The Akimat of the Beimbeta Maylin District DECIDES:

Amend the resolution of the Akimat of the Beimbeta Mailina district "On approval of the regulations on state institutions of the Akimat of the Beimbeta Mailina district and the apparatuses of akims of rural districts, the village of Tobol of the Beimbeta Mailina district" dated September 14, 2023, No. 233 as follows:

Appendix 8 "Regulations on the state institution "Department of Employment and Social Programs of the Akimat of the Beimbet Maylin District" shall be set out in a new version in accordance with the appendix to this resolution.

The State Institution "Department of Employment and Social Programs of the Akimat of Beimbet Maylin District" shall, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, ensure:

1) within five working days from the date of signing this resolution, sending a copy of it in electronic form in the state and Russian languages to the branch of the Republican state enterprise on the right of economic management "Institute of Legislation and Legal Information of the Republic of Kazakhstan" of the Ministry of Justice of the Republic of Kazakhstan for Kostanay region for official publication and inclusion in the Reference Control Bank of regulatory legal acts of the Republic of Kazakhstan;

2) posting this resolution on the Internet resource of the Akimat of the Beimbet Maylin district after its official publication.

3) adoption of other necessary measures arising from this resolution.

Control over the implementation of the resolution shall be assigned to the head of the district akim’s office, Beimbet Mailin.
This resolution shall come into effect upon expiration of ten calendar days from the date of its first official publication.

Regulations on the state institution "Department of Employment and Social Programs of the Akimat of the Beimbet Maylin District"

Chapter 1. General Provisions

The State Institution "Department of Employment and Social Programs of the Akimat of Beimbet Maylin District" (hereinafter referred to as the Department) is a state body of the Republic of Kazakhstan that exercises leadership in the field of employment, social protection of the population, provision of special social services for the elderly, persons with disabilities, including children with disabilities, and day care at home.
The department has a subordinate institution: the municipal state institution "Center for the provision of special social services of the Department of Employment and Social Programs of the Akimat of the Beimbet Mailina District".
The Department carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
The Department is a legal entity in the organizational and legal form of a state institution, has a seal with the image of the State Emblem of the Republic of Kazakhstan and stamps with its name in the Kazakh language, forms of the established form, accounts in the treasury bodies in accordance with the legislation of the Republic of Kazakhstan.
The Department has the right to enter into civil law relations on its own behalf.
The Department has the right to act as a party to civil-legal relations on behalf of the state, if it is authorized to do so in accordance with the legislation of the Republic of Kazakhstan.
The Department, on matters within its competence, in the manner prescribed by law, makes decisions, which are formalized by orders of the Head of the Department and other acts stipulated by the legislation of the Republic of Kazakhstan.
The structure and staffing limits of the Department are approved in accordance with the legislation of the Republic of Kazakhstan.
Location of the legal entity: 111700, Republic of Kazakhstan, Kostanay region, Beimbet Mailina district, Ayet village, Tauelsizdik street, 87.
These regulations are the founding document of the Department.
Financing of the Department’s activities is carried out from the republican and local budgets in accordance with the legislation of the Republic of Kazakhstan.
The Department is prohibited from entering into contractual relations with business entities for the purpose of performing duties that are within the powers of the Department.

If the Department is granted the right by legislative acts to carry out income-generating activities, then the income received is directed to the state budget, unless otherwise established by the legislation of the Republic of Kazakhstan.

Chapter 2. Tasks and powers of the state body.

Tasks:

1) Coordination and organization of the provision of social assistance to socially vulnerable groups of the population in accordance with the current legislation of the Republic of Kazakhstan;

2) Implementation of state programs to promote employment and social protection of the population;

3) Protection of the rights of citizens and their interests, state guarantees provided for by current legislation on employment and social protection;

4) Other tasks provided for by the legislation of the Republic of Kazakhstan.

Powers:

1) Rights:

issue, within the limits of its competence, orders and other acts that are mandatory for execution by the subordinate institution;

within the limits of its competence, request and receive in the established manner from government agencies and other organizations the necessary information, materials and documents;

plan its core activities and determine the development of the employment and social protection sectors in agreement with local executive bodies;

2) Responsibilities:

represent the local executive body on issues of employment and social protection of the population, in government bodies and organizations, in accordance with this Regulation;

comply with the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation;

improve the quality and accessibility of the provision of public service standards;

exercise other rights in accordance with the legislation of the Republic of Kazakhstan.

Functions:

1) coordination of the activities of the subordinate municipal state institution;

2) development of draft regulatory legal acts, ensuring their adoption;

3) participation in the development of regional programs aimed at stabilizing and improving the standard of living of the population, analysis of their implementation;

4) forecasting the need for budgetary funds and implementing social programs in accordance with the current legislation of the Republic of Kazakhstan;

5) implementation of state social policy in the area of providing special social services, targeted social assistance to the population and measures to reduce poverty;

6) preparation and submission of statistical and departmental reports, monitoring of the maintenance of automated information systems within the competence of the Department;

7) formation of a budget application for the current year, an indicative development plan;

8) ensuring the conduct of public procurement in accordance with the legislation of the Republic of Kazakhstan;

9) assignment and payment of housing assistance;

10) appointment and payment of other types of social assistance provided for by the legislation of the Republic of Kazakhstan;

11) financial support for children with disabilities raised and educated at home;

12) provision of persons with disabilities in need with prosthetic and orthopedic, audio-technical and typhlo-technical devices, special mobility aids, mandatory hygiene products, as well as provision of spa treatment services, a sign language specialist, and individual assistants in accordance with the individual rehabilitation program for the disabled person

13) ensuring the rights and improving the quality of life of persons with disabilities in the Republic of Kazakhstan;

14) reception and consultation of individuals and representatives of legal entities;

15) consideration of appeals from individuals and legal entities and adoption of necessary measures;

16) interaction with non-profit (non-governmental) organizations;

17) implementation of guardianship and trusteeship functions in relation to adult incapacitated citizens in accordance with the legislation of the Republic of Kazakhstan;

18) issuance, extension and revocation of permits for labor immigrants

19) implementation, within the limits of its competence, of state policy in the field of employment of the population and measures to ensure promotion of employment;

20) registration of documents for spa treatment for participants of the Great Patriotic War and persons equal to them in terms of benefits and guarantees;

21) control over the work of home care for elderly citizens and disabled people;

22) conducting an analysis of the population’s needs for special social services;

23) interaction with individuals and legal entities and government agencies on issues of providing special social services;

24) control and assistance in the implementation of the social part of individual rehabilitation programs for persons with disabilities;

25) making a decision on the provision of special social services to a person (family) in a difficult life situation;

26) implementation of state policy in the sphere of provision of special social services within the limits of its competence;

27) implementation of the functions of the working body of the special commission to establish the length of service of persons who worked for at least 6 months in the period from June 22, 1941 to May 9, 1945;

28) performing the functions of the working body of the special commission for the registration and accounting of citizens affected by nuclear tests at the Semipalatinsk nuclear test site. Issuance of certificates confirming the right to benefits and compensation for victims of nuclear tests at the Semipalatinsk nuclear test site;

29) implementation of the functions of the working body of a special commission for reviewing applications from individuals (families) applying for social assistance in connection with the onset of a difficult life situation, and making conclusions on the need to provide social assistance;

30) participation in court in criminal and civil cases against adult citizens on issues of guardianship and trusteeship;

31) considers appeals from individuals and legal entities and takes the necessary measures on them;

32) implementation of other functions provided for by the legislation of the Republic of Kazakhstan.

Chapter 3. Status and powers of the first head of a state body.

The Department is managed by the First Manager, who is personally responsible for the fulfillment of the tasks assigned to the Department and the exercise of its powers.
The first head of the Department is appointed to the position and dismissed from the position by the district akim in accordance with the current legislation of the Republic of Kazakhstan.
Powers of the First Head of the Department:

1) organizes and manages the work of the Department and bears personal responsibility for the performance of assigned tasks and functions;

2) appoints and dismisses employees in accordance with the legislation of the Republic of Kazakhstan;

3) approves regulations on structural divisions, issues orders and gives instructions that are mandatory for execution;

4) takes measures aimed at combating corruption in the department and bears personal responsibility for the adoption of inappropriate anti-corruption measures

5) in accordance with the procedure established by law, resolves issues of incentives, provision of financial assistance, and imposition of disciplinary sanctions;

6) acts on behalf of a government agency without a power of attorney;

7) conducts personal reception of citizens and representatives of legal entities, considers appeals from individuals and legal entities within the timeframes established by law, and takes the necessary measures on them;

8) signs official documentation;

9) exercises other powers in accordance with the legislation of the Republic of Kazakhstan on issues within its competence.

The powers of the head of the Department shall be exercised during his absence by the person replacing him in accordance with the current legislation of the Republic of Kazakhstan.

Chapter 4. Property of a state body.

The department may have separate property under the right of operational management in cases stipulated by law.

The Department's assets are formed from assets transferred to it by the owner, as well as assets (including cash income) acquired as a result of its own activities, and other sources not prohibited by the legislation of the Republic of Kazakhstan.

The property assigned to the Department is municipal property.
The Department does not have the right to independently alienate or otherwise dispose of the property assigned to it and the property acquired using funds issued to it under the financing plan, unless otherwise provided by law.
Reorganization and abolition of a state institution
The reorganization and abolition of the Department shall be carried out in accordance with the legislation of the Republic of Kazakhstan.

List of organizations under the jurisdiction of the Department:

Municipal state institution "Center for the provision of special social services of the department of employment and social programs of the Akimat of the Beimbet Maylin district".
