Today, December 10, the international community celebrates Human Rights Day, reminding us all of the enduring value of protecting constitutional rights and freedoms. On this day in 1948, the Universal Declaration of Human Rights was adopted, laying the foundation for international standards in the field of individual rights and freedoms.
For Kazakhstan, these principles are part of its constitutional identity. Article 1 of the Constitution of the Republic of Kazakhstan states that the highest values of the state are the individual, his or her life, rights, and freedoms. This guideline determines the work of the Constitutional Court. In its final decisions on citizens' appeals, the Constitutional Court consistently reinforces the priority of human rights and ensures compliance with constitutional guarantees.
The practice of reviewing appeals confirms that constitutional control is an effective mechanism for protecting and restoring violated rights. When reviewing legislation for constitutionality, the Constitutional Court proceeds from the principles of the rule of law, legality, and order, strengthening citizens' trust in the law and ensuring a balance between public and private interests.
The particular relevance of the principle of “law and order” is confirmed by the Decree of the President of the Republic of Kazakhstan on state values. It is aimed at strengthening public harmony and the institutions of the rule of law.
The Constitutional Court of the Republic of Kazakhstan congratulates everyone on Human Rights Day. Respect for the rights and freedoms of citizens is the legal foundation of our society, and the Constitution is the basic legal guarantor of justice and legality.
