The Department of Agriculture of the Akimat of the Karabalyk district (hereinafter referred to as the Department) is a subordinate institution of the Akimat of the Karabalyk district that performs managerial functions in the field of agriculture, state control and supervision in the regulated sphere.
In the period from June 13 to June 14, 2022, an internal analysis of corruption risks was conducted in the State Institution "Department of Agriculture of the Akimat of the Karabalyk district".
Analysis period: 5 months of 2022.
Internal analysis was carried out in the following areas: - identification of corruption risks in regulatory legal acts and legal acts affecting the activities of the Department; - identification of corruption risks in the organizational and managerial activities of the Department.
1. In the direction of: "Identification of corruption risks in regulatory legal acts and legal acts affecting the activities of the department" studied: the Labor Code of the Republic of Kazakhstan, the Administrative Procedural Code of the Republic of Kazakhstan, the Laws of the Republic of Kazakhstan "On Public Services", "On Public procurement", the Order of the acting Minister of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan "On approval of the register of public Services", Orders of the Minister of Agriculture "On approval of the Rules for admission of exams and issuance of certificates for the right to drive tractors ...", "On approval of the Rules of state registration of tractors ...", "On approval of the Rules of state registration of pledge tractors ...", "On approval of the Rules of the annual state technical inspection of tractors...".
According to the results of the analysis conducted in the direction of "Identification of corruption risks in regulatory legal acts and legal acts affecting the activities of the department", it was found that corruption-related legal norms comply with the rules of legal technique, discretionary powers and norms that contribute to the commission of corruption offenses were not identified.
2. In the direction: "Identification of corruption risks in the organizational and managerial activities of the Department" the following indicators are analyzed:
a) Personnel management:
The structure and the limit of the staffing of the Department are approved in accordance with the current legislation. The staffing of the Department is 12 units, of which 7 are civil servants (including 1 vacancy), 5 are freelance employees (including 2 are decree, i.e. the places are vacant).
For 5 months of 2022, the following personnel changes took place in the Department: the head of the Department Zhunusov Kadyrzhan Kayyrzhanovich (administrative civil servant) was relieved of his post by the order of the akim of the Karabalyk district No. 127-r/l dated 04/25/2022. The turnover of personnel occurred due to the occupation of another administrative public position from April 27, 2022.
By order of the akim of the Karabalyk district No. 128-r/l dated 04/25/2022, the duties of the head of the department were temporarily assigned to the deputy head of the department, S.A. Zeynalova.
By order of the akim of the Karabalyk district No. 152-r/l dated 05/16/2022, Urtembayev Ernar Taipovich was appointed head of the department from May 16, 2022 (according to the results of the competition).
The job descriptions of civil servants of the Department fully reflect the official rights and duties, there are no facts of duplication of duties of employees.
The provision of vacations to employees is carried out in accordance with the approved schedule and strictly in accordance with the Law of the Republic of Kazakhstan "On Public Service of the Republic of Kazakhstan" and the Labor Code of the Republic of Kazakhstan.
There are no facts of awarding employees who have not withdrawn a disciplinary penalty.
During the analyzed period, there were no facts of bringing the Department's employees to responsibility for committing corruption offenses, as well as misconduct discrediting the public service.
There are no government employees dismissed for negative reasons in the Department.
b) Conflict of interest settlement:
There is no conflict of interest in the Department.
c) Provision of public services:
According to the Register of Public Services, the Department provides 4 types of public services. Information about the provision of these services is posted on the official website of the akim of the Karabalyk district.
For 5 months of 2022, the Department provided 433 public services.
36 public services were provided through the State Corporation, 397 public services were provided through the electronic licensing web portal. The applications of the service recipients were reviewed by the Department in accordance with the established procedure and within the established time frame. As of June 1, 2022, there were no complaints about the quality of public services.
d) implementation of control functions:
According to the Regulations, there is no implementation of licensing and control functions in the Department.
e) Other issues arising from organizational and managerial activities:
In the 1st quarter of 2022, the chief specialist of the Department of Public Services of the Department of Informatization, Provision of Public Services and Archives of the Akimat of Kostanay region Saliy N.A. conducted a control event of the Department's activities on compliance with legislation on public services for the period from January 1, 2021 to January 2022. Following the results of the control event, recommendations were made and instructions were given.
Over the past period, corruption crimes and offenses have not been registered against the employees of the Department.
Public procurement is carried out by the Department in accordance with the provisions of the Law of the Republic of Kazakhstan "On Public Procurement". In 5 months of 2022, 18 public procurement contracts were concluded. These contracts are executed and posted on the web portal of public procurement (www.goszakup.gov.kz ), of which: by way of requesting price offers – 4 contracts, from one source by direct conclusion – 6 contracts, from one source for failed purchases – 8 contracts.
As of June 1, 2022, the clerk of the Department registered 804 official documents, 48 appeals from legal entities, 89 appeals from individuals. In accordance with the norms of the Administrative Procedural Code of the Republic of Kazakhstan, the terms and procedure for consideration of appeals are strictly observed. There were no repeated requests. The appeals were considered in due time. Office work on the appeals of individuals and legal entities is conducted separately, in accordance with the procedure established by the legislation of the Republic of Kazakhstan. The registration of appeals is carried out in an automated information system and in the logs of registration of appeals of individuals and legal entities. Appeals received through the PEP are registered in a timely manner. There are no complaints or repeated requests.
There were no violations of the deadlines for the execution of documents during the reporting period.
There were no critical publications on the activities of the department for the analyzed period on the website of the akim of the district and in the media.
According to the results of an internal analysis, corruption risks in the activities of the State Institution "Department of Agriculture of the Akimat of the Karabalyk district" were not revealed.
