, handing over keys to apartments, identity cards, providing sponsorship and other events will be organized throughout the country. Considering the epidemiological  situation in the country all the events will be held in online mode. The program includes presentations of books published in honor of the anniversary of the Basic Law.Since August 25  the National Bank plans to issue new commemorative coins with a nominal value of 100 and 200 tenge. JSC "Kazpost" puts into circulation a postage stamp in the series "Memorable dates and anniversaries". In honor of the Constitution Day, the international conference on "The Constitution of the XXI Century- the Rule of law,  the Value of  Person and  the Effectiveness of the State" is planned to be held in Nur - Sultan on August 27 this year. Within the conference the 4th Congress of the Association of Asian constitutional courts (18 countries) will take place. Members of the Eurasian Association of constitutional review bodies (9 countries) are also expected to participate in the conference. Currently, the Constitutional Council presides over these associations, which cover more than 20 countries with a population of more than 2 billion people.
The leading lawyers from all the world continents, representing in majority the bodies of the constitutional justice, will discuss the actual issues of the further constitutional-legal development, including those connected with pandemic of coronavirus. The Archive of the President  organizes  the   historic - documentary  online exhibition “Constitution of the Republic of Kazakhstan – the basis of state stability and prosperity” It will feature unique archival documents. For the first time, documents on the discussion of the draft Constitution among the national and international public will be shown. The Ministry of culture and sports is preparing an online concert dedicated to the 25th anniversary of the Constitution of the Republic. It will be broadcast on TV channels on the eve of a public holiday.
