Analytical report on the internal analysis of corruption risks in the State Institution "Department of Housing and Communal Services, Passenger Transport and highways of the Fedorovsky district"
On the basis of the order of the acting head of the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of the Fedorovsky district" dated 03.03.2022 No. 11 "On conducting an internal analysis of corruption risks in the activities of the state institution "Department of Housing and Communal Services, Passenger Transport and Highways of the Fedorovsky district", an internal analysis of corruption risks was conducted.
The Department of Housing and Communal Services, Passenger Transport and Highways of the Fedorovsky district carries out its activities on the basis of the Regulations on the state institution approved by the resolution of the Akimat of the Fedorovsky district dated 17. 05. 2022 No. 99. The functions of the Department defined in the Regulation correspond to regulatory legal acts.
The main regulatory legal acts that the Department is guided by in its activities are: the Constitution, acts of the President, the Government of the Republic of Kazakhstan, resolutions of the Akimat of Kostanay region, decisions of the Akim of Kostanay region, Resolutions of the Akimat of Fedorovsky district, Decisions of the Akim Fedorovsky District, other regulatory legal acts, On Approval of the Rules for Subsidizing Losses of Carriers Associated with the Implementation of Socially Significant Passenger Transportation at the Expense of Budgetary Funds, On approval of the Rules for the placement of outdoor (visual) advertising objects in the right-of-way of public highways of international, republican, regional and district significance, On approval of the Rules for the Provision of public services "Issuance of permits for cutting down trees", On approval of the Rules for registration of citizens of the Republic of Kazakhstan in Need of housing from the state housing fund or housing, leased by the local executive body in a private housing fund, On approval of the Rules for the Privatization of Housing from the Public Housing Fund, Rules for obtaining by energy-producing, energy-transmitting organizations a passport of readiness to work in the autumn-winter period, the Law of the Republic of Kazakhstan "On Public Service", On Public Procurement, On Combating Corruption, On Local Public Administration and Self-Government in the Republic of Kazakhstan, On state Property, On Legal Acts, On Elections in the Republic of Kazakhstan, on Mobilization Training and mobilization, On advocacy, On mass media, On access to information, On Highways, On housing relations, Budget Code, Land Code, On taxes and other mandatory payments to the budget, On the approval of Accounting Rules, the Labor Code, the Ethical Code of Civil Servants of the Republic of Kazakhstan (Rules of Official Ethics of Civil Servants), as well as Regulations.
Based on the results of the analysis of regulatory legal acts regulating the activities of the Department: collisions, gaps, and discretionary norms have not been identified. The presence of functions that have signs of public services has not been revealed.
Personnel management.
The staffing of the Department is 4 units (head of department, 3 – chief specialist).
There are no vacancies in the Department for the period of the analysis. There were no facts of dismissal, demotion of employees in the covered period of 2022.
The affiliation of the hired employees, as well as the conflict of interests were not revealed.
The job descriptions of civil servants of the Department fully reflect their official rights and duties, there are no facts of duplication of duties of employees.
The provision of vacations to employees of the department is carried out in accordance with the approved schedule and strictly in accordance with the law on public Service and the Labor Code of the Republic of Kazakhstan.
Bonuses for employees are carried out in accordance with the legislation of the Republic of Kazakhstan. During the analyzed period, employee bonuses were not carried out.
During the analyzed period, there were no facts of bringing employees of the Department to responsibility for committing corruption offenses, as well as misdemeanors discrediting the public service.
Provision of public services.
The Department provides eight types of public services:
- "Coordination of the placement of outdoor (visual) advertising objects in the right-of-way of public roads of regional and district significance";
-"Issuance of a passport of readiness for energy–producing and energy-transmitting organizations to work in the autumn - winter period";
-"Registration and priority, as well as the adoption by local executive bodies of a decision on the provision of housing to citizens in need of housing from the state housing fund or housing rented by the local executive body in a private housing fund."
-"Privatization of housing from the public housing stock";
- "Issuance of a permit for cutting down trees";
-"Registration of dangerous technical devices";
-"Subsidizing at the expense of budgetary funds the losses of carriers associated with the implementation of socially significant passenger transportation";
- "Issuance of housing certificates".
In order to receive the state service "Issuance of housing certificates", the applicant submits an application to the Administrator's office, which is a corruption risk since the service recipient and the service provider are in direct contact.
To inform the public about the procedure for the provision of services, an information stand has been designed, which contains the current Standards and Regulations for public services provided by the Department, a helpline number, an approved schedule for personal reception of citizens and representatives of legal entities by the head of the Department.
The results of inspections carried out by state bodies in relation to the State Institution "Department of Housing and Communal Services, Passenger Transport and highways of the Fedorovsky district".
No checks were carried out in the analyzed period.

In the analyzed period, the acts of the prosecutor's response were not received.
2). Claim and claim activity
In the analyzed period, the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of the Fedorovsky district" participated in court sessions:
- as a plaintiff to "Kostanai Zholdary" LLP on the issue of warranty obligations elimination of defects on a/d of district significance;
- as a plaintiff to SK LIDER PLUS LLP, which is declared bankrupt, the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of the Fedorovsky district" is subject to inclusion in the register of creditors' claims as part of the 6th queue.

Results of consideration of physical appeals: explained – 4, legal appeals - 5.
There were no requests for a personal reception of the head of the Department. There were no complaints in the analyzed period.
4). Publications in the mass media.
There are no facts of negative publications in the media regarding the employees of the Department.
According to the results of the analysis, 1 corruption risk was identified for the implementation of the state service "Issuance of housing certificates" where the applicant submits a package of documents to the office of the Administration, thereby there is a direct contact between the service recipient and the service provider, which can lead to a corruption risk.
