. Justification of the need to develop a draft law
The head of state of the Republic of Kazakhstan in the article "Social modernization of Kazakhstan: Twenty steps to a society of Universal Labor"instructed to work out the issue of introducing in the Republic of Kazakhstan mandatory insurance of professional liability of medical workers for causing damage to the health of a citizen, not related to the guilty actions of a medical worker.
According to subparagraph 11) of paragraph 1 статьи182Кодекса of the Republic of Kazakhstan from September 18, 2009 "About health of nation and healthcare system"of medical and pharmaceutical workers are entitled to professional liability insurance for damage to health of a citizen in the absence of negligent or careless treatment by a medical professional.
