The Constitutional Court of the Republic of Kazakhstan considered a petition concerning the constitutionality of a number of provisions granting children of employees of certain State spheres - military personnel, police officers, doctors, teachers and members of special bodies - the right to priority enrollment in kindergartens at their place of residence.
The applicant saw in these provisions signs of discrimination based on social origin and a violation of his child's rights. However, the Constitutional Court found no grounds for accepting the application for proceedings.
The Court emphasized that the contested provisions did not prevent the applicant from exercising his right to pre-school education - his child had already received a place in a kindergarten. It noted that the enjoyment of rights and freedoms does not imply equal treatment in all cases, which is in accordance with both national and international law, taking into account the tasks of the services in question, which entail risks to the life and health of the employees of those services.
A differentiated approach to the provision of social support measures is recognized as a legitimate mechanism of State policy aimed at protecting and supporting certain categories of citizens whose service involves special conditions and social significance.
