Based on the results of a preliminary review, the Constitutional Court accepted for constitutional proceedings a citizen's appeal regarding the constitutionality of Part 2 of Article 50 of the Code of the Republic of Kazakhstan on Administrative Offenses.

According to the provision, administrative arrest cannot be applied to pregnant women and women with children under the age of fourteen, persons under the age of eighteen, persons with disabilities of the first and second groups, as well as women over the age of fifty-eight, men over the age of sixty-three, and men who are single parents of children under the age of fourteen.

According to the applicant, the contested provision, insofar as it prohibits the use of administrative arrest only for women with children under the age of fourteen, contradicts Article 14 of the Constitution, as it discriminates on the basis of sex, violating the rights and interests of men with children under the age of fourteen.

Information on the progress and results of the review will be published on the official website and Telegram channel of the Constitutional Court.
