Constitutional Court to Review the Constitutionality of a Provision on Exemption from Payment for Notarial Services

The Constitutional Court has accepted for constitutional proceedings a petition seeking review of the constitutionality of subparagraph 3) of Article 25 of the Law of the Republic of Kazakhstan “On Advocacy and Legal Assistance.”

The applicant considers that exempting certain individuals from payment for notarial acts results in private notaries providing services without appropriate remuneration and creates unequal conditions for the exercise of their professional activities. In the applicant’s view, such an obligation may affect the constitutional rights of private notaries, including guarantees of equality, personal liberty and dignity.
