Regarding the implementation of public procurement by tender with prequalification of bidders
In order to assist in the development and support of domestic producers, a number of changes have been introduced into the current legislation which provides certain advantages for domestic enterprises in terms of the application of an industrial certificate.
So, since July 1 of this year the Order of the First Deputy Prime Minister of the Republic of Kazakhstan of the Minister of Finance of the Republic of Kazakhstan “On approval of the list of goods, works, services for which public procurement is carried out by means of a tender with preliminary qualification” (hereinafter referred to as “the Order”) governing public procurement of light industry goods comes into effect, construction and installation works, design works, furniture products, as well as goods belonging to the categories of software and electronic industry products.
Within the framework of the above Order, the availability of an industrial certificate is planned to be introduced as one of the mandatory conditions for admission to participation in the tender.
In this regard, from July 1 of this year when conducting the above public procurements, it is necessary to take into account the effect of the above Order, as well as inform potential suppliers about the need to obtain an industrial certificate (placement on official Internet resources).

On approval of the list of goods, works, services for which public procurement is carried out by a competitive tender with prequalification of bidders
In accordance with paragraph 1 of Article 31 of the Law of the Republic of Kazakhstan dated December 4, 2015 “On Public Procurement” I ORDER:
1. To approve the attached list of goods, works, services for which public procurement is carried out by a competitive tender process with preliminary qualification selection (hereinafter - the List).
2. To invalidate paragraph 1 of the order of the Minister of Finance of the Republic of Kazakhstan dated February 29, 2016 No. 91 “On approval of the list of goods, works, services for which public procurement is carried out by a competitive tender process and preliminary amendments and additions to the order of the Minister of Finance of the Republic Kazakhstan dated December 28, 2015 No. 694 “On approval of the Rules for the formation and maintenance of registers in the field of public procurement” (registered in the Register of State Registration of Normative Legal Acts under No. 13553, published in the legal information system “Udlet” on March 31, 2016).
3. To the Department of Public Procurement Law of the Ministry of Finance of the Republic of Kazakhstan, in the manner prescribed by law, ensure:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of registration of this order, send it in the Kazakh and Russian languages to the Republican state enterprise on the right of economic management “Institute of Legislation and Legal Information of the Republic of Kazakhstan” of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in the Reference Control Bank regulatory legal acts of the Republic of Kazakhstan;
3) the placement of this order on the Internet resource of the Ministry of Finance of the Republic of Kazakhstan;
4) within ten business days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, submission to the Department of Legal Services of the Ministry of Finance of the Republic of Kazakhstan of information on the implementation of measures provided for in subparagraphs 1), 2) and 3) of this paragraph.
4. This order is subject to official publication and comes into force on July 1, 2019, with the exception of paragraphs 4, 5 of the List, which come into force on January 1, 2020.
