In accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services", I ORDER:
1. Approve:
1) Rules for the provision of public services "Issuance of certificates of guardianship and guardianship" in accordance with Annex 1 to this order;
2) Rules for the provision of public services "Issuance of certificates for the disposal of property of minors" in accordance with Annex 2 to this order;
3) Rules for the provision of public services "Establishment of guardianship or guardianship over an orphan child (orphans) and a child (children) left without parental care" in accordance with Annex 3 to this order;
4) Rules for the provision of public services "Assignment of benefits to guardians or trustees for the maintenance of an orphan child (orphans) and a child (children) left without parental care" in accordance with Annex 4 to this order;
5) Rules for the provision of public services "Transfer of a child (children) to foster care and the purpose of payment of funds for the maintenance of a child (children) transferred to foster carers" according to Annex 5 to this order;
6) Rules for the provision of public services "Transfer of a child (children) to foster care and the purpose of payment of funds for their maintenance" in accordance with Annex 6 to this order;
7) Rules for the provision of public services "Appointment of a one-time cash payment in connection with the adoption of an orphan child and (or) a child left without parental care" in accordance with Annex 7 to this order;
8) Rules for the provision of public services "Granting permission to visit a child to parents deprived of parental rights that do not have a negative impact on the child" in accordance with Annex 8 to this order;
9) Rules for the provision of public services "Provision of free transportation to educational organizations and back home to children living in remote rural areas" according to Annex 9 to this order;
10) Rules for the provision of public services "Provision of free and reduced-price meals to certain categories of students and pupils in secondary schools" in accordance with Annex 10 to this order;
11) Rules for the provision of public services "Acceptance of documents and issuance of directions for the provision of recreation in suburban and school camps to certain categories of students and pupils of state educational institutions" in accordance with Annex 11 to this order.
12) Rules for the provision of public services "Issuance of a decision of the guardianship and guardianship authority on taking into account the opinion of a child who has reached the age of ten" in accordance with Annex 12 to this order.
2. To recognize as invalid some orders of the Ministry of Education and Science of the Republic of Kazakhstan in accordance with Annex 13 to this order.
3. The Committee for the Protection of Children's Rights of the Ministry of Education and Science of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on the Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;
3) within ten working days after the state registration of this order, submission to the Legal Department of the Ministry of Education and Science of the Republic of Kazakhstan of information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.
4. Control over the execution of this order shall be entrusted to the supervising Vice-Minister of Education and Science of the Republic of Kazakhstan.
5. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication, with the exception of paragraphs twelve and twenty-four of paragraph 8 and paragraph fourteen of paragraph 9 of the state service standard "Establishment of guardianship or guardianship over an orphan child (orphans) and a child (children) left without parental care", paragraph eight of paragraph 8 and paragraph fourteen of paragraph 9 of the state service standard "Transfer of a child (children) to foster care and the purpose of payment of funds for the maintenance of a child (children) transferred to foster caregivers", paragraphs nine and eighteen of paragraph 8 and paragraph fourteen of paragraph 9 of the state service standard "Transfer of a child (children) to foster care and the purpose of payment of funds for their maintenance" which are effective from July 1, 2020.

Rules for the provision of public services "Issuance of certificates of guardianship and guardianship"
Chapter 1. General provisions
1. These Rules for the provision of public services "Issuance of certificates of guardianship and guardianship" (hereinafter – the Rules) are developed in accordance with subparagraph 1) of Article 10 of the Law of the Republic of Kazakhstan dated April 15, 2013 "On Public Services" (hereinafter - the Law) and determine the procedure for issuing certificates of guardianship and guardianship to guardians or trustees.
2. The following concepts are used in these Rules:
1) public service standard – a list of basic requirements for the provision of public services, including the characteristics of the process, form, content and result of the provision, as well as other information, taking into account the specifics of the provision of public services;
2) e-government web portal www.egov .kz is an information system that represents a single window of access to all consolidated government information, including the regulatory framework, and to public services, services for issuing technical conditions for connection to the networks of natural monopoly entities and services of quasi-public sector entities provided in electronic form (hereinafter referred to as the portal);
3) electronic digital signature – a set of electronic digital symbols created by means of an electronic digital signature and confirming the authenticity of an electronic document, its belonging and the immutability of the content (hereinafter referred to as EDS).
Chapter 2. The procedure for the provision of public services
3. To receive the state service "Issuance of certificates of Guardianship and Guardianship" (hereinafter referred to as the state service), individuals (hereinafter referred to as the service recipient) through the portal submit an application in the form, according to Appendix 1 to these Rules, signed by the service recipient's EDS or certified with a one-time password, in case of registration and connection of the service recipient's subscriber number provided by the mobile operator to the portal account.
The public service is provided in accordance with the standard of public services "Issuance of certificates of guardianship and guardianship" in accordance with Annex 2 to these Rules.
4. Information about identity documents, a child's birth certificate (in the absence of information in the information system "Registry Office"), local executive bodies of the cities of Nur-Sultan, Almaty and Shymkent, districts and cities of regional significance (hereinafter referred to as the service provider) receive from the relevant state information systems through the gateway of "electronic government".
5. When a service recipient submits an application for the provision of a public service, the status of acceptance of a request for the provision of a public service, as well as a notification, is displayed in the "personal account" of the service recipient.
6. A certificate of guardianship and guardianship is issued in accordance with Annex 3 to these Rules, or a reasoned response on refusal to provide a public service is sent to the "personal account" of the service recipient in the form of an electronic document signed by the EDS of the authorized person of the service provider.
7. The total period for reviewing documents and issuing certificates of guardianship and guardianship or refusal to provide public services is 30 (thirty) minutes.
Chapter 3. Procedure for appealing decisions, actions (inaction) of the service provider and (or) its officials in the process of rendering public services
8. A complaint against the decision, actions (inaction) of the service provider on the provision of public services is submitted to the head of the service provider, to the authorized body for evaluation and quality control of the provision of public services, in accordance with the legislation of the Republic of Kazakhstan.
The complaint of the service recipient received by the service provider who directly rendered the public service, in accordance with paragraph 2 of Article 25 of the Law, is subject to consideration within 5 (five) working days from the date of its registration.
The complaint of the service recipient received by the authorized body for the assessment and control of the quality of public services is subject to consideration within 15 (fifteen) working days from the date of its registration.
9. In cases of disagreement with the results of the provision of public services, the service recipient applies to the court in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
