General provisions
The state institution "Department of veterinary medicine of the Kostanay region akimat" is a state body of the Republic of Kazakhstan that provides guidance in the field of veterinary medicine in the territory of the Kostanay region.
The founder of the state institution "veterinary Department of Kostanay region akimat" is the akimat of Kostanay region.
2. the State institution "veterinary Department of the akimat of Kostanay region" has subordinate organizations in accordance with the Annex to this Regulation.
The state institution "veterinary Department of Kostanay region akimat" operates in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as these regulations.
State institution "veterinary Department of Kostanay region akimat" is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan, accounts in the Treasury bodies.
State institution "Management of veterinary science of the akimat of Kostanay region" enters in civil-legal relations from own name.
The state institution "veterinary Department of Kostanay region akimat" has the right to act as a party to civil relations on behalf of the state, if it is authorized to do so in accordance with the legislation.
State institution "Management of veterinary science of the akimat of Kostanay region" on issues of its competence in accordance with legislation makes decisions orders of the head of state institution "Management of veterinary science of the akimat of Kostanay region" and other acts, stipulated by the legislation of the Republic of Kazakhstan.
The structure and staff limit of the state institution "veterinary Department of Kostanay region akimat" is approved in accordance with the current legislation.
9. Location of the legal entity: Republic of Kazakhstan, 110000, Kostanay region, Kostanay city, Gogol street, 75.
The full name of the state body is the state institution "veterinary Department of the Kostanay region akimat".
In the state institution "veterinary Department of Kostanay region akimat", the working time is set from 9.00 am to 18.30 PM daily (except Saturday and Sunday), with a break for rest and food from 13.00 am to 14.30 PM.
Present The regulation is the founding document of the state institution "veterinary Department of the Kostanay region akimat".
Financing of the activities of the state institution "veterinary Department of the akimat of Kostanay region" is carried out from the regional budget.
The state institution "veterinary Department of the akimat of Kostanay region" is prohibited to enter into contractual relations with business entities in order to perform the duties that are the functions of the state institution "veterinary Department of the akimat of Kostanay region".
If the state institution "veterinary Department of the Kostanay region akimat" is granted the right to carry out income-generating activities by legislative acts, then the income received from such activities is sent to the state budget.
Mission, tasks, functions, rights and duties of the state body
The mission of the state institution "veterinary Department of Kostanay region akimat" is to promote the development and improvement of state policy in the field of veterinary medicine.
16. Tasks of the state institution "veterinary Department of Kostanay region akimat»:
protection of animals from diseases and their treatment;
protection of public health from diseases common to animals and humans;
ensuring veterinary and sanitary safety;
protection of the territory of the Republic of Kazakhstan from the introduction and spread of infectious and exotic animal diseases from other States;
control over the safety and quality of veterinary drugs, feed and feed additives;
development and use of tools and methods for diagnostics, control of animal diseases and ensuring veterinary and sanitary safety;
prevention and elimination of environmental pollution when individuals and legal entities carry out activities in the field of veterinary medicine;
development of veterinary science, training and professional development of specialists in the field of veterinary medicine.
17. Functions of the state institution " veterinary Department of Kostanay region akimat»:
1) making proposals to the draft regional budget during its development and its execution in terms of the tasks assigned to the state institution "veterinary Department of the Kostanay region akimat" ;
2) organization of regional seminars and meetings on issues of ensuring veterinary and sanitary safety of the region;
3) organization of public health protection from diseases common to animals and humans, together with the authorized state body in the field of health and implementation of mutual exchange of information; 4) implementation of state policy in the field of veterinary medicine;
5) making decisions on the establishment of a quarantine or restrictive measures on the recommendation of the chief state veterinary and sanitary inspector of the relevant territory in the event of infectious animal diseases in two or more districts located on the territory of the region;
6) making decisions on lifting restrictive measures or quarantine on the recommendation of the chief state veterinary and sanitary inspector of the relevant territory after carrying out a set of veterinary measures to eliminate foci of infectious animal diseases that have occurred in two or more districts located on the territory of this region;
7) licensing of veterinary and sanitary expertise of products and raw materials of animal origin in accordance with the legislation of the Republic of Kazakhstan on permits and notifications;
8) making a decision on dividing the territory into zones in accordance with the procedure established by the authorized body;
9) approval of the plan of veterinary measures to ensure veterinary and sanitary safety on the territory of the relevant administrative-territorial unit in agreement with the authorized body;
10) coordinating the organization and conduct of veterinary measures to ensure veterinary and sanitary safety on the territory of the relevant administrative-territorial unit;
11) implementation of state procurement of services for transportation (delivery) of products (means) and attributes for identification of farm animals, production of veterinary passports;
12) determining the need for products (tools) and attributes for identification of farm animals and transmitting information to the processing center;
13) organization of storage, transportation (delivery) of veterinary drugs for the prevention of particularly dangerous animal diseases, with the exception of the national stock of veterinary drugs;
14) organization of maintaining a database on identification of farm animals;
15) receiving notifications from individuals and legal entities on the beginning or termination of business activities in the field of veterinary medicine, as well as maintaining the state electronic register of permits and notifications in accordance with the Law of the Republic of Kazakhstan dated may 16, 2014 "on permits and notifications»;
16) organization of construction and reconstruction of animal burial grounds (biothermal pits) and ensuring their maintenance;
17) organize the collection and compilation of data (information) on animal burial grounds (biothermal pits) for inclusion in the register of animal burial grounds (biothermal pits);
18) conducts surveys of epizootic foci in case of their occurrence;
19) submitting to the local representative body of the region for approval of rules for keeping animals, rules for keeping and walking dogs and cats, rules for trapping and destroying stray dogs and cats, proposals for establishing the boundaries of sanitary zones for keeping animals;
20) issue certificates of epizootological examination;
21) organization and provision of information to interested persons about the veterinary activities being carried out;
22) organization of state commissions for the commissioning of production facilities that are engaged in the cultivation of animals, harvesting (slaughter), storage, processing and sale of animals, products and raw materials of animal origin, as well as organizations for the production, storage and sale of veterinary drugs, feed and feed additives;
23) neutralization (decontamination) and processing without removing animals, products and raw materials of animal origin that are dangerous to animal and human health;
24) compensation to owners of the cost of animals, products and raw materials of animal origin that are dangerous to animal and human health that have been neutralized (decontaminated) and processed without withdrawal;
25) organization of sanitary slaughter of sick animals;
26) organization of trapping and destruction of stray dogs and cats;
27) carries out a summary, analysis of veterinary accounting and reporting and their submission to the authorized body;
28) carries out state procurement of veterinary drugs for the prevention and diagnosis of enzootic animal diseases, services for their prevention and diagnosis, organization of storage and transportation (delivery) of veterinary drugs, carrying out veterinary measures for the prevention and diagnosis of enzootic animal diseases;
29) ensures the implementation of veterinary measures for the prevention, sampling of biological material and their delivery for the diagnosis of particularly dangerous animal diseases according to the list approved by the authorized body, as well as enzootic and other animal diseases;
30) organizes and conducts educational work among the population on veterinary issues;
31) organizes activities for the identification of farm animals;
32) participates in state commissions for the commissioning of production facilities engaged in the cultivation of animals, harvesting (slaughter), storage, processing and sale of animals, products and raw materials of animal origin, as well as organizations for the production, storage and sale of veterinary drugs, feed and feed additives;
33) develops a list of enzootic animal diseases, prevention and diagnostics of which are carried out at the expense of budget funds;
34) exercise in the interests of local government other powers assigned to local Executive bodies by the legislation of the Republic of Kazakhstan.
18. Rights and obligations:
1) to carry out its activities in cooperation with other bodies of Executive power and local self-government;
2) receive in accordance with the procedure established by law (on the basis of requests) the necessary information materials from local government bodies and other organizations within their competence;
3) conclude contracts with legal entities and individuals, acquire property and personal non-property rights, represent their interests in state bodies and organizations in accordance with the current legislation of the Republic of Kazakhstan;
4) make proposals to draft regulatory legal acts adopted by the akim and akimat of the region on issues within the competence of the state institution " veterinary Department of the akimat of Kostanay region»;
5) involve specialists from other organizations, departments and agencies to participate in the development and implementation of programs on ensuring veterinary and sanitary safety in the region;
6) make a proposal to establish emergency anti-epizootic commissions in accordance with the established procedure;
7) other rights and obligations in accordance with the current legislation of the Republic of Kazakhstan.
Organization of the state body's activities
The management of a state institution "Management of veterinary science of the akimat of Kostanay region" is the first head, who bears personal responsibility for performance assigned to state institution "Management of veterinary science of the akimat of Kostanay region" objectives and performance of its functions,and shall be personally responsible for failing to combat corruption.
20. The first head of the state institution "veterinary Department of the Kostanay region akimat" is appointed and dismissed by the akim of the Kostanay region in accordance with the legislation of the Republic of Kazakhstan.
21. The first head of the state institution "veterinary Department of Kostanay region akimat" has deputies who are appointed and dismissed in accordance with the legislation of the Republic of Kazakhstan.
22. Powers of the first head of the state institution "veterinary Department of Kostanay region akimat":
1) defines the responsibilities of senior employees of the state institution "veterinary Department of Kostanay region akimat" (heads of departments);
2) appoint and dismiss employees of the state institution "veterinary Department of the Kostanay region akimat", heads, Deputy heads and chief accountants of enterprises specified in the Annex to this Regulation, in accordance with the current legislation;
3) within its competence, gives instructions that are mandatory for all employees of the state institution " veterinary Department of the Kostanay region akimat»;
4) represents the state institution "veterinary Department of the Kostanay region akimat" in state bodies and organizations in accordance with the current legislation of the Republic of Kazakhstan;
5) approve the structure and staffing of the state institution "veterinary Department of the Kostanay region akimat";
6) make joint decisions with other departments and agencies.
The powers of the first head of the state institution "veterinary Department of Kostanay region akimat" during his absence are performed by the person who replaces him in accordance with the current legislation.
23. The first Manager determines the powers of his deputies in accordance with current legislation.
Property of a state body
The state institution "veterinary Department of the akimat of Kostanay region" may have separate property on the right of operational management in cases stipulated by law.
The property of the state institution "veterinary Department of the Kostanay region akimat" is formed at the expense of property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
25. the Property assigned to the state institution "veterinary Department of the akimat of Kostanay region" belongs to communal property.
26. State institution "Management of veterinary science of the akimat of Kostanay region" has no right to alienate or otherwise dispose of the property fixed to it and the property acquired with funds provided by the financing plan, unless otherwise provided by law.
Reorganization and liquidation of a state body
Reorganization and liquidation of the state institution "veterinary Department of Kostanay region akimat" is carried out in accordance with the legislation of the Republic of Kazakhstan.
