Internal analysis of corruption risks was carried out in the state institution "Department of Entrepreneurship and Agriculture of the Akimat of Fedorovsky district" according to the Standard Rules for conducting internal analysis of corruption risks approved by the Order of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016 No. 12 and on the basis of the order of the head of the department No. 15 dated June 01, 2022 "On conducting an internal analysis of corruption risks". An internal analysis of corruption risks was conducted in the period from June 1 to June 10, 2022.
Regulatory legal acts affecting the activities of a state institution: the Department of Entrepreneurship and Agriculture of the Akimat of the Fedorovsky district carries out its activities on the basis of the Regulations on the state institution approved by the resolution of the Akimat of the Fedorovsky district dated July 17, 2021 No. 163. The functions of the Department of Entrepreneurship and Agriculture defined by the Regulations comply with regulatory legal acts.
In its activities, the Department of Entrepreneurship and Agriculture is guided by: the Law of the Republic of Kazakhstan dated April 15, 2013 No. 88-V, On Public Services, the Law of the Republic of Kazakhstan dated January 23, 2001 No. 148 On Local Public Administration and Self-Government in the Republic of Kazakhstan, the Law of the Republic of Kazakhstan dated December 4, 2015 No. 434-V ZRK On public Procurement, the Law of the Republic of Kazakhstan dated November 23, 2015 No. 416-V ZRK On Public Service, the Administrative Procedural and Procedural Code of the Republic of Kazakhstan dated June 29, 2020 No. 350-V, the Constitution, Acts of the President, the Government of the Republic of Kazakhstan, resolutions of the Akimat of Kostanay region, resolutions of the Akimat of Fedorovsky district, decisions of the akim of Fedorovsky district and other regulatory legal acts.
According to the results of the analysis of regulatory legal acts regulating the activities of the department: collisions, gaps, discretionary powers and norms that contribute to the commission of corruption offenses have not been identified.
Public procurement in the Department of Entrepreneurship and Agriculture is carried out in full compliance with the public procurement plan by requesting price assumptions and from a single source by directly concluding a contract. The proper conduct of public procurement is ensured. No violations were detected.
In the analyzed period, no inspections were carried out against the state institution.
Personnel management: the staffing of the State Institution "Department of Entrepreneurship and Agriculture of the Akimat of the Fedorovsky district" is 7 units. For the period of the analysis, the department is not fully staffed, there are two vacancies for the head of the business sector and the chief specialist in animal husbandry. There are no factors of dismissal, demotion for negative reasons.
The affiliation of the hired employees, as well as the conflict of interests were not revealed.
The job descriptions of civil servants fully reflect their official rights and duties, there are no facts of duplication of duties of employees.
The provision of vacations to employees of the department is carried out in accordance with the legislation of the Republic of Kazakhstan. There are no facts of awarding employees who have not received a disciplinary penalty.
During the analyzed period, there were no facts of bringing employees of the State Institution to responsibility for committing corruption offenses, as well as offenses discrediting the public service.
Public services are provided in accordance with the Law of the Republic of Kazakhstan dated April 15, 2013 No. 88-V "On Public Services". In accordance with the standards, the state institution "Department of Entrepreneurship and Agriculture of the Akimat of the Fedorovsky district" provides 4 types of public services:
1) "Issuance of certificates for the right to drive tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road-building machines and mechanisms, as well as special high-terrain vehicles".
2) "Issuance of a registration document (duplicate) and a state license plate for tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road construction machines, as well as special cross-country vehicles."
3) "State registration of the pledge of tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road construction machines, as well as special cross-country vehicles".
4) "Conducting an annual technical inspection of tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road construction machines, as well as special cross-country vehicles."
In accordance with the standards of public services specified above. For three public services, in addition to "State registration of the pledge of tractors and self-propelled chassis and mechanisms made on their basis, self-propelled agricultural, reclamation and road construction machines, as well as special cross-country vehicles", service recipients have the opportunity to submit applications and receive results through the office of the service provider, which is a corruption risk, since direct contact is carried out the service recipient and the service provider.
As of June 1, 2022, 728 public services were provided, of which 23 were provided through the PSC, 705 through the e–government web portal.
There were no complaints or appeals regarding the provision of public services.
To inform the public about the procedure for providing services, an information stand has been designed, on which a helpline is placed – 21-8-76, according to which citizens can appeal against illegal actions of employees, a book of comments and suggestions, a schedule for the reception of citizens and representatives of legal entities.
There are no control functions.
Publications in the mass media: there are no facts of negative publications regarding employees of the Department of Entrepreneurship and Agriculture.
Appeals of individuals and legal entities are considered within the time limits established by law. As of June 1, 2022, 46 appeals were received, all were considered on time.
There were no acts of prosecutorial supervision.
According to the results of the internal analysis of corruption risks in the activities of the State Institution "Department of Entrepreneurship and Agriculture of the Akimat of the Fedorovsky district", three corruption risks were identified in the provision of public services, since it is possible to submit documents through the office of the department, where the service recipient and the service provider are in direct contact.
