On amendments to the order of the Minister of national economy of the Republic of Kazakhstan dated November 6, 2014 No. 72 "on approval of the Rules for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex who arrived to work and live in rural settlements»
ORDER:
the title of the order should read as follows:
"On approval of the Rules for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of mayors of villages, settlements, rural districts who arrived to work and live in rural settlements»;
paragraph 1 of the order should read as follows:
"1. to Approve the attached Rules for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of mayors of villages, settlements, rural districts who have arrived to work and live in rural settlements.»;
in the Rules for providing social support measures to specialists in the fields of health, education, social security, culture, sports and agro-industrial complex who have arrived to work and live in rural settlements, approved by the specified order:
the title should read as follows:
"Rules for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of mayors of villages, settlements, rural districts who have arrived to work and live in rural settlements»;
paragraphs 1 and 2 should read as follows:
«1. These Rules of provision of measures of social support to specialists in the field of health, education, social welfare, culture, sport and agriculture, the state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation in selectionline points (hereinafter – regulations) developed in accordance with zakonomernosti of Kazakhstan dated
July 8 2005 "On the state regulirovaniye agro-industrial complex and rural territories" (further – the Law), from
the 15th April 2013 "On public services" (hereinafter – the Law on state service) budgetin code of the Republic of Kazakhstan dated 4 December 2008, and opredelyayutsya provide professionals in the field of health, education,social welfare, culture, sport and agriculture,the state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation at rural settlements (hereinafter –service recipient), by the decision of local representative bodies (maslikhats)resettlement allowance and social support for purchasing or stroitelstva at the expense of budgetary funds.
A list of basic requirements for its provision, including the process characteristics, the form, content and result of rendering, and also other information taking into account characteristics of the provision of public services set out in the standard of the state service "Provision of measures of social support to specialists in the field of health, education, social welfare, culture, sport and agriculture, the state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation at rural settlements" according to Annex 1 to this Regulation.»;
the title of Chapter 2 should read as follows:
"Chapter 2. Procedure for providing social support measures to specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of mayors of villages, settlements, rural districts who have arrived to work and live in rural settlements»;
paragraph 3 should read as follows:
"3. Lifting allowance and social support for the purchase or construction of housing is provided to service recipients specified in paragraph 8 of article 18 of the Law.
In this state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation at rural settlements, mobility allowance and social support for the acquisition or construction of housing is subject to the restrictions under paragraph 12 of article 56 of the Law of the Republic of Kazakhstan from November 23, 2015
"On state service of the Republic of Kazakhstan".»;
paragraphs 5 and 6 should read as follows:
«5. Budget credits are granted to local Executive bodies of oblasts by entering into credit agreements on the following terms:
followed by the provision of specialists in the field of health, education, social welfare, culture, sport, agriculture and state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation at rural settlements, for the purchase or construction of housing in tenge for a term of up to fifteen years at an interest rate of 0.01 % per annum;
the loan disbursement period is calculated from the moment of transfer of credits from the lender's account and is 22 (twenty-two) months.
The list indicates the name and number of service recipients, and/or their specialties, for which social support measures will be provided in the form of a lifting allowance and a budget loan for the purchase or construction of housing for the upcoming period.
The local representative body (maslikhat) of the district (city of regional significance) annually decides to provide social support measures to service recipients in the form of a lifting allowance and a budget loan for the purchase or construction of housing.»;
paragraphs 9 and 10 should read as follows:
"9. Budget lending for the purchase or construction of housing for specialists in the field of health, education, social security, culture, sports and agro-industrial complex, civil servants of the offices of mayors of villages, settlements, rural districts is carried out subject to a contract with a lawyer (agent).
The mayor of a district (city of regional significance) enters into a contract of assignment with a lawyer (agent) for the implementation of a budget program for crediting service recipients for the purchase or construction of housing in accordance with the legislation of the Republic of Kazakhstan.
Funds for reimbursement of expenses for operational services of an attorney (agent) for the implementation of a budget program for crediting service recipients for the purchase or construction of housing are provided within the local budget in accordance with budget legislation.
1) when receiving a lifting allowance:
application form in accordance with Annex 2 to these Rules;
an identity document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the service recipient's employment;
2) when receiving a budget loan for the purchase of housing:
application form in accordance with Annex 2 to these Rules;
an identity document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the service recipient's employment;
the certificate on the state registration of conclusion of marriage (matrimony) (for услугополучателей, married service recipients) for identification;
report from the Credit Bureau;
3) when receiving a budget loan for housing construction:
application form in accordance with Annex 2 to these Rules;
an identity document (for identification purposes);
a copy of the diploma of education;
a copy of the document confirming the service recipient's employment;
the certificate on the state registration of conclusion of marriage (matrimony) (for услугополучателей, married service recipients) for identification;
report from the Credit Bureau.
The requirement to submit other documents not provided for by these Rules is not allowed.
It is allowed to apply for a lifting allowance and a budget loan for the purchase or construction of housing at the same time.
When applying through the Portal to the statement attach electronic copies (scanned) of these documents (except documents obtained from the respective information systems), certified by the electronic digital signature of the applicant or certifying one-time password, in case of registration and connection of the subscriber number of the service recipientprovided by the mobile operator account portal, and are sent from the Portal to the automated information system "Software for accepting applications for rural mortgage" (IP) to the service provider.
When contacting the Portal, the service recipient's" personal account " услугополучателяis sent a status of acceptance of a request for social support measures, indicating the date and time of receipt of the result.";
paragraph 15 should read as follows:
«15. The result of rendering of measures of social support is the notification of the need for treatment of the service recipient to the service provider (indicating the address and contact details) for the conclusion of Agreements on granting of measures of social support to specialists in the field of health, education, social welfare, culture, sport and agriculture, the state servants of akim's apparatus of villages, settlements, rural districts, arrived for work and accommodation at rural settlements, in accordance with Appendix to this Regulation (hereinafter – the Agreement), the registration of the order or a reasoned refusal in granting of measures of social support.
The service provider provides delivery of the result of the public service to the State Corporation no later than one day before the expiration of the term for rendering the public service.
When applying through the Portal to the" personal account " of the service recipient, a notification about the provision of social support measures or a reasoned refusal to provide the service is sent. If the service is successfully rendered, a notification is sent to the Portal with the address of the service provider for signing the Agreement.»;
paragraph 18 should read as follows:
«18. Social support measures are provided to service recipients who do not have outstanding overdue debts on previously issued loans (at the time of reviewing the documents specified in paragraph 10 of these Rules), as well as in the absence of a delay for the last 2 (two) years of more than 90 (ninety) calendar days.»;
appendices 1, 2, 3 and 4 shall be redrafted in accordance with appendices 1, 2, 3 and 4 to this order.
1) state registration of this order in the Ministry of justice of the Republic of Kazakhstan;
2) placement of this order on the Internet resource of the Ministry of national economy of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order in the Ministry of justice of the Republic of Kazakhstan, submission to the Legal Department of the Ministry of national economy of the Republic of Kazakhstan of information on the implementation of measures provided for in subitems 1) and 2) of this paragraph.
