Project on approval of the rules for holding separate meetings of the local community of Sholakashi rural district of Karasu District of Kostanay region and the quantitative composition of representatives of rural residents to participate in the meeting of the local community
In accordance with paragraph 6 of Article 39-3 of the law of the Republic of Kazakhstan" on local public administration and self-government in the Republic of Kazakhstan", the Order of the minister of national economy of the Republic of Kazakhstan dated June 23, 2023 No. 122" on approval of standard rules for holding separate meetings of the local community " was decided by the Karasu district maslikhat:
Approve the attached rules for holding separate meetings of the local community in Sholakashi rural district of Karasu District of Kostanay region.
To approve the quantitative composition of representatives of the population of villages to participate in the meeting of the local community of Sholakashi rural district of Karasu District of Kostanay region in accordance with the annex to this decision.
This decision shall enter into force on the expiration of ten calendar days after the date of its first official publication.

Rules for holding separate meetings of the local community of Sholakashi rural district of Karasu District of Kostanay region
General provisions
The rules for holding separate meetings of the local community in Sholakashi rural district of Karasu District of Kostanay region are developed in accordance with paragraph 6 of Article 39-3 of the law of the Republic of Kazakhstan"on local public administration and self-government in the Republic of Kazakhstan", order of the minister of national economy of the Republic of Kazakhstan dated June 23, 2023 No. 122 "on approval of standard rules for holding separate meetings of the local community", and establish the procedure for holding separate meetings of the local community of residents of the villages of Sholakashi rural district.
The following basic concepts are used in these rules:
1) separate meetings of the local community-direct participation of residents of villages, rural districts, streets (members of the local community) in the election of Representatives for participation in the meeting of the local community;
2) local community-a set of residents (members of the local community) living on the territory of the relevant administrative-territorial unit, within the borders of which local self-government is carried out, its bodies are created and operate.
Procedure for holding separate meetings of the local community
For holding separate meetings of the local community, the territory of the Sholakashi rural district is divided into plots (villages).
At separate meetings of the local community, representatives are elected to participate in the meeting of the local community, the number of which does not exceed three people.
Akim of sholakashi rural district invites and organizes a separate meeting of the local community within the villages of Sholakashi rural district.
The population of the local community is informed by the Akim of the Sholakashi rural district about the time, place of convening separate meetings of the local community and the issues under discussion no later than ten calendar days before the date of holding them through the mass media or other means.
Before opening a separate meeting of the local community, registration of the participating residents of the relevant village is carried out.
Participation of minors, persons recognized by the court as legally incompetent, as well as persons held in places of deprivation of liberty by a court sentence, in a separate gathering of the local community is not allowed.
A separate meeting of the local community is considered to have taken place when at least ten percent of the residents (members of the local community) living in this village were present.
A separate meeting of the local community is opened by the Akim of Sholakashi rural district or a person authorized by him.
The mayor of sholakashi rural district or a person authorized by him is the chairman of a separate meeting of the local community.
A protocol is kept at a separate meeting of the local community, and a secretary is elected by open voting to draw up a protocol of a separate meeting of the local community.
Candidates for representatives of residents of villages of sholakashi rural district are submitted by participants of a separate local community meeting for participation in the local community meeting in accordance with the quantitative composition approved by the Karasu district maslikhat.
Voting is conducted independently for each candidate in an open way.It is believed that the candidates who received the most votes of the participants of a separate meeting of the local community were elected.
The chairman of a separate meeting shall exercise the right to a decisive vote if, when voting at a separate meeting of the local community, the votes of the participants are divided equally.
The minutes of a separate meeting of the local community are signed by the chairman and secretary and, within two working days from the date of the separate meeting, are transferred by the secretary of the meeting to the Office of the Akim of Sholakashi rural district for registration.
A protocol is kept at a meeting of the local community or at a meeting of the local community, in which:
1) date and place of the meeting of the local community or meeting of the local community;
2) the total number of members of the local community living in the relevant territory and having the right to participate in a meeting of the local community or a meeting of the local community;
3) the number and list of participants indicating their last name, first name, patronymic (if any) ;
4)surname, first name, patronymic (if any) of the chairman and Secretary of the local community meeting or meeting of the local community;
5) the agenda, the content of the speech and the decisions made.
