1. General provisions
State institution "Department of housing and communal services, passenger transport and automobile roads of Uzynkol area" (the Department) is the state body of the Republic of Kazakhstan, carrying out management in the sphere of communal services, passenger transport and highways in Uzunkolskiy area in the legal form of companies.
The Department operates in accordance with the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan, acts of the President, Government of the Republic of Kazakhstan and other regulatory legal acts, as well as this Regulation.
The founder of the Department is the state represented by the akimat of Uzunkol district.
The Department is a legal entity in organizational – legal form of state establishment, has seals and stamps with its name in state language, forms of the established sample, and also in accordance with the legislation of the Republic of Kazakhstan the account in bodies of Treasury Committee Ministry of Finance of the Republic of Kazakhstan and banks.
The working mode is established in accordance with the Department's work regulations approved by the chief and should not contradict the current legislation of the Republic of Kazakhstan.
The Department enters into civil relations on its own behalf.
The division has the right to enter into civil relations on behalf of the state, if it is authorized to do so in accordance with the law.
The Department makes decisions on issues of its competence in accordance with the procedure established by law, which are issued by orders of the head of the Department.
The Department's structure and staffing limit are approved in accordance with current legislation.

This Regulation is the founding document of the Department
The Department is funded from the local budget.
The Department is prohibited from entering into contractual relations with business entities in order to perform the duties that are the functions of the Department.
If the Department is granted the right by legislative acts to carry out income-generating activities, then the income received from such activities is sent to the state budget revenue.
2 Mission, main tasks, functions, rights and duties of the state body
15. the Mission of the Department is to promote the development and improvement of state policy in the sphere of housing and communal services, passenger transport and highways.
16. Subject, tasks of the Department
The subject is services for the implementation of state policy at the local level in the field of housing and communal services, passenger transport and highways.
17. the Department's Task is to:
1) implementation of state policy, formation of engineering infrastructure of localities and territories;
2) assistance and participation in the organization of stable functioning of housing and communal services;
3) assistance and participation in the organization operation and monitoring of the housing stock and other infrastructure facilities of various forms of ownership;
18. Functions:
1) Coordination of interaction between the housing and utilities sector and related industries in terms of stable provision of public services to consumers;
2) monitoring and preparing a report on the implementation of state and regional programs on housing and communal services, passenger transport and highways, acts of the President and resolutions of the Government of the Republic of Kazakhstan, and decisions and orders of the district akim on issues of their competence;
3) assistance in the implementation of priority development programs, analysis, adjustments in the field of energy, transport infrastructure, road and housing and communal services of the district;
4) implementation of coordination and control over the work on preparing the enterprises of the district to work in autumn-winter conditions and flood period;
5) implementation of management and control over the implementation of energy saving measures, development of housing and communal services;
6) monitoring the activities of enterprises and economic entities within their competence;
7) ensures the formation of transport infrastructure and communications in localities and territories, promotes and participates in the organization of operation and maintenance of roads and other transport infrastructure objects of various forms of ownership;
8) contributes to the development of a competitive market in the field of maintenance and maintenance of highways;
9) provides high-quality repair work, maintenance and operation of the roadbed.
10) ensures compliance with engineering and technical standards in the construction, repair and maintenance of local roads and road structures;
11) conducts competitions (tenders) for the performance of works in accordance with the current legislation, concludes contracts for their performance;
19. Rights and responsibilities:
The Department has the right to perform the tasks assigned to it:
1) participate in the development of programs for the development of housing and communal services, transport and communication complex, organization of passenger transport, road facilities;
2) act as an administrator of programs (customer) for the management of road activities, on the basis of legislative acts of the Republic of Kazakhstan to conclude contracts (act as a customer) for financing the operation, repair, construction and reconstruction of highways from the budget:
3) submit proposals to the relevant state bodies on changing or canceling the acts adopted by them that hinder the implementation of the strategic program for the development of transport and roads in the district;
4) submit proposals for the consideration of the akim of the district and the district maslikhat to address issues of transport, housing and communal services and transport.
5) to involve specialists of enterprises, organizations, public formations of the district in coordination with their head for conducting inspections and examinations, participation in competitive commissions.
6) make decisions within its competence on the implementation of policies in the field of transport, housing and communal services and road management, which are mandatory for all entities engaged in activities in the field of maintenance and maintenance of roads in the territories of the district.
7) to request and receive information from the relevant state authorities, statistical bodies, organizations, institutions and enterprises within their competence in order to perform the tasks assigned to state institutions.
8) comply with the current legislation of the Republic of Kazakhstan.
9) execute efficiently and on time acts of the President and resolutions of the Government and other Central bodies, as well as decisions and orders of the district akim.
3. Organization of activities of the state body
20. the management of the Department is carried out by the first head, who is personally responsible for the implementation of the tasks assigned to the Department and the implementation of its functions.
21. The first head of the Department is appointed and dismissed in accordance with current legislation.
Powers of the first head of the Department:
1) manages the Department;
2) appoints and dismisses the heads of subordinate institutions of the Department;
3) signs the cost estimates and financial documents, approves the regulations on bonuses and develops the procedure for material incentives for employees of the Department;
4) imposes penalties on employees of the Department, takes measures to influence and eliminate violations of labor discipline.
5) the Manager is responsible for not taking anti-corruption measures.
4. Property of the state body.
22. The property Department is formed at the expense of the property transferred to him by the state and consists of main funds and circulating assets, and also other property which cost is reflected in the balance of state enterprises.
The property of the Department belongs to it on the right of operational management and belongs to the state property.
23. If the Department is granted the right to carry out income-generating activities, the income received from such activities is sent to the state budget revenue.
24. the Department has no right to independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
5. Reorganization and liquidation of the state body.
25. Reorganization and liquidation of the Department is carried out in accordance with the legislation of the Republic of Kazakhstan.
