The Supreme Court has harmonized a normative ruling in the field of compensation for moral damages with the Constitution

The Supreme Court has made amendments https://adilet.zan.kz/rus/docs/P230000004S to normative decree No. 7 of November 27, 2015 “On the Application by the Courts of Legislation on the Compensation of Moral Damage”. The amendments expand the range of subjects to whom moral harm is compensated in the event of the death of a natural person.

These amendments were adopted pursuant to the final decision of the Constitutional Court of October 6, 2023, No. 32-NP https://www.gov.kz/memleket/entities/ksrk/documents/details/532647?lang=en.

In it, the Constitutional Court noted that the above-mentioned normative decision of the Supreme Court did not include a spouse in the circle of subjects who were entitled to compensation for moral damage in case of death of a physical person who had suffered moral and physical suffering.
