In accordance with the Law of the Republic of Kazakhstan “On Religious Activities and Religious Associations”, before being invited to participate in the activities of religious associations, a foreign missionary must have a legalized or apostilled document certifying the official registration of the religious association,
as well as a special invitation from a citizen by a religious association registered in the country.
In accordance with paragraph 1 of Article 9 of the Law of the Republic of Kazakhstan “On Religious Activities and Religious Associations” (hereinafter referred to as the Law), religious objects are objects, products and attributes necessary for worship, religious rites and ceremonies, as well as containing elements of religious symbols.
Due to the fact that, according to Article 6 of the Law, these items are classified as objects of religious studies examination, they are subject to a religious studies examination to clarify the circumstances of their religious affiliation. Based on the results of the religious studies examination, a corresponding letter will be issued determining whether the subject is classified as religious.
In accordance with the legislation of the country (Articles 47 and 49 of the Law “On Education”), compliance with school uniforms is mandatory for students, and the fulfillment of this obligation is assigned to parents.
Also, according to paragraph 4 of Art. 3 of the Law “On Religious Activities and Religious Associations”, the education and upbringing system in the Republic of Kazakhstan, with the exception of spiritual (religious) educational organizations, is separated from religions and religious associations and is secular in nature.
That is, social relations, including in the field of education, are regulated by current legislation, and not by religious norms.
Thus, the Constitution and laws of the Republic of Kazakhstan provide citizens with corresponding rights, while simultaneously defining their responsibilities to the state and society.
Moreover, these norms do not subject to any discrimination based on attitudes towards religion. Based on the above, we urge parents to comply with the mandatory school uniform for secondary education organizations, approved by order of the Minister of Education and Science of the Republic of Kazakhstan.
The religious association of Jehovah's Witnesses is officially registered with the justice authorities of the Republic of Kazakhstan and carries out its activities in accordance with the legislation of the country.
Participation in the religious activities of the association is based on voluntary principles. Every member of the community has the right to leave it.
If, in your opinion, any illegal actions occur, including coercive measures on the part of the leadership of a religious association, each member of the community has the right to apply to law enforcement agencies, as well as, in the manner prescribed by law, to court for the protection of violated or disputed constitutional rights, freedoms or interests protected by law.
Regarding the situation surrounding Jehovah's Witnesses in the Russian Federation, the decisions of the judicial authorities of the Russian Federation are not grounds for banning them on the territory of the Republic of Kazakhstan.
