The Address of the Constitutional Court of the Republic of Kazakhstan “On the State of Constitutional Legality in the Republic of Kazakhstan”

Chairperson of the Constitutional Court Elvira Azimova at a joint session of the Chambers of the Parliament delivered a message on the state of constitutional legality in the Republic of Kazakhstan on the results of generalization of the practice of constitutional proceedings for 2024 and 5 months of this year.

Elvira Azimova said that to date the Constitutional Court has received more than 10.5 thousand appeals, of which more than 95% came from citizens. The majority of citizens' appeals concern the norms of criminal, administrative, civil, land, tax and social legislation.

Many citizens made proposals to improve legislation and requests for clarification of legal norms. Such an increase in civic legal awareness required feedback from legislators and State institutions. In this regard, she suggested that the Ministry of Justice should take such initiatives into account in the framework of “Open NLA” projects and legal consultations, including through the use of artificial intelligence.

The President of the Constitutional Court noted that since the beginning of its activity, the Constitutional Court has adopted about 400 decisions, of which 72 final decisions on the results of verification of the norms of laws and other normative legal acts refer to the issues of law-making. 33 normative rulings have already been implemented, 14 are in the process of implementation.

The message of the Constitutional Court contains proposals to improve the legislation, to which Elvira Azimova drew attention in order to take them into account in the framework of legislative initiatives.

The decision of the Government to delegate to the Ministry of Justice the function of coordinating the process of execution of decisions of the constitutional control body by the executive bodies was noted as a positive result.

The message of the Constitutional Court states that state bodies should be proactive in eliminating legal uncertainties even before the intervention of constitutional control, which is especially important in the context of increasing digitalization and introduction of artificial intelligence in the system of state administration.

According to the data of the Constitutional Court, out of 72 normative decisions adopted in two and a half years, 19 norms of normative legal acts in force were recognized as inconsistent with the Constitution in 17 CC decisions, and 25 norms in 15 CC decisions were recognized as consistent with the Constitution as interpreted by the Constitutional Court. Decisions on the interpretation of norms are binding in the framework of lawmaking and law enforcement work.
