Rules for state registration of tractors and self-propelled chassis and mechanisms manufactured on their basis, trailers to them, including trailers with mounted special equipment, self-propelled agricultural, land reclamation and road-building machines and mechanisms, special off-road vehicles
Chapter 1. General provisions
1) information system – an organizational and ordered set of information and communication technologies that provide centralized accounting of information about machines and their owners in the subsystem "state registration of agricultural machinery" of the information system "unified automated system for managing branches of the agro-industrial complex" E-Agriculture" ;
2) primary registration of machines – the state registration of machines, which is carried out for the first time on the territory of the Republic of Kazakhstan.
State registration of vehicles temporarily imported into the territory of the Republic of Kazakhstan is not the initial registration of vehicles;
3) de-registration of cars – actions related to the loss, alienation of cars to another person, as well as the disposal or export of cars to a permanent place of residence outside the Republic of Kazakhstan;
4) owner of machines – a natural or legal person who actually owns a machine in the current period of time on the basis of the right of ownership or temporary possession and consumption belonging to him;
5) owner of a car – a natural or legal person who has the right to own, use and dispose of the car belonging to him at his own discretion;
6) re-registration of machines-making changes and additions to the registration data of the machine and registration documents in the presence of appropriate legal grounds;
7) state registration, including the registration of primary registration points, the results of the state registration registration plates, confirming the admission of vehicles to participate in traffic (hereinafter – number plate) and registration documents (hereinafter – the registration is););
8) electronic register of registration of machines – a set of data containing information about the machine, owner, owner, owner, license plate, technical passport, re-registration, de-registration of machines reflected in the information system;;
9) numbered unit-the main component unit of the machine with the factory registration number (chassis, frame););
10) special off-road vehicles-ATVs and snowmobiles with a maximum design speed of less than fifty and fifty kilometers per hour;
11) certificate of conformity – a document certifying the conformity of products, services to the requirements of article 6 technical regulations of the Customs Union "On safety of agricultural and forestry tractors and trailers", approved by Decision of the Board Eurasian economic Commission of 20 July 2012 No. 60 (hereinafter – technical regulation);;
12) registration document-technical passport in the form according to Annex 1 to these Rules, issued by the service provider, which is an official document for the car, confirming the car's admission to participate in road traffic and operation;1-қосымшаға;
13) registration actions-activities of registration points related to the implementation of registration, temporary registration, re-registration, de-registration of machines with the introduction of changes to the information system;;
14) electronic digital signature – a set of electronic digital characters created by means of an electronic digital signature and confirming the authenticity of an electronic document, its belonging and unchangeability of content.
6.Information about the registration actions of machines is entered into the information system before submitting registration documents to individuals and legal entities (hereinafter referred to as the service recipient), and3-қосымшағаan electronic register of registration of machines is formed in accordance with Annex 3 to these Rules.
7.the owners of the machines within 30 (thirty) calendar days from receipt of the machine in the property (possession), eviction from their property (possessions) or liabilities, entailing the need for registration (re-registration), registration (re-registration) or removal from the register machines that perform actions set forth in these Regulations for registration (re-registration) or de-registration of cars.
8.documents specified in Appendix 2 to these Rules, drawn up in other languages, are submitted for registration in the form of a translation into the state or Russian languages and certified by a notary or other official authorized to perform actions to verify the correctness of translation from one language to another.
1) dates of filling them out;;
2) where to fill them out;
3) information about the car (Make, Model, year of manufacture, factory numbers of the car));
4) signatures of authorized persons (except for persons who are subjects of private enterprise), whose powers are certified by a seal.
Cars imported into the Republic of Kazakhstan that are goods of the Eurasian economic Union (hereinafter referred to as the EEU) are registered without passing through customs Declaration and customs clearance.
Chapter 2. General provisions Procedure for state registration and rendering of public services of tractors and self-propelled chassis and mechanisms manufactured on their basis, trailers to them, including trailers with mounted special equipment, self-propelled agricultural, land reclamation and road-building machines and mechanisms, special off-road vehicles
Paragraph 1. General provisions registration of machines
to the Registration point (to the service provider)):

3) a copy of the certificate* or certificate of state registration (re-registration) of a legal entity – for legal entities;
4) a document confirming payment of duties and fees established by articles 553 and 615 of the Code of the Republic of Kazakhstan dated December 25, 2017 "on taxes and other mandatory payments to the budget" (Tax code) (hereinafter referred to as the Tax code);553 және 615-баптарында;
5)бұйрығыменa document confirming the performance of the producers (importers) of extended commitments during the initial registration of cars included in the list of products (goods) that are subject to the extended obligations of manufacturers (importers), approved by order of the acting Minister of energy of the Republic of Kazakhstan from December 4, 2015 No. 695 (registered in the Register of the state registration of regulatory legal acts for No. 12565) (hereinafter – the list);;
6) documents confirming the ownership of the car, which include::
contracts, transactions, certificates, documents on the right to inherit property concluded in accordance with the requirements of civil law;
the writ accompanied by a certified copy of the court decisions, court orders, notice of a bailiff state action body to be executed;
documents confirming the passage of customs clearance (customs Declaration, customs receipt order, obligation to re-export in cases of temporary import, except for cases of import from the countries of the Eurasian economic Union (hereinafter referred to as the EEU) );
7) certificate of conformity of the Republic of Kazakhstan or other document confirming their compliance with article 6 of the technical regulations for machines that are the result of new and individual technical creativity or imported into the territory of the Republic of Kazakhstan.

4) documents confirming the ownership of the car, which include::
contracts, transactions, certificates, documents on the right to inherit property concluded in accordance with the requirements of civil law;
the writ accompanied by a certified copy of the court decisions, court orders, notice of a bailiff state action body to be executed;
documents confirming the passage of customs clearance (customs Declaration, customs receipt order, obligation to re-export in cases of temporary import, except for cases of import from the EEU countries));
5) certificate of conformity of the Republic of Kazakhstan or other document confirming their compliance with article 6 of the technical regulations for machines that are the result of new and individual technical creativity or imported into the territory of the Republic of Kazakhstan.
Note: * certain legislative acts of the Republic of Kazakhstan on state registration of legal entities and record registration of branches and representative offices", "on amendments and additions to" the Republic of Kazakhstan from December 24, 2012the Law(hereinafter – the law on Legal entities), issued before the entry into force of the legal entity (branch, representative office), the state (accounting) registration (re-registration) of a legal entity, the certificate will be valid until the termination of the activity.
In cases of first registration of the car are presented:6-қосымшағаphotographs of the inspection of registered vehicles (excluding cars purchased from an authorized dealer (representative) of the manufacturer of machinery on the territory of the Republic of Kazakhstan) in accordance with the criteria to provide customers with photographs for inspection of machinery in accordance with Annex 6 to this Regulation (contain types that enable you to identify the object of study we examine the machine).
If representatives perform registration actions on behalf of the owner or owner, in addition to the documents established by this paragraph, documents certifying the authority of the owner or owner to represent the interests of the owner or owner are submitted to the registration point (service provider).
If a car that was previously under state registration in the Republic of Kazakhstan is subject to state registration, then in addition to the documents established by this paragraph, the former registration document is submitted to the Registration point (service provider), but failure to submit this document is not a ground for refusal to conduct state registration.
In case of registration actions, including registration of cars, the following documents confirming the right of ownership are submitted to persons who are not owners::
contract (lease, sublease, lease, sublease, mortgage) and certificate of acceptance and transfer of the car;
written consent of the car owner to perform the appropriate registration actions, signed by the owner (for individuals) and signed by the first head of the legal entity (for legal entities).
If the car on which registration actions are performed is in common ownership, then all owners are indicated in the registration documents and all documents are issued on behalf of all owners of the car. A notarized transaction is the basis for alienating the common property of individuals.
If the owners are minors who have not reached the age of 14, registration actions on their behalf are performed by parents( adoptive parents) or guardianship authorities with the submission of a birth certificate.
If the owners are persons aged from 14 to 18 years, registration actions are performed by these persons with the written consent of parents (adoptive parents) or guardianship and guardianship authorities with the submission of a birth certificate.
In case of purchasing cars by legal entities and individuals through auctions and trading exchanges: the auction Protocol and the purchase and sale agreement must be signed by authorized persons.
1) a member of the office of the registration point (the service provider) carries out the reception of documents, their registration and confirms the acceptance of the application with a mark about acceptance of documents with indication of date and time of reception of the documents for copies of the application and shall forward to the chief of registration point (of the service provider);;
2) the head of the registration point (service provider) reviews the documents and sends them to the responsible contractor of the registration point (service provider) (hereinafter referred to as the engineer – inspector) for execution.
3) the engineer-inspector performs registration actions and enters data into the information system and prepares a draft of the result of rendering the public service and sends it to the head of the registration point (service provider) for signing;
4) the head of the registration point (service provider) signs the result of rendering the state service and sends it to the employee of the registration point's office (service provider);;
5) an employee of the office of the registration point (service provider) issues to the service recipient a registration document (duplicate) and /or7-қосымшағаa reasoned response on refusal to provide public services in the form according to Annex 7 to these Rules;;
When submitting an application electronically via the portal:
1) in the" personal account " of the service recipient, the status of accepting a request for public service provision is displayed;;
2) the engineer-inspector reviews the received documents through the portal, prepares the result of rendering the public service and sends it to the head of the registration point (service provider) for signing;
3) sends to the service recipient8-қосымшағаa notification of the readiness of the registration document (duplicate) and (or) license plates in accordance with Annex 8 to these rules, or7-қосымшағаa reasoned response on refusal to provide public services in accordance with Annex 7 to these Rules.
1) identification of unreliability of documents submitted by the service recipient for receiving a public service, and (or) the data contained therein (information) ;
2) non-compliance of the service recipient and (or) materials, objects, data and information required for the provision of a public service with the requirements established by these Rules;;
3) Availability of a court decision (sentence) that has entered into legal force regarding the service recipient on the prohibition of activities or certain types of activities that require receiving a certain state service;
4) the presence of a court decision that has entered into legal force in respect of the service recipient, on the basis of which the service recipient is deprived of a special right to receive a public service.
15.The registration point (service provider) ensures that information about the stage of rendering a public service is entered into2-тармағыныңthe information system for monitoring the provision of public services in accordance with subparagraph 11) of paragraph 2 of article 5 of the Law in accordance with the procedure established by the authorized body in the field of Informatization.
Information interaction between the portal and the information system is carried out in accordance with article 43 of the Law of the Republic of Kazakhstan dated November 24, 2015 "on Informatization"43-бабына.
In case of failure of the information system containing the information necessary for registration actions and issuance of a registration document (duplicate) and license plate for cars, the Registration point (service provider) immediately notifies the operator of the information system (hereinafter referred to as the operator).
In this case, the operator draws up an arbitrary report on the technical problem and signs it at the Registration point (to the service provider).
In this case, the list of letter designations in the Latin transcription of regions and cities of the Republic of Kazakhstan, used in a series of forms of technical passports and license plates9-қосымшаға, is applied in accordance with Annex 9 to these Rules.
Expenditure of registration documents and license plates of cars is made in the information system in ascending order of series and their digital numbers.
The number of incoming and issued license plates and technical passports10-қосымшағаis reflected in the register of registration of receipt and issuance of license plates and technical passports in the form according to Annex 10 to these Rules.
The log of receipt and issuance of license plates and technical passports, as well as registration forms and license plates are stored at the place of registration of the car.
Registration forms that are damaged during filling out, license plates that are unsuitable for further use, are disposed of by means and methods that exclude the possibility of their reuse, and relevant certificates are drawn up.
Settlement of issues related to the provision of license plates is made by the registration point (service provider).
1) authorized state bodies in cases stipulated by the legislation of the Republic of Kazakhstan;
2) a written request from the car owners.
27.machines of manufacturing plants, trade or other organizations that sell machines on the basis of the Charter of a legal entity, intended for sale and not used for personal economic purposes, are not subject to state registration.
28.cars are registered to individuals for the period of permanent residence or temporary residence at the place of temporary stay (in the absence of permanent registration) or in the on state revenue by location (in case of registration of the physical person as the individual businessman), register of legal entities on legal address and branches of legal entities, the location of the branches with the written permission of the legal entity.
29.If the state registration of machines is performed by persons to whom they are transferred in trust management, economic management in accordance with lease, leasing, mortgage, loan agreements, registration actions in respect of which are performed with the written consent of the participant (participants) of these agreements.
The powers of the representative certified notarially certified power of attorney, power of attorney of the representative of the legal entity, certified by signature and seal of the legal entity (except for persons who are private entrepreneurs). Identification of citizens aged from 14 to 18 years is carried out upon presentation of a birth certificate of a minor in the presence of their parents (adoptive parents), guardians (Trustees) or a representative of guardianship and guardianship authorities.
The registration point (service provider) receives the necessary information about the registration actions of cars at the place of previous registration of the car through the information system at the place of intended registration actions.
After receiving information from the information system at the place of registration of cars at the registration point( at the service provider) at the place where registration actions are supposed to be performed, the necessary registration actions are performed.
32.if state registration or other registration actions are made for individuals who are not owners, disposal of the machine from the possession of the person, in which the vehicle is registered to or the deprivation of the person of a right to future possession of the car is the basis for the relevant registration procedures at the initiative of the owner and the subsequent registration of the car in the name of the owner.

3) agreement of lease, sublease, leasing, subleasing, trust management, economic management, mortgage, loan or other document confirming the right of ownership of machines, and for temporarily imported machines-the consent of the owner (owner) land plot or territory for temporary registration of vehicles;;
4) when importing cars from outside the Republic – documents confirming the passage of customs clearance (customs Declaration, customs receipt order, except in cases of import from the EEU countries, an obligation to re-export in cases of temporary import).

The term of temporary registration of vehicles is established in accordance with the terms of validity of the documents specified in subparagraph 4) of this paragraph of the rules.
Paragraph 2. General provisions re-Registration of vehicles
1) changes in ownership rights;
2) the emergence, termination of the right of common ownership of machines and changes in the composition of common owners;;
3) changes in the place of residence (legal address) of the owner (owner) of the car at the will of the owner (owner) of the car;
4) changes in the name, patronymic (if any), surname of the person in respect of which the car is registered;
5) changes in the type of machine due to re-equipment or replacement of numbered units, installation of special equipment and other similar changes.

documents confirming the passage of customs clearance (customs Declaration, customs receipt order, obligation to re-export in cases of temporary import, except for cases of import from the EEU countries).
Note: * a certificate of state (accounting) registration (re-registration) of a legal entity (branch, representative office) issued before the entry into force of the law on legal entities is valid until the termination of the legal entity's activities.
Paragraph 3. General provisions de-registration of vehicles
1) Change of place of residence (legal address) of the person in which the car is registered (if a new place of residence (legal address) is located outside the service area registration point to register a machine (service provider););
2) termination of ownership of the car;
3) recyclable machines (required invalid, write-off);
4) export of the car outside the Republic of Kazakhstan.

43.in cases of de-registration of machines transferred to state ownership on the basis of a court decision, bailiffs, officials of other state bodies are subject to the requirements provided for by these Rules for representatives of owners of machines.
46.32-тармағындаin cases of owners ' actions provided for in paragraph 32 of these Rules, cars are not removed from registration.
Chapter 3. General provisions Procedure for appealing against decisions, actions (omissions) of registration offices (service providers) and (or) their officials concerning the provision of public services
Registration point (service provider), within 5 (five) business days from the date of registration of the authorized body;
the authorized body for assessment and control of the quality of rendering of public services within 15 (fifteen) working days from the date of registration.
50.4-тармағынаtime limit for consideration of the complaint in accordance with paragraph 4 of article 25 of the Law of the registration office (service provider), the authorized body, the authorized body for assessment and control of the quality of public services:
1) conducting an additional investigation or verification based on a complaint or a field visit;
2) if it is necessary to obtain additional information for a period of no more than ten working days.
In case of prolongation of term of consideration of complaints officer, has the authority to consider complaints within 3 (three) working days since the extension of term of consideration of the complaint according to the Complainant the Complainant in writing (with the filing of a complaint on paper) or in electronic form (if the filing of a complaint in electronic form) to extend the term of consideration of the complaint including the reasons for the extension.

Criteria for submitting photographic materials for vehicle inspection
To implement state registration of cars by physical or legal persons submit to the local Executive body of oblasts, cities of Republican significance, capital, districts and cities of regional importance scanned copies of photographs of the inspection, register the machine with the application the following three types of photography.
1) the front part;
2) the back of;
3) front and entire side section;
4) the back and entire side part.

At the same time:
1) providing identification and complete fixing of machine parts, components and dimensions by photographing the machine.
2) obtaining the entire frame by the subject of photography or obtaining a significant (more than 85%) part of the object of photography with leaving a minimum free space along the frame borders;
3) when photographing, the camera is placed on the Central axis of the shooting object or the height of the machine parts and assemblies, while the rear wall of the camera is parallel to the shooting plane of the object;
4) it is recommended to take photos of cars in the daytime, the car should be illuminated evenly by a natural light source (the sun) - photography in the shade of trees, buildings is not allowed.
If there is insufficient light, you can use still photos or additional light sources.
