Constitutional Court to Review the Constitutionality of Provisions on Establishing a Child’s Parentage

The Constitutional Court has accepted for constitutional proceedings a petition seeking review of the constitutionality of the first part of paragraph 2 of Article 51 of the Code “On Marriage (Matrimony) and Family” and the first paragraph of paragraph 15 of the normative resolution of the Supreme Court “On the Application by Courts of Legislation in Cases Concerning the Establishment of a Child’s Parentage.”

The applicant considers that the application of the contested provisions may result in certain obligations and legal consequences being imposed on a person who has exercised his or her right in circumstances provided for by law. In the applicant’s view, this affects constitutional guarantees relating to marriage and family, property and inheritance rights, as well as rights and obligations concerning the care and upbringing of children.

Updates on the progress and outcome of the constitutional proceedings will be published on the official website and Telegram channel of the Constitutional Court.
