In Aktobe and Kostanay regions, a trial has begun between the Committee for the Regulation of Natural Monopolies MNE RK and the company "Center for Transport Service" JSC.
The fate of consumers of access to access roads is at stake, Business Kazakhstan informs.
JSC "Center of Transport Service" is a member of the republican section of the State Register for controlled services in the field of access roads, and falls under the regulation of CRNM.
The dispute between the company and the CRNM began with the fact that the Committee received complaints from consumers of Aktobe and Kostanay regions who use the services of JSC "Center for Transport Service".
In the complaints, consumers noted that JSC "Center of Transport Service" provided access to its access roads in these regions only to "KazJolTrans" LLP.
"According to the results of this audit, it was revealed that the subject violated subparagraph 6) of paragraph 2 of Article 26 of the Law of the Republic of Kazakhstan "On Natural Monopolies", which was expressed in the establishment of additional requirements that do not relate to the regulated service of access roads provided. As a result of the audit, the Tariff Regulator issued an order to JSC "Center for Transport Service" on the elimination of the detected violations No. 4 dated March 31, 2021, and a protocol on an administrative offense was drawn up under part 4 of Article 164 of the Code of Administrative Offenses of the Republic of Kazakhstan, which provides for a fine of three hundred and twenty monthly calculation indicators, " Kanat Uralov, head of the department in the fields of railway transport and ports of the CRNM.
The company did not agree with the verdict of the CRNM and will appeal this measure of the Committee in court. Who is right, who is guilty-the court will decide.
