"Registration of the dissolution of marriage (matrimony), including amendments, additions and corrections to civil status records"

Term of rendering of the stateState

registration of the dissolution of a marriage (matrimony) by mutual consent of spouses who do not have minor children is performed after the expiration of one month from the date of filing an application. The term begins on the next day after the application is submitted and expires on the corresponding day of the following month. If this number falls on a non-working day, then the working day following it is considered the deadline day. Month period may not be reduced;
the state registration of dissolution of marriage (matrimony) on the basis of an enforceable court decision on the recognition wife missing, or incapacitated, also the sentence of the court condemning the husband for the offence to imprisonment for a term not less than three years - forty-five (45) calendar days (day of reception does not enter in time rendering the state service), with notification within a week from the date of receipt of the application spouse in encapsulationand, or a guardian of an incapacitated spouse or the guardian of the property of a recognized missing spouse;
changes, additions and corrections to the record of civil status act - 5 (five) working days;
in the absence of IP registry office records the service period shall be extended for not more than 15 (fifteen) calendar days from notification of the applicant within 3 (three) calendar days (renewal of term of consideration of applications received through State Corporation result of state service rendering sent by the service provider in the State Corporation);
when submitting through the portal – notification on the confirmation of acceptance of application withinand 1 (one) working day shall be sent to the personal Cabinet;
The maximum allowed waiting time for submitting a package of documents is 20 (twenty) minutes.
The maximum allowed service time for the service recipient is 20 (twenty) minutes.

Result of rendering state aid services

1) a certificate of state registration of the dissolution of marriage (matrimony), a repeated certificate of state registration of the dissolution of marriage (matrimony);
2) a reasoned response on refusal to provide state services.
Form of providing the result of rendering a public service: paper, electronic, when a certificate of divorce is sent, a reasoned refusal when submitting an application through the portal.

The amount of payment charged to service recipient in the provision of public services and the means of collection in cases stipulated by the legislation of the Republic of Kazakhstan

1) by mutual consent of the spouses having no minor children – 2 MCI;
2) on the basis of a court decision with persons recognized as missing, incapacitated or convicted of the offence to imprisonment for a term not less than three years – 0.1 MCI;
3) for issuing a certificate in connection with a change, addition, correction and restoration of record of the certificate on divorce (marriage) – 0,5 MCI.
They are exempt from paying the state fee for registration of civil status acts upon presentation of supporting documents:
1) participants and invalids of the great Patriotic war and persons equated on privileges and guarantees, persons awarded orders and medals of the former Union of SSR for selfless labor and flawless military service in the rear during the great Patriotic war, persons who worked (served) not less than six months from 22 June 1941 through 9 may 1945 and not awarded with orders and medals of the former Union of SSR for selfless labor and flawless military service in the rear during the great Patriotic war, the disabled, and also one of the parents of a disabled from childhood, a disabled child, guardians (Trustees), the state organization for the registration and issuing of repeat certificates on birth;
2) natural persons – for issuing to them the witnessof STV PRand the alteration, addition, restoration and correction of records of civil status in connection with errors made during registration of acts of civil status.

Working work Schedule

1) service provider - from Monday to Friday inclusive from 09.00 to 17.30 hours, break from 13.00 to 14.30 hours, except weekends and holidays.
 Public service is provided on a first-come, first – served basis, without prior appointment and accelerated service;
2) State Corporation-from Monday to Saturday inclusive, in accordance with the established work schedule from 9-00 to 20-00 hours without lunch break, except for Sundays and public holidays, in accordance with labor legislation.
Reception is carried out in the order of "electronic" queue, without accelerated maintenance, it is possible to book an electronic queue through the portal;
3) portal-around the clock, except for technical breaks related to repair works (when contacting the service recipient after the end of working hours, on weekends and holidays, the application is accepted and the result of rendering the public service is issued on the following working day).

The list of documents necessary for rendering of the state service

1) application for state registration of dissolution of marriage (matrimony) according to the application 18 or 19 to the Rules depending on the reason of termination of marriage (matrimony);
2) the document proving the identity (for identification);
3) certificate on conclusion of marriage (matrimony);
4) document confirming payment of the state fee;
5) information on the entered into force court decision on the recognition wife missing, either incompetent or a court verdict condemning the spouse (-and) for the offence to imprisonment for a term not less than three years;
6) a notarized power of attorney in case of representative of the applicant.
The list of necessary documents for making changes, additions and corrections to the statutory record on the dissolution of marriage (matrimony):
1) application on making amendments, corrections and additions in the form of Annex 24 to the Rules;
2) the document proving the identity (for identification);
3) the original certificate of state registration of civil status, which is to be exchanged in connection with the amendments, additions and corrections to the record of civil status, in case of loss of the original certificate to indicate that it is lost and information on registration of civil status;
4) a document confirming the grounds for making changes, additions and corrections to the record of civil status act;
5) a notarized power of attorney in case of representative of the applicant.
When contacting the portal to register the dissolution of marriage (matrimony) by mutual consent of spouses who do not have minor children:
1) an electronic application, certified by the service recipient's EDS or certified by a one-time password, in case of registration and connection of the service recipient's subscriber numberprovided by the mobile operator to the portal's account;
2) information on civil registration.

Grounds for refusal to provide a public service, established by the legislation of the Republic of Kazakhstan

1) establishing the unreliability of documents submitted by the service recipient for receiving a public service, and (or) data (information) contained therein;
2) non-compliance of the service recipient and (or) submissions, data and information necessary for rendering public services the requirements of the Code of the Republic of Kazakhstan "On marriage (matrimony) and family", the Laws of the Republic of Kazakhstan "On identity documents" and "About national registers of identification numbers", of these Regulations;
3) when applying for state registration of dissolution of marriage (matrimony) on the basis of the joint statement of spouses through the representative
by law of the Republic of Kazakhstan may establish other grounds for refusal to provide public services.

Other requirements, taking into account the specifics of the provision of public services, including those provided in electronic form and through a State Corporation
