"The office of the akim of the Fedorovsky district"
Internal analysis of corruption risks was carried out in the state institution "Office of Akim of Fedorovsky district" according to the Standard Rules for Internal Analysis of Corruption Risks approved by Order No. 12 of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated October 19, 2016 and based on the order of the Head of the Office of Akim of Fedorovsky district dated March 10, 2022 "On conducting an internal analysis of corruption risks in the activities of the state institution "Akim's Office of the Fedorovsky district". The internal analysis of corruption risks was carried out in the period from June 1 to June 10, 2022.
Regulatory legal acts affecting the activities of a state institution: the office of the akim of the Fedorovsky district carries out its activities on the basis of the Regulations on the state institution approved by the resolution of the Akimat of the Fedorovsky district dated December 21, 2021 No. 299. The functions of the akim's office defined by the Regulation correspond to regulatory legal acts.
In its activities, the Akim's office is guided by: the Constitution, Laws, acts of the President, the Government of the Republic of Kazakhstan, resolutions of the Akimat of Kostanay region, decisions of the Akim of Kostanay region, resolutions of the akimat of Fedorovsky district, decisions of the akim of Fedorovsky district and other regulatory legal acts.
According to the results of the analysis of regulatory legal acts regulating the activities of the akim's office: collisions, gaps, discretionary powers and norms that contribute to the commission of corruption offenses have not been identified.
Public procurement in the akim's office is carried out in full compliance with the public procurement plan by requesting price offers and from one source by directly concluding a contract. The proper conduct of public procurement is ensured. No violations were detected.
Information on inspections previously carried out by state bodies in relation to the state institution of the State Institution "Akim's Office of the Fedorovsky district": in the analyzed period, 2 inspections were carried out:
1) from February 8-28, 2022, preventive control and supervision of the state of civil defense was carried out - the state institution "Department of Emergency Situations of Kostanay region of the Ministry of Emergency Situations of the Republic of Kazakhstan".
2) from February 14 to March 3, 2022 – checking the state of fire safety - republican state institution "Department for Emergency Situations of the Fedorovsky district of the Department for Emergency Situations of the Kostanay region of the Ministry of Emergency Situations of the Republic of Kazakhstan";
Personnel management: the staffing of the State Institution "Akim's Office of the Fedorovsky district" is 24 units. For the period of the analysis, the akim's office is not fully staffed, there is one vacancy for the secretary for juvenile Affairs and protection of their rights at the akimat of the Fedorovsky district. There are no facts of dismissal or demotion of employees for negative reasons.
The affiliation of the hired employees, as well as the conflict of interests were not revealed.
The job descriptions of civil servants fully reflect their official rights and duties, there are no facts of duplication of duties of employees.
The provision of vacations to employees of the department is carried out strictly in accordance with the law on public Service and the Labor Code of the Republic of Kazakhstan.
Bonuses for employees are carried out in accordance with the legislation of the Republic of Kazakhstan. There are no facts of awarding employees who have not received a disciplinary penalty.
During the analyzed period, there were no facts of bringing employees of the State Institution to responsibility for committing corruption offenses, as well as misconduct discrediting the public service.
During the analysis, a corruption risk was identified: when the personnel service specialists receive documents on purpose, candidates are in direct contact with employees of a state institution.
Provision of public services: the internal control service for the quality of public services, their monitoring and information technology collects reports from the departments of the Akimat on the activities of the state body for the provision of public services for the past month according to approved forms. During the analyzed period, 29090 public services were provided by state institutions of the district, of which 370 services (1.3%) were provided through the PSC, 28407 services (97.7%) through the e-government web portal, 313 services (1%) through local executive bodies.
Public services are provided in accordance with the Law of the Republic of Kazakhstan dated April 15, 2013 No. 88-V "On Public Services", as well as the Rules for the provision of public services: in the field of civil registration and military registration.
The state institution "Akim's Office of the Fedorovsky district" provides 8 types of public services in the field of civil registration:
1) "Registration of the change of name, patronymic, surname, including the introduction of changes, additions and corrections to the civil status records";
2) "Registration of death, including amendments, additions and corrections to the civil status records";
3) "Restoration of civil status records";
4) "Issuance of repeated certificates or certificates of registration of acts of civil status";
5) "Registration of marriage (matrimony), including amendments, additions and corrections to the civil status records"
6) "Registration of the dissolution of marriage (matrimony), including amendments, additions and corrections to the civil status records";
7) "Registration of the birth of a child, including amendments, additions and corrections to the civil status records";
8) "Cancellation of civil status records".
and 2 state services in the field of military accounting:
"Granting a deferral from conscription for military service";
"The release of citizens from conscription for military service."
During the analyzed period, 487 public services were provided, of which 243 services (49.9%) were provided through the PSC, 226 services (46.4%) through the e–government web portal, 18 services (3.7%) through local executive bodies.
There were no complaints about the provision of public services.
Publications in the mass media: there are no facts of negative publications regarding the staff of the akim's office.
Appeals of individuals and legal entities received by the office of the akim of the Fedorovsky district: as of June 1, 2022, 94 appeals of individuals and legal entities were received, of which: 24 - applications, others – 68, complaints - 2. The results of consideration of appeals: a favorable administrative act was issued -7, rejected - 0, explained – 56, terminated – 1, written off without consideration – 1, under consideration -1, redirected - 28. The largest number of appeals are related to the provision of housing, housing and communal services, agriculture, land use, labor and employment of the population, etc.
33 people were accepted at the personal reception of the akim of the Fedorovsky district, 11 people were accepted by the deputy akim of the district. All appeals have been reviewed and appropriate responses have been given to them.
There were no repeated requests. Violations of the terms of consideration of appeals were not allowed.
As a result of the analysis, 3 "hidden" functions carried out by the district akim's office were revealed:
1) appeals on issues of registration of guardianship (guardianship) over adults, incapacitated persons with disabilities;
2) appeals for the extension of the lease term for a land plot of regional significance for farming;
3) provision of housing from the housing state fund.
The acts of the prosecutor's response to the state institution "The Office of the Akim of the Fedorovsky district" were not received.
8. Judicial acts: in total, during the reporting period, the Fedorovsky District Court received 29 statements of claim from citizens to the akim of the Fedorovsky district, of which: 4 on the recognition of property rights under the acquisition statute of limitations, 6 on the restoration of the term for accepting inheritance, 2 on the recognition of decisions illegal, 3 on the establishment of the recognition of paternity, on the establishment of the fact of kinship relations - 2, on the establishment of the fact of death – 1, on the recognition of the transaction as valid – 1, on the recognition of funds as extortionate property and their transfer to communal ownership - 10. The court's decision satisfied 28 claims.
In total, the akim of the Fedorovsky district filed 31 lawsuits against citizens, of which: 1 on the return of a land plot to communal ownership, 30 on the recognition of inheritance as extortionate property and transfer to communal ownership.
According to the results of the internal analysis of corruption risks in the activities of the State Institution "Akim's Office of the Fedorovsky district", corruption risks were identified: one in the personnel service when accepting documents on purpose and three risks when accepting applications to a state body ("hidden" functions).
