Based on the results of a preliminary review, the Constitutional Court accepted for constitutional proceedings an appeal to verify the constitutionality of Article 50(4) of the Law “On Banks and Banking Activities in the Republic of Kazakhstan.”

According to the contested provision, banking secrecy may only be disclosed to the client or any third party with the consent of the account (property) holder.

When preparing a claim for the division of joint property after divorce, the applicant was unable to obtain information about her former spouse's financial savings during the marriage. In her opinion, the current provision deprives one of the spouses of access to information about joint savings and prevents the exercise of the right to a share in the joint property of the spouses.

Information on the progress and results of the review will be published on the official website and Telegram channel of the Constitutional Court.
