"Registration of marriage (matrimony), including amendments, additions and corrections to civil status records"

 Name of the service provider

M & E of Nur-Sultan and Almaty, Shymkent, districts and cities of regional significance (hereinafter-the service provider)

 Methods of providing public services (access channels)

1) through the service provider;
2) MIO of districts in the city, cities of district significance, akims of settlements, villages,rural districts;
3) through the portal.

Term of rendering the state service

from the date of delivery of the document package to the service provider , the registration of marriage (matrimony) is made within one month from the date of submission of the application to the service provider wish to enter into marriage (matrimony) (day of reception does not enter in time rendering the state service);
at the joint request of the persons entering into marriage (matrimony), if there are valid reasons (pregnancy, the birth of the child, direct threat of life of one of the parties, and other special circumstances), confirmed by respective documents (the certificate of the medical qualifying Commission of the pregnancy, proof of health, medical certificates and other special circumstances), the service provider at the place of state registration of conclusion of marriage (matrimony) shall appoint the conclusion of marriage (matrimony) before the end of the month or increase this term, but not more than a month on the basis of written statements of service recipients on the day of submission of the application;
if there are special circumstances (pregnancy, childbirth, the immediate danger to the life of one of the parties, and other special circumstances) state registration of conclusion of marriage (matrimony) at the request of the persons entering into marriage (matrimony) on the day of filing the application with the obligatory indication of the reasons and supporting documents;
changes, additions and corrections to the record of civil status act - 5 (five) working days;
in the absence of IP registry office records the service period shall be extended for not more than 15 (fifteen) calendar days from notification of the applicant within 3 (three) calendar days (in case of extension of period for consideration of applications, received through the State Corporation the result of rendering the state service, is sent by the service provider in the State Corporation);
when submitting through the portal – notification on the confirmation of acceptance of application withinand 1 (one) working day shall be sent to the personal Cabinet;
The maximum allowed waiting time for submitting a package of documents is 20 (twenty) minutes.
The maximum allowed service time for the service recipient is 20 (twenty) minutes.

Result of rendering state aid services

1) a certificate of state registration of marriage (matrimony), a repeated certificate of marriage (matrimony) with amendments, additions and corrections;
2) a reasoned response on refusal to provide a state service.
Form of providing the result of rendering a public service: paper, electronic, when a certificate of marriage (matrimony) is sent, a reasoned refusal when submitting an application through the portal.

The amount of payment collected from the service recipient when providing a public service, and the methods of its collection in cases provided for by the legislation of the Republic of Kazakhstan

1) for the registration of marriage - 1 (one) MCI;
2) for issuing a certificate in connection with changing, supplementing, correcting and restoring the record of the act of marriage (matrimony) – 0.5 MCI.
They are exempt from paying the state fee for registration of civil status acts upon presentation of supporting documents:
1) participants and invalids of the great Patriotic war and persons equated on privileges and guarantees, persons awarded orders and medals of the former Union of SSR for selfless labor and flawless military service in the rear during the great Patriotic war, persons who worked (served) not less than six months from 22 June 1941 through 9 may 1945 and not awarded with orders and medals of the former Union of SSR for selfless labor and flawless military service in the rear during the great Patriotic war, the disabled, and also one of the parents of a disabled from childhood, a disabled child, guardians (Trustees), the state organization for the registration and issuing of repeat certificates on birth;
2) natural persons – for issuing to them the witnessof STV PRand the alteration, addition, restoration and correction of records of civil status in connection with errors made during registration of acts of civil status.

Working working Hours

1) service provider - from Monday to Friday inclusive, except weekends and holidays.
Reception of statements and issue of result of rendering the state service from service provider – Monday through Friday inclusive, 09.00 to 17.30, a break from 13.00 to 14.30 o'clock, except days off and holidays;
The public service is in a queue, without an appointment and the accelerated service;
2) the portal – around the clock, except for maintenance related repairs (with the appeal of the applicant after the end of working hours, weekends and public holidays, reception of statements and issue of result of rendering of the state service is carried out the next working day).

List of documents required for the provision of public services

When contacting the service provider:
1) an application for the conclusion of marriage (matrimony) in accordance with Annex 14 to these Rules;
2) a document certifying the identity of service recipients
3) a document confirming payment of the state duty to the budget;
Foreigners, and persons without citizenship in addition represent:
- certificate of capacity of marriage (apostilled/legalized, translated into Russian or the state language);
- a Foreigner permanently residing in the Republic of Kazakhstan, shall present the residence permit of the foreigner in the Republic of Kazakhstan;
a stateless Person permanently residing in the Republic of Kazakhstan, makes the identity of the person without citizenship with a mark of bodies of internal Affairs of the Republic of Kazakhstan on registration by place of residence;
a Foreigner or stateless person temporarily staying in the Republic of Kazakhstan, shall submit a document proving his identity, issued by the competent authorities of the country, which is the foreigner or the country of permanent residence of a stateless person and notarially certified translation of the text in Kazakh or Russian language.
The accuracy of the translation of the text of documents certifying the identity of a foreigner or stateless person can be attested at the diplomatic mission or consular office or at the foreign Ministry of the state of which the foreigner is a citizen, or the state of permanent residence of the stateless person.
Along with the presentation of identity documents, a notarized translation of their text in the state or Russian language is provided.
If necessary – a marriage license (matrimony) from the competent authority of the state of which he is a citizen.
If it is necessary to shorten or extend the term of marriage registration (matrimony) established by law, a document confirming the grounds for reducing the term is additionally submitted: a certificate of the medical qualification Commission on pregnancy, a certificate on the state of health, certificates confirming other special circumstances.
If it is necessary to reduce the marriage (matrimonial) age established by the legislation, additionally submitted:
1) an application for reducing the marriage (matrimonial) age in accordance with Annex 16 to the Rules;
2) documents confirming the need to reduce the established marriage age: a certificate of the medical qualification Commission on pregnancy or information on the state registration of the birth of a common child;
3) consent of legal representatives of persons entering into marriage (matrimony) who have not reached the marriageable age;
4) information on documents confirming the powers of legal representatives.
If there are previous marriages (spousal relationships), information about the dissolution of the marriage (spousal relationship) or the death of the spouse is provided for data verification.
When registering civil status acts outside the Republic of Kazakhstan, copies are provided (apostilled/legalized, with a notarized translation into Kazakh or Russian language) of the relevant certificates of state registration of the civil status act (originals for verification).
On the portal:
An electronic application, certified by the EDS of the service recipients, both persons entering into marriage.
When registering second and subsequent marriages (matrimony), information about the dissolution of the marriage (matrimony) or the death of the spouse is provided for verification of data.
List of necessary documents for making changes, additions and corrections to the certificate of marriage (matrimony):
1) application on making amendments, corrections and additions in the form of Annex 24 to the Rules;
2) the document proving the identity (for identification);
3) the original certificate of state registration of civil status, which is to be exchanged in connection with the amendments, additions and corrections to the record of civil status, in case of loss of the original certificate to indicate that it is lost and information on registration of civil status;
4) a document confirming the grounds for making changes, additions and corrections to the record of civil status act;
5) a notarized power of attorney in case of representative of the applicant.

Grounds for refusal to provide a public service established by the legislation of the Republic of Kazakhstan

In case of submitting an application:
1) persons of the same sex;
2) persons of whom at least one person already consists in another registered marriage (matrimony);
3) between close relatives;
4) between adoptive parents and adopted children, children of adoptive parents and adopted children;
5) persons, at least one of which is recognized as incapable due to mental disease or dementia by a court decision entered into legal force;
6) through a representative;
7) in case of establishing the fact of providing false information;
8) if the registering authority has the evidence proving the existence of circumstances hindering the marriage (matrimony);
9) establish the unreliability of the documents submitted by a service recipient to obtain public service, and (or) data (information) contained in them;
10) mismatch of the applicant and (or) the submitted materials, objects, data and information necessary for rendering public services the requirements established by the regulatory legal acts of the Republic of Kazakhstan;
Laws of the Republic of Kazakhstan may establish other grounds for refusal of provision of public services.

Other requirements, taking into account the specifics of the provision of public services, including those provided in electronic form and through a State Corporation
