for participants of the tender for securing fishery reservoirs
and (or) plots of Kostanay region
In accordance with The rules of the competition for securing hunting grounds and fisheries reservoirs and (or) sites and qualification requirements for participants of the competition approved by the order of the Minister of agriculture of the Republic of Kazakhstan dated March 19, 2015 No. 18-04/245 (hereinafter referred to as the Rules), the tender application includes:
Application for participation in the Competition for the consolidation of fishery reservoirs and (or) sites in the form, according to Annex 1 (original);
documents confirming the applicant's compliance with the established qualification requirements for the participants of the Competition;
- for individuals – identity card or passport of a citizen of the Republic of Kazakhstan, documents confirming the right to carry out business activities without forming a legal entity (copy);
- for legal entities – certificate or certificate of state registration (re-registration) of the legal entity (copy);
help of the Bank, branch or branch of a Bank on paper, signed and sealed, which provides services to the participant of Competition about absence of overdue debt on all types of obligations of the participant, to the Bank, the branch or Bank branch (in case the bidder is a client of several banks of the second level of branches or offices as well as foreign Bank, this reference is represented from each of such banks), given out not earlier than thirty calendar days preceding the date of opening of envelopes with competitive application forms (original).
the plan of development of subjects of fisheries, for the entire period of consolidation for each reservoir and (or) site approved by the head of the applicant according to the standard form approved by the order of the Minister of agriculture of the Republic of Kazakhstan dated March 31, 2015 No. 18-04 / 287 (registered in the Register of state registration of regulatory legal acts No. 10890), according to Appendix 2 (original);
- information on the fulfillment of financial and other obligations under the development plans of fisheries entities received from territorial divisions (for individuals or legal entities that were previously assigned to fisheries reservoirs and (or) areas) - original;
a written commitment signed by the applicant's Manager to grant an easement in accordance with subparagraph 11) of paragraph 2 of article 27 of the Law of the Republic of Kazakhstan dated July 9, 2004 No. 593 "on the protection, reproduction and use of wildlife", in accordance with Annex 3 for the implementation of:
- control fishing – to the Agency and (or) its territorial division;
- research fishing – individuals and legal entities;
- Amateur (sports) fishing – to individuals.
Depending on the declared fishery reservoir and (or) site, the following documents are additionally attached to the application:
1) for fishery reservoirs and (or) areas for the purpose of commercial fishing:
- certificate of availability of fixed assets, according to Appendix 4 (original);
- an extract* from the State ship register of the Republic of Kazakhstan and (or) the ship book on registered in the name of the participant of the mining and transport fleet, including small-sized, issued not earlier than one month prior to the date of opening the envelopes with competitive applications (copy).
Note:* if pogliani of the vessel, including small vessel state registration in the ship book and the State ship register of the Republic of Kazakhstan in accordance with paragraphs 5 and 6 of article 16 of the Law of the Republic of Kazakhstan from January 17, 2002 "About merchant shipping" (further – the Law "On merchant shipping") and paragraphs 6 and 6-1 of article 26 of the Law of the Republic of Kazakhstan dated July 6, 2004 "About the inland water transport" (hereinafter – The law "on inland water transport") provides a document (a certificate in any form) confirming that there is no need for state registration of a vessel, including a small vessel;
certificate of seaworthiness of the vessel with an indication of its class or with a classification certificate and (or) a ship's ticket with a note on the passage of the annual technical examination of the vessel for seaworthiness (copy);
address certificate from the place of residence (for individuals);
certificate of registration (re-registration) of legal entities, registration (re-registration) of their branches and representative offices (for legal entities);
for frost-prone reservoirs and (or) areas of local significance for the purpose of commercial fishing:
a certificate of the availability of fixed assets for carrying out fishery reclamation works in accordance with Annex 5 to the tender documentation (hereinafter referred to as the certificate of carrying out reclamation works) (original).
Qualification
requirements for participants of the competition for securing
fishery reservoirs and (or) sites
The following qualification requirement is applied to the participants of the Competition for securing fishery reservoirs and (or) sites::
1) absence of tax arrears of the taxpayer, arrears on mandatory pension contributions, mandatory professional pension contributions and social contributions;
2) no arrears on fisheries development Plans for previous years;
3) there is no overdue debt for all types of obligations of the bidder to the Bank, branch or branch of the Bank.
Depending on the declared fishery reservoir and (or) site, except for the qualification requirements specified in these Qualification requirements, the participants of the Competition must meet the following qualification requirements:
1) for other fishery reservoirs and (or) areas for the purpose of commercial fishing:
- availability of fixed assets on the right of ownership;
- the presence on the right of ownership of the fishing (mining) fleet and fishing gear.
If a participant submits more than one application for two or more fishery reservoirs and (or) plots within the same Competition, the claimed amount of refrigeration capacity, technological equipment, transport, fishing gear, and financial resources is distributed by the participant of the Competition to the claimed fishery reservoirs and (or) plots.
The application is submitted in stitched form, with numbered pages and the last page is certified with a signature and seal (if available).
Individuals or legal entities prepare a separate competitive application for each declared fishery reservoir and (or) site in accordance with the requirements of these Rules and submit it to the address specified in the announcement, in a sealed envelope on which they are indicated:
1) the full name and address of the participant (for the purpose of returning the tender application not opened, if it is recognized as late);
2) address of the Contest organizer;
3) the words "Competition for securing fishery reservoirs and (or) sites".
The deadline for submission of the tender application is January 12, 2021 until 18.30 hours.
Envelopes with a competitive application for participation in the competition, provided after the deadline, will not be accepted.
Envelopes with competitive applications will be opened on January 14, 2021 at 16.00 in the presence of participants of the competition or their representatives at the address: Kostanay, al-Farabi str., 66 (building of the regional akimat), 4th floor-meeting room.
In case of absence or improper execution of documents, in accordance with the requirements of paragraphs 43, 44, 47, 48 and 49 of the Rules, as well as non-compliance of the participant With the qualification requirements, such participant is recognized as not meeting the conditions of the Competition.
The results of the Competition are summed up by the competition Commission within ten working days from the date of opening the envelopes with the competition application.
On the basis of the decision of the akimat of Kostanay region on the consolidation of fishery reservoirs and (or) sites within ten working days, a contract for fisheries management is concluded between the state institution "Department of natural resources and environmental management of the akimat of Kostanay region" and the winner of the Competition.
If the winner of the Competition, after the decision of akimat of the Kostanay region on securing the fisheries of the reservoir and (or) area within the specified period has not signed the agreement on maintenance of fisheries, on the proposal of the organizer of the fisheries pond and (or) the station is assigned to the bidder whose rating is the highest rating after the rating of the winner in accordance with the Protocol on the results of the Competition.
