Confirmation by specialists of qualification compliance with the requirements of professional standards

In accordance with the Requirements for legal entities certified for work in the field of industrial safety, approved by the Order of the Acting Minister for Investment and Development of the Republic of Kazakhstan dated December 26, 2014 No. 299, a legal entity applying for the right to work in the field of industrial safety must have specialists who have confirmed their qualifications with the requirements of professional standards of the Republic of Kazakhstan, approved in accordance with paragraph 2 of Article 117 of the Labor Code of the Republic of Kazakhstan.

According to labor legislation, a professional standard is a standard that defines in a specific field of professional activity the requirements for the level of qualification and competence, for the content, quality and working conditions.

A professional standard is a characteristic of the qualifications (level of knowledge, skills, professional skills and work experience) necessary for an employee to carry out a certain type of professional activity, including performing a certain labor function. The procedure for the development and introduction of professional standards is regulated by labor legislation.

According to Article 117 of the Labor Code of the Republic of Kazakhstan, the development, introduction, replacement and revision of professional standards are carried out by associations (associations, unions) of employers based on the sectoral qualifications framework and approved by the National Chamber of Entrepreneurs of the Republic of Kazakhstan in accordance with the procedure established by the authorized state body for labor.

By Order of the Deputy Chairman of the Board of the National Chamber of Entrepreneurs of the Republic of Kazakhstan «Atameken» No. 270 dated December 30, 2019, professional standards were approved within the framework of the industry qualification framework «Industrial safety Services».

In accordance with the Law of the Republic of Kazakhstan «On the National Chamber of Entrepreneurs of the Republic of Kazakhstan», the National Chamber, within the framework of the function in the field of training, retraining, advanced training, certification and attestation of personnel in the sectors of economy and development of technical and vocational education, carries out independent certification of qualifications of specialists and creates training centers for vocational training, retraining, advanced training and assignment of qualifications in professions (specialties) of technical and service labor.

The procedure for the approval of professional standards, the formation and maintenance of the Register of educational organizations for vocational training, retraining, advanced training and the assignment of qualifications in professions (specialties) of technical and service work, the formation and maintenance of the Register of certification centers of specialists and the Register of certified specialists is established by the Rules of Interaction in the system of the National Chamber of Entrepreneurs of the Republic of Kazakhstan «Atameken» on human capital development dated 25.01.2019 (amendments 24.06.2019 № 121).

Thus, the confirmation of the compliance of the qualifications of specialists with the requirements of professional standards is carried out in order to maintain the necessary level of knowledge for carrying out certified types of work in the field of industrial safety.

The legislation in the field of industrial safety does not define the procedure for professional training and retraining of specialists, nor does it establish requirements for the training procedure and for determining readiness for professional activity. The issues of personnel training and qualification in the field of professional activity, including the issues of training and retraining in educational programs, are not regulated by the legislation in the field of industrial safety.

In this regard, the Certification Centers of specialists formed by the National Chamber of Entrepreneurs of the Republic of Kazakhstan «Atameken» carry out the confirmation of the qualification of specialists to the requirements of professional standards.
