THE CHAIRMAN OF THE FPRK INSTRUCTED THE TRADE UNION CENTERS OF THE REGIONS TO STRENGTHEN CONTROL OVER THE OBSERVANCE OF WORKERS' RIGHTS IN THE REGIONS
On Thursday, June 23, under the leadership of the Chairman of the Federation of Trade Unions of the Republic of Kazakhstan Satybalda Dauletalin, a working meeting was held with the chairmen of territorial unions of trade unions.
According to the agenda of the meeting, the issues of the activities of Territorial associations of trade unions on amendments and additions to the existing regional agreements on the development of social partnership, taking into account the recommendations of the Federation of Trade Unions, were considered.
The analysis showed that, for the most part, regional agreements signed by akimats of regions and representatives of employees and employers need to be revised and brought into line with the General Agreement between the Government of the Republic of Kazakhstan, republican associations of employees and republican associations of employers for 2021-2023.
"Regional agreements are often declarative in nature. The indicators specified in the regional agreements on occupational safety and health, compliance with social guarantees for employees and ensuring employment of the population require revision. Trade unions should initiate amendments and additions to these acts so that our social partners strive to improve the indicators not on paper, but in real reality. In addition, it is the trade unions themselves who must fulfill their obligations and monitor the fulfillment by social partners of their obligations under regional agreements," the Chairman of the FPRC stressed.
According to him, at the next meetings of the regional trilateral space commissions, it is necessary to raise the issue of the implementation of regional agreements by all parties of the social partnership.
"It is difficult to talk about the implementation of the initiative of the Head of State to build a New Kazakhstan without the parity responsibility of the parties for the observance of the social and labor rights of workers. The trade union, as the only organization protecting the rights of workers, should be at the forefront in this matter," the Chairman of the FPRC noted.
Satybaldy Dauletalin also instructed to activate the work of the Trade Union Centers of the regions to expand the coverage of enterprises with the action "Labor Consultations". Recall that the initiative of the Federation of Trade Unions of the Republic of Kazakhstan to conduct labor consultations at Kazakhstani enterprises was supported by the Republican Tripartite Commission on Social Partnership and Regulation of Social and Labor Relations.
"We are talking about bilateral joint consultations, information exchange. On the one hand, the employer transmits information related to production management to trade unions, on the other – receives information from trade unions related to working conditions. The system of joint consultations contributes to the reduction of labor conflicts, the exclusion of protracted confrontation between the parties," the Chairman of the FPRC reminded his colleagues.
In this regard, a pool of trade union negotiators is already operating in the regions of Kazakhstan – Enbek Elshisi. Satybaldy Dauletalin noted that no enterprise should be left without the attention of the pool of negotiators.
"All enterprises and especially those that are in the risk map for labor conflicts should visit our Enbek Elshisi. I instruct all 17 Trade Union Centers to carry out this work on an ongoing basis. The rights and interests of employees of enterprises should be under the full control of trade union organizations," stressed Satybaldy Dauletalin.
The Chairman of the FPRC paid special attention to the work of the Legal Clinic of the Federation and its branches in the regions of Kazakhstan. As part of the legal clinic, there are currently 17 public reception rooms at territorial unions of trade unions.
Schedules for the reception of citizens have been formed, which are posted on the website of the Federation of Trade Unions of the Republic of Kazakhstan. Reception in public reception rooms is conducted by the heads of Trade union centers, deputies of local representative bodies, heads of local trade unions of various fields of activity, legal services and mediators of Reconciliation Centers.
In the first half of this year, 1,827 appeals from trade union members were considered within the framework of public reception. Most of the appeals concerned labor relations, wage issues and trade union activities.
Satybaldy Dauletalin instructed to strengthen cooperation with the primary trade union organizations of the regions in terms of providing free legal assistance to trade union members and to ensure constant monitoring of the consideration of requests sent to authorized state bodies and organizations based on the results of appeals from trade union members for their logical completion, making positive decisions. In addition, Trade union centers need to establish cooperation with judicial and law enforcement agencies, as well as human rights organizations of the regions, in accordance with the legislation, and conduct a monthly analysis of appeals with the identification of the most problematic issues for their further solution through the improvement of legislation.
