From July 11, amendments https://online.zakon.kz/Document/?doc_id=33931465#sub_id=400 to the Order of the Ministry of Internal Affairs of the Republic of Kazakhstan from November 17, 2014 № 819 “On Approval of the Internal Regulations of the institutions of the penal correctional system” will come into force. These amendments are aimed at ensuring the rights of convicts to legal and medical assistance. Thus, convicts in strict conditions of serving their sentence, as well as those held in disciplinary isolation ward, solitary confinement and temporary isolation ward will be allowed telephone conversations with a lawyer, as well as consultations with a medical worker.
The amendments were adopted in compliance with the normative decision of the Constitutional Court of December 27, 2024, No. 60-NP https://www.gov.kz/memleket/entities/ksrk/documents/details/770974?lang=en, in which the constitutional control body pointed out the right of a convicted person to have telephone conversations in order to receive qualified legal or medical assistance during the period of detention in a disciplinary isolation unit as a punishment, as well as in strict conditions of serving the sentence.
The Constitutional Court recommended that the Ministry of the Interior bring the departmental regulations on the conditions of detention of convicts in line with the Constitution with regard to the rights to qualified legal assistance and health protection, as well as the relevant provisions of the Criminal Executive Code and the Law on Advocacy and Legal Aid https://www.gov.kz/memleket/entities/ksrk/press/news/details/911284?lang=en.
