General provisions
1) Information about the service provider.
The State institution "Department of State Architectural and Construction Control of the Akimat of Kostanay region" (hereinafter referred to as the Department) was established in accordance with the resolution of the Akimat of Kostanay region No. 9 of January 19, 2015.
The Regulation on Management was approved by the resolution of the Akimat of Kostanay region No. 43 dated January 01, 2017.
In accordance with the Regulation, the Management carries out its activities within the competence established by the legislation of the Republic of Kazakhstan:
1) conducting inspections in accordance with the current legislation of the Republic of Kazakhstan;
2) monitoring of objects and complexes under construction (planned for construction) in accordance with the procedure established by the authorized body for architecture, urban planning and construction;
3) making decisions on the application of the provided legislative measures to violators in connection with the violations and deviations from the norms of legislation, state regulatory requirements, conditions and restrictions established in the field of architectural, urban planning and construction activities;
4) control over the safe operation of dangerous technical devices operating under a pressure of more than 0.07 megaPascals or at a water heating temperature of more than 115 degrees Celsius, lifting mechanisms, escalators, cable cars, funiculars, elevators at housing and communal services facilities;
5) implementation of registration and de-registration of hazardous technical devices of housing and communal services facilities;
6) monitoring compliance with the requirements for the safe operation of household cylinders and gas supply system facilities;
7) implementation of state architectural and construction control and supervision over the quality of construction of objects, application of administrative measures established by the Code of the Republic of Kazakhstan on Administrative Offenses to violators of architectural and urban planning discipline at these objects;
8) implementation of licensing in the field of architectural, urban planning and construction activities;
9) certification of experts for the right to carry out expert work and engineering services in the field of architectural, urban planning and construction activities;
10) accreditation of project management organizations in the field of architecture, urban planning and construction;
11) implementation of state regulation of the activities of participants in the construction of shared-equity objects in housing construction in accordance with the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities;
12) issuing a permit to attract money from shareholders;
13) keeping records of issued permits to attract money from shareholders and agreements on equity participation in housing construction, as well as agreements on the assignment of rights to claims on them;
14) implementation of state control and supervision in the field of equity participation in housing construction;
15) performing other functions provided for by the current legislation of the Republic of Kazakhstan.

Working with service recipients
1) Information about the sources and places of access to information about the procedure for providing public services.
In accordance with article 19 of the Law of the Republic of Kazakhstan "On Public Services", the requirements and procedure for the provision of public services by service providers are determined by the standard of public services.
The standards of public services provided by the Department are posted on the website http://ugask.kostanay.gov.kz/.
The Department has an information stand for the provision of public services with a list of NPAs.

2) Information on public discussions of draft bylaws defining the procedure for the provision of public services.
The developer of the standards of public services provided by the Department is the Committee for Construction and Housing and Communal Services of the Ministry of Industry and Infrastructure Development of the Republic of Kazakhstan.
Standards have been developed and approved for all public services.
Prior to approval, the draft standards were discussed on the developer's Internet resource and the Open NPA Internet portal, as well as approved, including with the service provider.
3) Activities aimed at ensuring the transparency of the process of providing public services (explanatory work, seminars, meetings, interviews, etc.).
In 2019, the Department repeatedly participated in public service fairs organized by the Department of the Agency of the Republic of Kazakhstan for Civil Service Affairs in the Kostanay Region, where explanations were made and consultations were given on licensing and certification issues.
Activities to improve the processes of providing public services
1) Results of optimization and automation of the processes of rendering state services.
Currently, the process of providing the following public services in the information system of the State Budget Office "E – Licensing" has been optimized and automated:

"Accreditation of project management organizations in the field of architecture, urban planning and construction»;
"Certification of experts performing expert work and engineering services in the field of architectural, urban planning and construction activities";

2) Activities aimed at improving the skills of employees in the field of public services.
In April 2019, one employee of the Licensing and Certification department completed a refresher course for civil servants.
3) Regulatory and legal improvement of the processes of providing public services.
The processes of rendering public services are constantly being improved by the current regulatory and legal acts. For four public services, in accordance with the possibility provided for by the standards and with the requirement of paragraph 3, Article 52 of the Law of the Republic of Kazakhstan "On Permits and Notifications", licensing procedures from January 1, 2016 are carried out only in electronic form. These are licensing and certification processes.
The Standard of the state service "Accreditation of organizations for project management in the field of architecture, urban planning and construction" was amended by Order No. 499 of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated July 10, 2019 regarding the acceptance of the application and the deadline for the provision of the state service. According to the change, the service is fully automated and the delivery time is 20-40 minutes.
The Standards of public Services "Issuance of a license for exploration activities", "Issuance of a license for design activities", "Issuance of a license for construction and installation works", as well as by Order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated July 10, 2019 No. 499, were amended in terms of the term for the provision of public services. According to the amendment, the term for the provision of services is 5 working days (the day of receiving applications and documents is not included in the term for the provision of public services).
The Standard of the state service "Issuance of a permit to attract money from shareholders" was amended by the order of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan No. 506 dated July 15, 2019 in terms of accepting an application and issuing the result of the provision of a state service. According to the amendment, the acceptance of applications and the issuance of the results of the provision of public services is carried out through the non-profit joint-stock company "State Corporation "Government for Citizens" and the web portal "electronic government".
