ORDER:
1. To amend the order of the Minister of agriculture of the Republic of Kazakhstan from March 30, 2015 No. 4-3/270 "On approval of Rules of acceptance of examinations and issue of certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and also special machines of the increased passability" (registered in the Register of the state registration of regulatory legal acts No. 11711 issued on 11 August 2015 in the legal information system "Adilet") with the following changes:
the preamble to read as follows:
"In accordance with subparagraph 19) of paragraph 1 of article 6 of the Law of the Republic of Kazakhstan dated July 8, 2005 "On state regulation of the development of the agro-industrial complex and rural territories" and subparagraph 1) of article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "on public services" I ORDER:";
The rules for taking examinations and issuing certificates for the right to drive tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, land reclamation and road-building machines, as well as special off-road vehicles, approved by the said order, should be set out in a new version in accordance with the Annex to this order.
2. The Department of production and processing of crop products of the Ministry of agriculture of the Republic of Kazakhstan in accordance with the procedure established by law to provide:
1) state registration of this order in the Ministry of justice of the Republic of Kazakhstan;
2) placement of this order on the Internet resource of the Ministry of agriculture of the Republic of Kazakhstan after its official publication.
3. Control over the implementation of this order is entrusted to the supervising Vice-Minister of agriculture of the Republic of Kazakhstan.
4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Rules for taking exams and issuing certificates for the right to drive tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road-building machines, as well as special off-road vehicles
Chapter 1. General provisions
- These Rules of acceptance of examinations and issue of certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and also special machines of the increased passability (hereinafter – regulations) developed in accordance with subparagraph 19) of paragraph 1 of article 6 of the law of the Republic of Kazakhstan dated July 8 2005 "On state regulation of development of agroindustrial complex and rural territories" and subparagraph 1) of article 10 of the law of the Republic of Kazakhstan dated 15 April 2013 "On public services" (hereinafter – the Law).
2. These Rules regulate the procedure of admission examinations and issuing certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and also special machines of the increased passability (hereinafter – the machine) and the order of rendering the state service "issue of certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and mechanisms, and also special cars of the raised passableness" (further – the state service).
3. In the present Rules following basic concepts are used:
1) special all terrain vehicles – snowmobiles and ATVs with a maximum speed of fifty or less than fifty kilometres per hour;
2) the certificate of the tractor operator-the machinist – a document confirming the admission of the tractor drivers to management of vehicles;
3) the service recipient – a natural person who has addressed for receiving the identity of a tractor-driver in the manner prescribed in these Regulations;
4) registration activities – the activities of the service providerrelating to the registration and issuance of the certificate of the tractor operator-the driver of the service recipient, with the introduction of the registration data, and changes to the information system of registration and issuance of the certificate of the tractor operator-the machinist;
5) information system of registration and issuance of the certificate of the tractor operator-the machinist (hereinafter – information system) – organizational ordered set of information and communication technologies, providing a Central register of information in the subsystem "State registration of agricultural machinery" information system "unified automated control system for branches of agro-industrial complex "e-Agriculture".
4. In these Rules, examination points are understood to be educational organizations of technical and vocational education that are accredited in the field of education, or included in the register of training centers and educational institutions for short-term professional training on the Internet resource The national chamber of entrepreneurs of the Republic of Kazakhstan "Atameken".
5. Examination points provide theoretical training, as well as industrial training and professional practice in the specialty "tractor driver of agricultural production". Based on the results of training, the examination points conduct theoretical and practical examinations (final certification), according to the results of which a certificate of completion of training courses (hereinafter referred to as the certificate) is issued in accordance with Annex 1 to these Rules.
The examination for the right to drive cars of all categories is accepted by the examination commissions at the examination points on the day of application.
The exam is conducted to test the knowledge of traffic Rules approved by the government of the Republic of Kazakhstan resolution No. 1196 of November 13, 2014, and the safety of operation of vehicles provided for in the training programs.
Admission of citizens to take the exam and issue a certificate is carried out at their registered permanent residence or place of temporary stay (if there is a temporary residence permit), and for foreign citizens registered with the internal Affairs bodies – at their place of stay.
Admission to the exam is carried out by using computer complexes or examination material, which includes ten questions. To answer all questions, the candidate for tractor driver is given 30 (thirty) minutes.
The correct answers are checked automatically by a computer system or examiner.
The final score "PASSED" is given if the answer is positive for at least eight questions, and otherwise the score "FAILED"is given.
In case of receiving a negative assessment "DID not PASS", the repeated exam is carried out not earlier than 5 (five) calendar days from the date of passing the previous exam.
Timekeeping of time is carried out by a computer complex from the moment of the beginning of the theoretical exam.
The sequence of answers to the ticket questions is chosen by the examinee independently.
The results of the examination are entered in the examination sheet in accordance with Annex 2 to these Rules, and signed by the service recipient and the examination Commission.
Persons who have passed the exam, on the basis of the examination sheet, are issued a certificate within 2 (two) working days.
6. All the machines, depending on their types, purposes and features of management are divided into categories: "A", "B", "B", "G", "D", the right of control which issued the certificate of the tractor operator-the machinist (hereinafter – certificate) in the form of Annex 3 to this Regulation, with putting it in permissive marks in the appropriate categories.
7. The certificate grants the right to operate machines throughout the territory of the Republic of Kazakhstan.
8. Persons who have a certificate with permissive marks in the categories "A", "B", "C", "D"," E " can manage:
1) "A" - wheeled tractors of class up to 30 kilonewtons (3,0 tractive force) inclusive;
2) "B" - wheeled tractors of class over 30 kilonewtonsкилоНьютон (3.0 pulling force);
3) "C" - crawler tractors;
4) "D" - self-propelled agricultural machines;
5) "D" – all self-propelled mechanized reclamation machines and road-building machines, including excavators, tractors with mounted reclamation and road-building machines.
The certificate grants the right to drive vehicles of the appropriate category, if they are equipped with additional equipment or they work as part of an aggregate (trailer, road train).
9. The right to management of vehicles is permitted:
1) persons who have attained the age of seventeen, – the management of vehicles of categories "A", "b" and "G";
2) persons under eighteen years of age, if you have experience of driving vehicles of categories "A" and "b" or "G" not less than six months –ddopolnitelno to the right to management of vehicles of category "B" and "D".
10. Category "B" (or) "D" are provided to service recipientswho have certificates with the allowing marks in columns "A" and "b" or "G" (overall seniority of the applicant on the relevant machines for at least six months), and have passed in the examination item theory test.
The document confirming the service recipient's employment can be any of the documents specified in article 35 of the Labor code of the Republic of Kazakhstan dated November 23, 2015.
11. For the right to drive special off-road vehicles, a certificate is issued with the entry "driving snowmobiles, ATVs is allowed" in the column "for special marks".
Issuing of certificates with record of "managing snowmobiles and (or) ATVs allowed" in the column "special marks" is carried out in the presence of identity with the allowing categories "A" and "b" or "B", "B", or driver's license with a resolution of category "A" or "1" or "B1".
When issuing a certificate with the entry "driving snowmobiles and (or) Quad bikes is allowed", a stamp with a diagonal stripe is placed in the columns "permission mark".
Chapter 2. Procedure for rendering public services
- The state service is provided by local Executive bodies of oblasts, cities of Republican significance, the capital, districts and cities of regional significance (hereinafter referred to as the service provider).
13. to receive a public service, the service recipient submits an electronic application via веб-порталthe e-government web portal www.egov.kz (hereinafter referred to as the portal), or an application in paper form to the service provider's office in accordance with Annex 4 to these Rules.
14. A list of the main requirements for the provision of public services, including the process characteristics, the form, content and result of rendering, and also other information taking into account characteristics of the provision of public services set out in the standard of state service "Issuance of certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and mechanisms, and also special cars of the raised passableness" in accordance with Annex 5 to this Regulation (hereinafter – the Standard of the state service).
15. An employee of the service provider's office receives and registers documents on the day of receipt.
If the service recipient applies after the end of working hours, on weekends and holidays in accordance with the labor legislation of the Republic of Kazakhstan, documents are accepted and the results of public service provision are issued on the following working day.
If the service recipient submits an incomplete set of documents, as well as expired documents, the employee of the service provider's office refuses to accept the application and issues a receipt for refusal to accept the documents.
Confirmation of acceptance of the application on paper in the office of the service provider is a mark on its copy of the registration with the indication of the date, time (hours, minutes).
If the service recipient applies through the portal, the service recipient's" personal account " услугополучателяdisplays the status of accepting the request for public service provision, as well as a notification indicating the date and time of receipt of the result of the public service.
16. In the case of treatment of the applicant through the portal of the service provider on the day of documents acceptance, checks completeness of submitted documents, and in the case of submission by the applicant of an incomplete package of documents and the documents with expired, prepares a reasoned refusal in further consideration of the application and shall give notice to the personal account of the applicant in the form of electronic document signed by electronic digital signature (further – EDS) of the head of the service provider.
17. When the service recipient provides a full set of documents, the service provider's Manager determines the responsible contractor on the day of receiving the documents.
The responsible executor of the service provider within 1 (one) business day from the moment of acceptance of the application verifies the authenticity of documents submitted by the service recipient for receiving a public service, and (or) information contained in them.
Responsible executor of the service provider enter information from the application into the information system, keep a registration record in the book of issuing certificates of a tractor driver in the form according to Annex 6 to these Rules, and formalize the result of providing a public service – a certificate or a reasoned response to a refusal to provide a public service in the form according to Annex 7 to these Rules.
The result of rendering a public service is issued to the service recipient through the service provider's office.
Certificates of service recipients are issued under their personal signature in the book of issuing certificates of a tractor driver, upon presentation of an identity document.
If the service recipient applies through the portal, the responsible executor sends the service recipient a notification of the readiness of the tractor driver's license in accordance with Annex 8 to these Rules, or a reasoned response on refusal to provide public services in the form of an electronic document signed by the EDS of the head of the service provider.
18. the Total term of rendering a public service is 2 (two) working days.
19. for the provision of public services, the service recipient pays to the budget the state duty established in accordance with subparagraph 9) of article 615 of the Code of the Republic of Kazakhstan dated December 25, 2017 "on taxes and other mandatory payments to the budget" (Tax Code).
20. The grounds for refusal to provide a public service are:
1) establishing authenticity of documents submitted by a service recipient to obtain public service, and (or) the information contained in them;
2) the mismatch of the applicant and (or) presented information needed for rendering of the state service, the requirements of these Regulations;
3) in respect of the applicant has entered into legal force court decision on the basis of which the applicant is deprived of special rights associated with obtaining public services.
21. the service Provider ensures that information about the stage of rendering the public service is entered in the information system for monitoring the provision of public services.
Information interaction of the portal and information systems is carried out in accordance with article 43 of the Law of the Republic of Kazakhstan dated November 24, 2015 "on Informatization".
22. Registration and issuance of a certificate is carried out at the permanent registered place of residence or place of temporary stay (if there is a temporary residence permit), and to foreign citizens registered with the internal Affairs bodies – at the place of their stay.
23. the Series and numbers of issued certificates are entered in ascending order in the book of receipts and expenditures of strict reporting forms in accordance with Annex 9 to these Rules.
24. The certificate is issued for a period of ten years (about which the corresponding entries are made in the columns " Valid until...."), according to upon expiration of which it is subject to replacement in accordance with the procedure established by these Rules.
25. When issuing a certificate to persons who have limitations in the terms of re-certification established by medical commissions, the column "for special marks" is marked "Medical certificate is mandatory".
26. Marks in the columns of categories of machines, for the management of which the certificate is issued, are made with a stamp "Allowed". A stamp with a diagonal stripe is placed in the columns for other categories of vehicles that have not been issued a permit to operate.
27. When obtaining a permit for the right to drive vehicles of another category, the certificate is replaced with a new one, with a mark placed on the former certificate.
28. replacement of the certificate is carried out in the following cases:
1) changes in the surname, first name, patronymic (if any);
2) unsuitability for use;
3) expiration of the validity period (10 (ten) years);
4) at the request of the service recipient.
Replacement of the certificate is made on the basis of the list of documents specified in paragraph 8 Of the standard of public service, with the presentation of the previously issued certificate, and when changing the surname, first name, patronymic (if available), a document confirming the change of personal information.
29. When replacing an old-style certificate, the permitting categories are transferred to the new certificate and put down in the following order:
1) category "A", "B", "B", "G", "D", "E" in the certificate of the old sample correspond to the categories "A", "B", "B", "G", "D" in the new certificate;
2) certificate class 3 corresponds to the identity categories "A", "b", "G" new sample;
3) the identity 2 class corresponds to the certificate with a category "A", "B", "B", "G" new sample;
4) certification 1 class corresponds to the certificate with a category "A", "B", "B", "G", "D" new sample;
5) the identity of the K-701 "Kirovets" matches the identity of the class B new sample;
6) the identity of the mechanic of agriculture indicating the specialty "combiner" corresponds to the ID in the "G" of the new sample;
7) the identity of the mechanic of agriculture indicating the specialty "tractor driver" matches the identity of the sample with the categories "A", "b".
In the presentation for the replacement card the old model, categories which are not covered by this paragraph of this regulation, the replacement is carried out with the transport and affixing only relevant categories description category ID new sample.
30. When replacing the certificate in the newly issued certificate, the series, number and date of issue of the former certificate are entered in the column "for special marks".
31. If your ID card is lost, a new ID with the "Duplicate" mark is issued:
1) within 2 (two) working days from the moment of registration documents of the applicant – persons registered by place of residence, on the basis of the documents referred to in paragraph 8 of the Standard of the state service;
2) within 10 (ten) working days from the moment of registration documents of the applicant – in the absence of information on the issue of identity at the place of treatment of service recipienton the basis of the book entry issuance of the certificates of the tractor operator-the machinist the service providerwho issued the ID.
Clarification of the record of the book of issuing certificates of a tractor driver is carried out by the service provider by sending a corresponding request to the service providerwho issued the certificate.
32. Before issuing, replacing and restoring lost certificates, the service provider checks the service recipient on the information resources of the Committee on legal statistics and special records of the General Prosecutor's office of the Republic of Kazakhstan.
33. Exchange of foreign citizens and stateless persons identity is made within 2 (two) working days from the date of receipt of the documents on the basis of representation to the service provider of original certificates and their certified translation into the state or Russian languages, of the document proving the identity (the original is returned after verification) registered in internal Affairs bodies, payment of state duty for issuance of a license.
Atthe same time, a certificate isissued for the right to drive categories of vehicles that were authorized in the national certificate and meet the requirements of paragraph 8 of these Regulations, for the duration of entry documents. The national certificate is kept by the service provider and returned to the service recipient upon his application in any form and after delivery of the previously issued certificate of the Republic of Kazakhstan within 1 (one) working day.
34. In the absence of national identity cards for foreign citizens and stateless persons, the certificate of the Republic of Kazakhstan is issued to them on a General basis, if the period of their stay in the Republic of Kazakhstan exceeds 6 (six) months.
35. In the book of accounting for receipt and expenditure of strict reporting forms, enter data on receipt and expenditure of certificate forms to comply with strict reporting.
36. The local Executive bodies of oblasts, cities of Republican significance, the capital, districts and cities of regional significance provide forms of identification and consumable materials.
37. Damaged forms, consumables that served as the basis for issuing and replacing certificates, are disposed of annually by means and methods that exclude the possibility of their reuse, and a corresponding report is drawn up.
They are disposed of in the same order:
1) newly found certificates, instead of which new ones were issued;
2) not in demand after the expiration of 2 (two) years after the end of the term of imprisonment, a note is made in the book of issuing certificates of a tractor driver.
38. The materials that served as the basis for issuing and replacing certificates (applications, old certificates, documents on payment of fees, copies of certificates of completion of training courses) are filed in separate files, and the service provider ensures their availability for 3 (three) years, then, after the expiration of this period, destroyedby Commission . Also by the service provider for 10 (ten) years, copies of training certificates and diplomas confirming qualification in the specialty "tractor driver of agricultural production" are provided, for 60 (sixty) years-the availability of books for issuing certificates of a tractor driver after their completion. Certificates that have been issued in lieu of new ones are filed in the files with the stamp "Cancelled"affixed to them.
39. Certificates of persons deprived of the right to drive vehicles in accordance with the procedure established by law are transferred to the service provider of the corresponding administrative-territorial unit.
Chapter 3. Procedure for appealing decisions, actions (omissions) of Central state bodies, service providers and (or) their officials on the provision of public services
- Complaint about a decision, action (omission) service provider in the provision of public services is submitted to the head of the service provider, the authorized body in the field of agro-industrial complex (further – authorized body), the Agency responsible for assessing and monitoring the quality of public services.
41. The complaint of the service recipient in accordance with paragraph 2 of article 25 of the Law is subject to review:
by the service provider, the authorized body – within 5 (five) working days from the date of its registration;
by the authorized body for assessment and control of the quality of public services – within 15 (fifteen) working days from the date of its registration.
42. The term of consideration of the complaint by the service provider, the authorized body, the authorized body for assessment and control of the quality of public services in accordance with paragraph 4 of article 25 of the Law is extended for no more than 10 (ten) working days in cases of necessity:
1) conducting an additional investigation or verification based on the complaint or a field visit;
2) obtaining additional information.
In case of extension of the term of consideration of the complaint, the official authorized to consider complaints, within 3 (three) working days from the date of extension of the term of consideration of the complaint, informs in writing (when filing a complaint on paper) or electronically (when filing a complaint in electronic form) to the service recipientwho filed the complaint, about the extension of the time period for consideration of the complaint, indicating the reasons for the extension.
43. In cases of disagreement with the results of rendering a public service, the service recipient applies to the court in accordance with subparagraph 6) of paragraph 1 of article 4 of the Law._____________________________________________________________________

A tractor driver's license is issued through the service provider's office.

Term of rendering

When issuing a tractor driver's license - 2 (two) working days from the moment of registration of the individual's documents (hereinafter referred to as the service recipient).
If your ID card is lost, a new ID with the "Duplicate" mark is issued:
1) within 2 (two) working days from the moment of registration documents of the applicant – persons registered by place of residence, on the basis of the documents referred to in paragraph 8 of this standard of the state service;
2) within 10 (ten) working days from the moment of registration documents of the applicant – in the absence of information on the issue of identity at the place of treatment of service recipienton the basis of the book entry issuance of certificates of the tractor operator-machinist of the service providerissuing the permit.

The state service is provided to the service recipient on a paid basis.
When providing a public service, the service recipient pays a state fee to the budget, which in accordance with subparagraph 9) of article 615 of the Code of the Republic of Kazakhstan dated December 25, 2017 "on taxes and other mandatory payments to the budget (Tax code)" (hereinafter – the Tax code) amounts to:
for issuance of a certificate of the tractor operator-machinist – 0.5 of monthly calculation index.
The state fee is paid in cash and non-cash through second-tier banks and organizations that perform certain types of banking operations.
On the portal, payment of the state fee is made through the payment gateway of the portal of "electronic government" (hereinafter-PSHEP).

Schedule
|
1) provider – Monday through Friday, in accordance with the established schedule of work from 9.00 to 18.30 with a lunch break from 13.00 to 14.30 o'clock, except days off and holidays according to the labor legislation of the Republic of Kazakhstan;
2) portal – around the clock, except for maintenance related repairs.
If the service recipient applies after the end of working hours, on weekends and holidays, according to the labor legislation of the Republic of Kazakhstan, applications are accepted and the results of public service provision are issued on the following working day.
Addresses of places where public services are provided are posted on the:
1) an Internet resource the relevant service provider;
2) the portal.

|
The service recipient submits the following documents:
when contacting the service provider:
1) for driving of a tractor-driver categories "A", "b" and "G":
an application form;
a copy of the certificate of completion of courses of study and examination of the item on training in the specialty "tractor-driver of agricultural production" or a copy of the diploma confirming the qualification of "agricultural mechanization or of a tractor-driver";
document confirming payment of state duty in the budget for issuance of a certificate of a tractor-driver in accordance with the Tax code;
the photo size 3,5 x4,5 cm with white or with a colored background;
2) to obtain the identity of a tractor-driver categories "B" and "D":
an application form;
a copy of the certificate of completion of courses of study and examination of the item on training in the specialty "tractor-driver of agricultural production" or a copy of the diploma confirming the qualification of "agricultural mechanization or of a tractor-driver";
document confirming payment of state duty in the budget for issuance of a certificate of a tractor-driver in accordance with the Tax code;
the photo size 3,5 x4,5 cm with white or with a colored background;
the document confirming labor activity of the applicant under article 35 of the Labour code of the Republic of Kazakhstan from November 23, 2015 (Labor code);
3) to obtain the identity of a tractor-driver with a record of "managing snowmobiles, ATVs allowed":
an application form;
a copy of the certificate of the tractor operator-the driver with the allowing categories "A" and "b" or "B" and "C", or driver's license with a resolution of category "A" or "1"or "B1";
document confirming payment of state duty in the budget for issuance of a certificate of a tractor-driver in accordance with the Tax code;
the photo of size 3.5 x4,5 cm with white or with a colored background;
4) for replacement of the certificate of the tractor operator-the machinist:
an application form;
a document confirming payment of state duty in the budget for issuance of a certificate of a tractor-driver in accordance with the Tax code;
the photo of size 3.5 x4,5 cm with white or with a colored background;
old certificate of the tractor operator-the machinist;
5) for obtaining the duplicate certificates of the tractor operator-the machinist:
application form;
document confirming payment of state duty to the budget for issuing a tractor driver's license in accordance with the Tax code;
photo size of 3. 5x4. 5 centimeters with a white or colored background;
when accessing the portal:
1) to obtain the identity of a tractor-driver "A", "b" and "G":
the statement in the form of an electronic document;
an electronic copy of the certificate of completion of courses of study and examination of the item on training in the specialty "tractor-driver of agricultural production" or an electronic copy of the diploma certifying the qualification of "agricultural mechanization or of a tractor-driver";
photo size 3.5 x4,5 cm with white or colored background (available to the service provider when applying for government services).
To obtain a certificate of a tractor driver of categories "B", "D" additionally:
an electronic copy of the tractor driver's license with authorization marks in the categories "A", " B " or "D", and an electronic copy of the document confirming the employment of the service recipient in accordance with article 35 of the Labor code;
2) when replacing the old tractor driver's license with a new license:
an application in the form of an electronic document;
a photo of 3.5 x4.5centimeters with a white or colored background (provided to the service provider when applying for a public service result);
an old tractor driver's license (issued to the service provider when applying for a public service result);
3) when receiving a duplicate of the tractor driver's license:
an application in the form of an electronic document;
a photo of 3.5 x4.5centimeters with a white or colored background (provided to the service provider when applying for a public service result).
The service provider receives information about the identity document, payment of the state fee (when paying via PSHEP), and a previously issued certificate of a tractor driver услугодательfrom the relevant state information systems via the "electronic government"gateway.

Grounds for refusal to provide a public service, established by the legislation of the Republic of Kazakhstan
|
1) establishing the unreliability of documents submitted by the service recipient for receiving the state service, and (or) the information contained in them;
2) the mismatch of the applicant and (or) presented information needed for rendering of the state service, the requirements established by the Rules of admission examinations and issuing certificates for operators of tractors and manufactured on their basis self-propelled chassis and machinery, self-propelled agricultural, ameliorative and road-building machines and also special machines of the increased passability approved by order of Minister of agriculture of the Republic of Kazakhstan from March 30, 2015 No. 4-3/270 (registered in the Register of the state registration of regulatory legal acts No. 11711);
3) in respect of the applicant has entered into legal force court decision on the basis of which the applicant is deprived of special rights associated with obtaining public services.

The service recipient can receive information about the status of public service provision in remote access mode through a "personal account" on the portal, as well as a Single contact center for public services.
