On amendments and additions to the decision of the Maslikhat of December 11, 2015 No. 468 "On Establishing the Rules of General Water Use on Water bodies of the Kostanay region»
In accordance with subparagraph 1) of Article 38 of the Water Code of the Republic of Kazakhstan dated July 9, 2003, the Kostanay Regional Maslikhat DECIDED:
1. Make the following changes and additions to the decision of the Kostanay regional Maslikhat "On the establishment of Rules for general water use on water bodies of the Kostanay region" dated December 11, 2015 No. 468 (published on February 11, 2016 in the information and legal system "Adilet", registered in the Register of State Registration of Regulatory Legal Acts No. 6157):
in the Rules of general water use on water bodies of Kostanay region, approved by the specified decision:
paragraph 9 should be redrafted:
"9. Surface water bodies of the Republic of Kazakhstan classified as navigable are public waterways, except for cases when their use for these purposes is fully or partially prohibited or they are provided for separate use.
The procedure for classifying water bodies as navigable and the list of navigable waterways shall be carried out in accordance with the rules approved in accordance with paragraph 3 of Article 105 of the Code.»;
paragraph 11 should be redrafted:
"11. In order to protect the life and health of citizens, taking into account the peculiarities of regional conditions, to determine that they are not carried out:
water intake for drinking and household needs from surface and underground water bodies in places that are prohibited by the authorized body in the field of sanitary and epidemiological welfare of the population;
riding on small vessels and other floating vehicles, in places where appropriate prohibiting or warning signs are installed on water bodies.
On dangerous and unequipped areas of reservoirs for recreation and bathing, local executive bodies establish prohibiting and warning signs of safety on reservoirs, in accordance with the requirements of the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated January 19, 2015 No. 34 "On Approval of Safety Rules on Reservoirs" (registered in the Register of State Registration of Regulatory Legal Acts under No. 10335) (hereinafter - the Rules of Safety on Reservoirs).»;
add paragraphs 11-1, 11-2 to read as follows:
«11-1. Determine that swimming is prohibited in unequipped areas of reservoirs, in places where appropriate safety signs are installed on reservoirs.
«11-2. Bathing is allowed if the section of the reservoir is equipped, according to the requirements of the Safety Rules on reservoirs.»;
add paragraph 17-1 to read as follows:
«17-1. Violation of the rules of general water use entails liability in accordance with Article 364 of the Code of the Republic of Kazakhstan of July 5, 2014 "On Administrative Offenses.".
This decision shall enter into force upon the expiration of ten calendar days after the date of its first official publication.
